投標(biāo)須知
Instructions to Bidders
1、凡具有法人資格，有生產(chǎn)能力或供應(yīng)能力，能滿足需方技術(shù)要求及信譽良好的供應(yīng)商，均可參加投標(biāo)。
1. All suppliers who have legal
personality, production or supply capacity, and sound reputation, and meet
the technical requirements of the Employer, can submit a bid.
2、投標(biāo)方應(yīng)遵守國家的有關(guān)法律、法令和條例。
2. All bidders shall abide by the relevant
laws, decrees and regulations of China.
3、投標(biāo)企業(yè)注冊資金不能少于500萬元人民幣
，特殊情況須單獨說明。
3. All bidders shall have a registered
capital of not less than RMB 5 million Yuan, and if there is any special
circumstance, specify separately.
4、投標(biāo)委托：如投標(biāo)方代表不是法人代表，須持有《法人代表授權(quán)委托書》
4. Authorization of bidding: in case the
bidder’s representative is not a legal representative, he/she shall hold a
Power of Attorney of the Legal Representative.
5、投標(biāo)方是否中標(biāo)均自行承擔(dān)所有與參加投標(biāo)有關(guān)的費用。
5. The bidder shall bear any and all
expenses incurred in connection with its participation in the bid, no matter
whether it is awarded the contract.
6、投標(biāo)保證金：（如不能滿足以下關(guān)于投標(biāo)保證金的要求，取消投標(biāo)資格）
6. Bid security: (If a bidder
doesn’t satisfy the following requirements for the bid security, it will be
disqualified for bidding.)
（1）投標(biāo)方應(yīng)提供不少于招標(biāo)金額3%的投標(biāo)保證金。
(1) The bidder shall provide a bid
security of not less than 3% of the tender amount.
（2）為了方便投標(biāo)保證金的及時退還，投標(biāo)保證金應(yīng)在開標(biāo)前必須以電匯方式提前兩天交招標(biāo)方，招標(biāo)前將電匯底單復(fù)印件及標(biāo)書費一并上交招標(biāo)單位工作人員。（不收取銀行承兌、匯票、轉(zhuǎn)賬支票，不得以貨款作為保證金。）
(2) In order to facilitate the timely
refund of the bid security, the bid security shall be wired to the
tenderee within two days prior to the bid opening, and the copy of
the stub of wire transfer and payment of the tender document shall be
submitted and made to the tenderee’s relevant staff. (No bank acceptance
bill, draft or transfer check will be collected, and no payment for goods
may be taken as the bid security.)
要求保證金的電匯底單上必須清楚的注明投標(biāo)單位的開戶行（具體到支行）、銀行賬號、抬頭等信息，以方便我司及時準(zhǔn)確的退還保證金。
The stub of wire transfer of the bid
security must be clearly stated the bidder’s bank (specific to the
sub-branch), bank account No., and account name, so as to facilitate our
timely and accurate refunding of the bid security.
（3）中標(biāo)方的保證金，在與買方簽定合同后留作履約保證金，貨到后無息退還。
(3) The bid security of the winning bidder
shall be retained as the performance bond after it signs the contract with
the buyer, and then refunded without interest after the goods are delivered.
（4）落標(biāo)方的保證金，在落標(biāo)后按照電匯底單復(fù)印件的銀行信息以電匯方式無息退還。
(4) The bid security of the losing
bidders shall be refunded without interest via wire transfer according to
the bank information indicated on the copy of the stub of wire transfer.
（5）在投標(biāo)有效期內(nèi)，投標(biāo)方撤回標(biāo)書和不按中標(biāo)通知的時間、地點簽定合同的，保證金將被沒收。
(5) Within the validity of the bid, where the
bidder withdraws its bidding document or fails to sign the contract at the
time and in the place stipulated in the letter of acceptance, the bid
security of the bidder will be forfeited.

10、招標(biāo)文件的澄清：
10. Clarification of tender document:
投標(biāo)方對招標(biāo)文件如有疑點要求澄清，或認(rèn)為有必要與用戶進(jìn)行交流時，要用書面、傳真、電報形式通知招標(biāo)方，招標(biāo)方用同樣形式做出回答。
Where the bidder requests clarification for any question
about the tender document or considers it necessary to communicate with the
users, it shall notify the tenderee in writing, or by fax or telex, and the
tenderee shall answer in the same form.
11、招標(biāo)文件的修改：
11. Amendment of tender
document:
（1）在投標(biāo)截止時間前，招標(biāo)方無論出于自己的考慮，還是對投標(biāo)方提出的澄清，均可對招標(biāo)文件用補充文件的方式進(jìn)行修改。
(1) Before the deadline for bidding, the
tenderee can amend the tender document in the way of supplementary
documents, either for the cause of its own consideration or for the
clarification of what the bidders put forward.
（2）對招標(biāo)文件修改，將以書面、傳真、電報形式通知已收到招標(biāo)文件的投標(biāo)方，補充文件將作為招標(biāo)文件的組成部分，對所有投標(biāo)方都具有約束力。
(2) Any amendment made to the tender document
shall be made notified to the bidders receiving the tender document in
writing or by fax or telex, and the supplementary document(s) shall be an
integral part of the tender document and binding on all bidders.
