出入境檢驗(yàn)檢疫代理報(bào)檢管理規(guī)定-中英對(duì)照法律英語(yǔ)

第一章 總 則
第一條
為加強(qiáng)對(duì)代理報(bào)檢行為的監(jiān)督管理,規(guī)范代理報(bào)檢行為,根據(jù)《中華人民共和國(guó)進(jìn)出口商品檢驗(yàn)法》及其實(shí)施條例、《中華人民共和國(guó)進(jìn)出境動(dòng)植物檢疫法》及其實(shí)施條例、《中華人民共和國(guó)國(guó)境衛(wèi)生檢疫法》及其實(shí)施細(xì)則、《中華人民共和國(guó)食品衛(wèi)生法》等法律法規(guī)的規(guī)定,制定本規(guī)定。
第二條
本規(guī)定所稱代理報(bào)檢,是指經(jīng)國(guó)家質(zhì)量監(jiān)督檢驗(yàn)檢疫總局(以下簡(jiǎn)稱國(guó)家質(zhì)檢總局)注冊(cè)登記的境內(nèi)企業(yè)法人(以下稱代理報(bào)檢單位)依法接受進(jìn)出口貨物收發(fā)貨人的委托,為進(jìn)出口貨物收發(fā)貨人辦理報(bào)檢手續(xù)的行為。
第三條
國(guó)家質(zhì)檢總局統(tǒng)一管理全國(guó)代理報(bào)檢工作,負(fù)責(zé)對(duì)代理報(bào)檢單位的注冊(cè)登記;各直屬出入境檢驗(yàn)檢疫局(以下簡(jiǎn)稱直屬檢驗(yàn)檢疫局)負(fù)責(zé)所轄地區(qū)代理報(bào)檢單位的初審和年度考核工作;各地出入境檢驗(yàn)檢疫機(jī)構(gòu)(以下簡(jiǎn)稱檢驗(yàn)檢疫機(jī)構(gòu))負(fù)責(zé)代理報(bào)檢單位的日常監(jiān)督管理工作。
第四條 代理報(bào)檢單位應(yīng)當(dāng)經(jīng)國(guó)家質(zhì)檢總局注冊(cè)登記,未經(jīng)注冊(cè)登記的單位不得從事代理報(bào)檢業(yè)務(wù)。
第五條 代理報(bào)檢單位在接受委托辦理報(bào)檢等相關(guān)事宜時(shí),應(yīng)當(dāng)遵守有關(guān)出入境檢驗(yàn)檢疫法律法規(guī)規(guī)定,并對(duì)代理報(bào)檢各項(xiàng)內(nèi)容的真實(shí)性、合法性負(fù)責(zé),承擔(dān)相應(yīng)的法律責(zé)任。
第二章 代理報(bào)檢單位的注冊(cè)登記
第六條 申請(qǐng)代理報(bào)檢注冊(cè)登記的單位(以下簡(jiǎn)稱申請(qǐng)單位)應(yīng)當(dāng)具備下列條件:
?。ㄒ唬┤〉霉ど绦姓芾聿块T頒發(fā)的《企業(yè)法人營(yíng)業(yè)執(zhí)照》;
(二)注冊(cè)資金人民幣150萬(wàn)元以上;
(三)有固定營(yíng)業(yè)場(chǎng)所及符合辦理檢驗(yàn)檢疫報(bào)檢業(yè)務(wù)所需的設(shè)施;
?。ㄋ模┯薪∪墓芾碇贫?;
?。ㄎ澹┯胁簧儆?0名取得《報(bào)檢員資格證》的人員;
?。﹪?guó)家質(zhì)檢總局規(guī)定的其他條件。
第七條 申請(qǐng)單位應(yīng)當(dāng)向所在地直屬檢驗(yàn)檢疫局提出申請(qǐng)并提交下列材料:
?。ㄒ唬洞沓鋈刖硻z驗(yàn)檢疫報(bào)檢注冊(cè)登記申請(qǐng)書》;
?。ǘ镀髽I(yè)法人營(yíng)業(yè)執(zhí)照》復(fù)印件(同時(shí)交驗(yàn)正本);
?。ㄈM任報(bào)檢員的《報(bào)檢員資格證》復(fù)印件(同時(shí)交驗(yàn)正本);
?。ㄋ模┐韴?bào)檢企業(yè)的印章印模;
(五)國(guó)家質(zhì)檢總局規(guī)定需提交的其他文件。
第八條 直屬檢驗(yàn)檢疫局對(duì)申請(qǐng)單位的申請(qǐng)進(jìn)行初審,初審合格的,報(bào)國(guó)家質(zhì)檢總局審核,經(jīng)審核合格,頒發(fā)《代理出入境檢驗(yàn)檢疫報(bào)檢登記證書》(以下簡(jiǎn)稱《登記證書》)。
取得《登記證書》的代理報(bào)檢單位,應(yīng)當(dāng)在國(guó)家質(zhì)檢總局批準(zhǔn)的區(qū)域內(nèi)從事代理報(bào)檢業(yè)務(wù)。
第九條 代理報(bào)檢單位名稱、地址、法定代表人、經(jīng)營(yíng)范圍等重大事項(xiàng)發(fā)生變更的,應(yīng)當(dāng)在變更之日起15日內(nèi)以書面形式報(bào)所在地直屬檢驗(yàn)檢疫局。
第三章 代理報(bào)檢行為
第十條 進(jìn)口貨物的收貨人可以在報(bào)關(guān)地和收貨地委托代理報(bào)檢單位報(bào)檢,出口貨物發(fā)貨人可以在產(chǎn)地和報(bào)關(guān)地委托代理報(bào)檢單位報(bào)檢。
第十一條 接受委托的代理報(bào)檢單位應(yīng)當(dāng)完成下列代理報(bào)檢行為:
?。ㄒ唬┺k理報(bào)檢手續(xù);
?。ǘ├U納檢驗(yàn)檢疫費(fèi);
(三)聯(lián)系配合檢驗(yàn)檢疫機(jī)構(gòu)實(shí)施檢驗(yàn)檢疫;
?。ㄋ模╊I(lǐng)取檢驗(yàn)檢疫證單和通關(guān)證明;
(五)其他與檢驗(yàn)檢疫工作有關(guān)的事宜。
第十二條 代理報(bào)檢單位接受收發(fā)貨人的委托,應(yīng)當(dāng)遵守法律法規(guī)對(duì)收發(fā)貨人的各項(xiàng)規(guī)定。
第十三條 代理報(bào)檢單位在報(bào)檢時(shí),應(yīng)當(dāng)向檢驗(yàn)檢疫機(jī)構(gòu)提交報(bào)檢委托書。
報(bào)檢委托書應(yīng)當(dāng)載明委托人的名稱、地址、法定代表人姓名(簽字)、機(jī)構(gòu)性質(zhì)及經(jīng)營(yíng)范圍;代理報(bào)檢單位的名稱、地址、代理事項(xiàng),以及雙方責(zé)任、權(quán)利和代理期限等內(nèi)容,并加蓋雙方的公章。
第十四條 代理報(bào)檢單位應(yīng)當(dāng)按照相關(guān)規(guī)定規(guī)范報(bào)檢員的報(bào)檢行為,并對(duì)報(bào)檢員的報(bào)檢行為承擔(dān)法律責(zé)任。
第十五條 代理報(bào)檢單位應(yīng)當(dāng)按照檢驗(yàn)檢疫機(jī)構(gòu)的要求,負(fù)責(zé)落實(shí)檢驗(yàn)檢疫場(chǎng)地、時(shí)間等有關(guān)事宜。
第十六條 代理報(bào)檢單位對(duì)實(shí)施代理報(bào)檢中所知悉的商業(yè)秘密負(fù)有保密義務(wù)。
第十七條 代理報(bào)檢單位應(yīng)當(dāng)按照規(guī)定代委托人繳納檢驗(yàn)檢疫費(fèi),不得借檢驗(yàn)檢疫機(jī)構(gòu)名義向委托人收取額外費(fèi)用。
代理報(bào)檢單位應(yīng)當(dāng)將向檢驗(yàn)檢疫機(jī)構(gòu)的繳費(fèi)情況以書面形式如實(shí)通知委托人,檢驗(yàn)檢疫機(jī)構(gòu)對(duì)此可隨時(shí)進(jìn)行抽查、核實(shí)。
第十八條 代理報(bào)檢單位應(yīng)當(dāng)嚴(yán)格按照有關(guān)規(guī)定向委托人收取代理報(bào)檢中介服務(wù)費(fèi)。
第四章 監(jiān)督管理
第十九條 檢驗(yàn)檢疫機(jī)構(gòu)對(duì)代理報(bào)檢單位實(shí)行年度審核制度。代理報(bào)檢單位應(yīng)當(dāng)在每年3月31日前向所在地直屬檢驗(yàn)檢疫局申請(qǐng)年度審核,并提交上一年度的《年審報(bào)告書》。
《年審報(bào)告書》的主要內(nèi)容包括:年度代理報(bào)檢業(yè)務(wù)情況及分析,財(cái)務(wù)報(bào)告,報(bào)檢差錯(cuò)及原因,遵守檢驗(yàn)檢疫相關(guān)規(guī)定情況及自我評(píng)估等。
獲得國(guó)家質(zhì)檢總局注冊(cè)登記不滿1年的,本年度可不參加年審。
直屬檢驗(yàn)檢疫局應(yīng)當(dāng)將代理報(bào)檢單位年審情況報(bào)國(guó)家質(zhì)檢總局備案。
第二十條 代理報(bào)檢單位應(yīng)當(dāng)配合檢驗(yàn)檢疫機(jī)構(gòu)對(duì)其所代理報(bào)檢的事項(xiàng)進(jìn)行調(diào)查和處理。
第二十一條 代理報(bào)檢單位不得以任何形式出讓其名義供他人辦理代理報(bào)檢業(yè)務(wù)。
第二十二條 代理報(bào)檢單位應(yīng)當(dāng)建立、健全代理報(bào)檢業(yè)務(wù)檔案,真實(shí)完整地記錄其承辦的代理報(bào)檢業(yè)務(wù),并自覺(jué)接受檢驗(yàn)檢疫機(jī)構(gòu)的日常監(jiān)督和年度審核。
第二十三條 代理報(bào)檢單位可以以電子方式向檢驗(yàn)檢疫機(jī)構(gòu)進(jìn)行申報(bào),但不得利用電子報(bào)檢企業(yè)端軟件進(jìn)行遠(yuǎn)程電子預(yù)錄入。
第二十四條 代理報(bào)檢單位有下列情況之一的,直屬檢驗(yàn)檢疫局可以暫停其3個(gè)月或者6個(gè)月的代理報(bào)檢資格:
?。ㄒ唬┯羞`反檢驗(yàn)檢疫報(bào)檢規(guī)定行為的;
(二)提供不真實(shí)情況,導(dǎo)致代理報(bào)檢的貨物不能落實(shí)檢驗(yàn)檢疫的;
(三)對(duì)報(bào)檢員管理不嚴(yán),多人次被取消報(bào)檢資格的;
(四)未經(jīng)檢驗(yàn)檢疫機(jī)構(gòu)同意延遲參加年審的;
?。ㄎ澹┻`反本規(guī)定第十六條規(guī)定,泄露實(shí)施代理報(bào)檢中所知悉的商業(yè)秘密的;
?。┻`反本規(guī)定第十七條規(guī)定,未按照規(guī)定代委托人繳納檢驗(yàn)檢疫費(fèi)或者未將向檢驗(yàn)檢疫機(jī)構(gòu)的繳費(fèi)情況以書面形式通知委托人的,或者借檢驗(yàn)檢疫機(jī)構(gòu)名義向委托人收取額外費(fèi)用的;
(七)違反本規(guī)定第十八條規(guī)定,未按照規(guī)定向委托人收取代理報(bào)檢中介服務(wù)費(fèi)的;
?。ò耍┻`反本規(guī)定第二十條規(guī)定,對(duì)檢驗(yàn)檢疫機(jī)構(gòu)對(duì)其所代理報(bào)檢事項(xiàng)進(jìn)行的調(diào)查和處理不予配合的;
?。ň牛┻`反本規(guī)定第二十一條規(guī)定,出讓其名義供他人代理報(bào)檢業(yè)務(wù)的;
?。ㄊ┻`反本規(guī)定第二十二條規(guī)定,未建立、健全代理報(bào)檢業(yè)務(wù)檔案,不能真實(shí)完整地記錄其承辦的代理報(bào)檢業(yè)務(wù)的;
?。ㄊ唬┻`反本規(guī)定第二十三條規(guī)定,利用電子報(bào)檢企業(yè)端軟件開(kāi)展遠(yuǎn)程電子預(yù)錄入的;
?。ㄊ┮蚱渌蛐钑和?bào)檢的。
第二十五條 代理報(bào)檢機(jī)構(gòu)有下列情況之一的,國(guó)家質(zhì)檢總局可以取消其代理報(bào)檢資格:
?。ㄒ唬┐韴?bào)檢企業(yè)發(fā)生變化,不具備本規(guī)定第六條條件的;
?。ǘ┪磪⒓幽陮徎蛘吣陮彶缓细竦?;
?。ㄈ┯斜疽?guī)定第二十四條所列行為之一,情節(jié)嚴(yán)重的;
?。ㄋ模┎话创頇?quán)限履行義務(wù),影響檢驗(yàn)檢疫工作秩序的;
(五)不如實(shí)報(bào)檢,騙取檢驗(yàn)檢疫單證的;
?。﹤卧?、變?cè)?、買賣或者盜竊檢驗(yàn)檢疫單證、印章、標(biāo)志、封識(shí)和質(zhì)量認(rèn)證標(biāo)志的;
?。ㄆ撸┮蚱渌蛐枞∠韴?bào)檢資格的。
第二十六條 代理報(bào)檢機(jī)構(gòu)及其報(bào)檢員在從事報(bào)檢業(yè)務(wù)活動(dòng)中違反檢驗(yàn)檢疫法律法規(guī)的,按照法律法規(guī)規(guī)定處理。
第二十七條 檢驗(yàn)檢疫機(jī)構(gòu)和工作人員不得以任何形式成立代理報(bào)檢單位,進(jìn)行代理報(bào)檢工作,從中謀取任何不正當(dāng)利益。
第二十八條
檢驗(yàn)檢疫機(jī)構(gòu)工作人員不得與代理報(bào)檢單位有任何利益關(guān)系。檢驗(yàn)檢疫機(jī)構(gòu)工作人員和按國(guó)家有關(guān)規(guī)定應(yīng)予回避的人員以及離開(kāi)檢驗(yàn)檢疫工作崗位3年內(nèi)的人員,不得在代理報(bào)檢單位任職并按照有關(guān)規(guī)定實(shí)行回避制度。
第五章 附 則
第二十九條 本規(guī)定所稱的代理報(bào)檢不包括生產(chǎn)企業(yè)接受貿(mào)易公司的委托,為該貿(mào)易公司收購(gòu)本企業(yè)產(chǎn)品進(jìn)行報(bào)檢的行為。
第三十條 國(guó)家質(zhì)檢總局鼓勵(lì)進(jìn)出口企業(yè)以電子方式直接向檢驗(yàn)檢疫機(jī)構(gòu)報(bào)檢。
第三十一條 本規(guī)定由國(guó)家質(zhì)檢總局負(fù)責(zé)解釋。
第三十二條 本規(guī)定自2003年1月1日起施行。

Provisions on The Administration of Entry-exit Inspection And Quarantine Report
by ProxyNo.34 [2002] of the General Administration of Quality Supervision,
Inspection and Quarantine
Chapter I General Provisions
Article 1 The present provisions are formulated in accordance with the Law of
the People''s Republic of China on Import and Export Commodity Inspection and
the regulations for its implementation, the Law of the People''s Republic of
China on Entry-Exit Animal and Plant Quarantine and the regulations for its
implementation, the Frontier Health Quarantine Law of the People''s Republic of
China and the detailed rules for its implementation, the Food Hygiene Law of the
People''s Republic of China and other laws and regulations with a view to
strengthening the supervision and administration of, and regulating the act of
inspection and quarantine report by proxy.
Article 2 Inspection and quarantine report by proxy mentioned in the present
provisions shall mean the act of an enterprise legal person inside the territory
of China (hereinafter referred to as the inspection and quarantine report
agency) which has been registered by the General Administration of Quality
Supervision, Inspection and Quarantine of the People''s Republic of China
(hereinafter referred to as the AQSIQ) to, upon the entrustment of the consignee
of imported goods and the consigner of exported goods, handle the formalities of
inspection and quarantine report in accordance with the law.
Article 3 The AQSIQ shall uniformly administer the work of inspection and
quarantine report by proxy all over the country, and shall be responsible for
the registration of the inspection and quarantine report agencies; each
entry-exit inspection and quarantine bureau directly under the AQSIQ
(hereinafter referred to as inspection and quarantine bureau directly under the
AQSIQ) shall be responsible for the preliminary verification and annual
appraisal of the inspection and quarantine report agencies within its
jurisdiction; the entry-exit inspection and quarantine institution at all places
(hereinafter referred to as inspection and quarantine institutions) shall be
responsible for the daily supervision and administration of the inspection and
quarantine report agencies.
Article 4 An inspection and quarantine report agency shall be registered by
the AQSIQ, otherwise it shall not engage in the business of inspection and
quarantine report by proxy.
Article 5 An inspection and quarantine report agency shall, when accepting the
entrustment to handle the inspection and quarantine report and other relevant
matters, abide by the relevant laws and regulations on entry-exit inspection and
quarantine, and shall be responsible for the genuineness and legitimacy of all
the contents under the inspection and quarantine report by proxy, and bear the
corresponding legal liabilities as well.
Chapter II Registration of Inspection and Quarantine Report Agencies
Article 6 An entity applying for the registration of inspection and quarantine
report by proxy (hereinafter referred to as the applying entity) shall meet the
following conditions:
(1) having obtained the "Business License of Enterprise Legal Person" issued
by the department for industry and commerce;
?。?) having at least 1.5 million Yuan of registered capital;
(3) having a fixed business site and the facilities for handling the business
of inspection and quarantine report;
?。?) having a good management system;
?。?) having at least 10 persons who have obtained the "Certificate for the
Qualifications as An Inspection and Quarantine Reporter";
?。?) other conditions stipulated by the AQSIQ.
Article 7 An applying entity shall file an application to the inspection and
quarantine bureau directly under the AQSIQ at its locality and submit the
following documents:
?。?) the "Application Letter for the Registration of Entry-Exit Inspection and
Quarantine Report by Proxy";
(2) a duplicate of the "Business License of Enterprise Legal Person" (the
original shall be submitted for verification at the same time);
?。?) a duplicate of the "Certificate for the Qualifications as An Inspection
and Quarantine Reporter" of the inspection and quarantine reporter to be
appointed (the original shall be submitted for verification at the same time);
?。?) a sample seal mould of the enterprise of inspection and quarantine report
by proxy;
(5) other documents stipulated by the AQSIQ to be submitted.
Article 8 The inspection and quarantine bureaus directly under the AQSIQ shall
carry out the preliminary verification on the applying entities'' applications,
and shall submit those which have passed the preliminary verification to the
AQSIQ for verification. To the applying entity that passes the verification may
be issued a "Registration Certificate for Entry-Exit Inspection and Quarantine
Report by Proxy" (hereinafter referred to as "Registration Certificate").
An inspection and quarantine report agency that has obtained the "Registration
Certificate" may engage in the business of inspection and quarantine report by
proxy within the areas approved by the AQSIQ.
Article 9 In case of any modification with an inspection and quarantine report
agency''s name, address, legal representative, business scope or other major
issues, the agency shall, within 15 days as of the modification, report in
written form to the inspection and quarantine bureau directly under the AQSIQ at
its locality.
Chapter III The Act of Inspection and Quarantine Report by Proxy
Article 10 A consignee of imported goods may entrust an inspection and
quarantine report agency at the place of customs declaration or the place of
receipt to make the inspection and quarantine report, while a consigner of
exported goods may entrust an inspection and quarantine report agency at the
place of origin or the place of customs declaration to make the inspection and
quarantine report.
Article 11 An entrusted inspection and quarantine report agency shall complete
the following acts of inspection and quarantine report by proxy:
?。?) going through the formalities of inspection and quarantine report;
?。?) paying the inspection and quarantine fee;
?。?) contacting and cooperating with the inspection and quarantine institution
to carry out the inspection and quarantine;
(4) obtaining the inspection and quarantine certificates and the proof of
customs release;
?。?) other matters related to the work of inspection and quarantine.
Article 12 An inspection and quarantine report agency shall, when accepting
the entrustment by a consignee or consigner, abide by the provisions in laws and
regulations on the consignee or consigner.
Article 13 An inspection and quarantine report agency shall, when making the
inspection and quarantine report, submit a power of attorney on the inspection
and quarantine report to the inspection and quarantine institution.
The power of attorney on inspection and quarantine report shall indicate the
principal''s name, address, the name (signature) of the legal representative,
the nature of the principal and its business scope; the inspection and
quarantine report agency''s name, address, matters under agency, and
responsibilities and rights of both parties, period of agency, etc., and shall
be affixed with the official seals of both parties.
Article 14 An inspection and quarantine report agency shall, in accordance
with the relevant provisions, regulate the inspection and quarantine reporters''
act of inspection and quarantine report, and shall bear the legal liabilities
for the inspection and quarantine reporters'' act.
Article 15 An inspection and quarantine report agency shall, as required by
the inspection and quarantine institution, be responsible for guaranteeing the
inspection and quarantine place, time and other relevant matters.
Article 16 An inspection and quarantine report agency shall bear the
obligation of keeping confidential for the commercial secrets he has known from
carrying out the inspection and quarantine report by proxy.
Article 17 An inspection and quarantine report agency shall, in accordance
with the relevant provisions, pay the inspection and quarantine fee on behalf of
the principal, and shall not charge additional fees from the principal in the
name of the inspection and quarantine institution.
An inspection and quarantine report agency shall truthfully inform the
principal in written form of the payment of fees to the inspection and
quarantine institution, and the inspection and quarantine institution may check
or verify this issue at any time.
Article 18 An inspection and quarantine report agency shall charge the
principal the intermediation service fee for the inspection and quarantine
report by proxy strictly in accordance with the relevant provisions.
Chapter IV Supervision and Administration
Article 19 An inspection and quarantine institution shall apply the system of
annual verification to the inspection and quarantine report agencies. Each
inspection and quarantine report agency shall, before March 31 of each year,
apply to the inspection and quarantine bureau directly under the AQSIQ at its
locality for annual verification, and submit the "Annual Verification Report" of
the last year.
The main contents of the "Annual Verification Report" include: the information
on the business of annual inspection and quarantine report by proxy and the
analysis thereof, the financial statement, the errors in inspection and
quarantine report and the reasons thereof, the information on abidance by the
relevant inspection and quarantine provisions and the self-evaluation, etc……
An inspection and quarantine report agency that has been registered by the
AQSIQ for less than 1 year does not have to apply for annual verification in the
present year.
An inspection and quarantine bureau directly under the AQSIQ shall report the
information on the annual verification of the inspection and quarantine report
agencies to the AQSIQ for record.
Article 20 An inspection and quarantine report agency shall cooperate with the
inspection and quarantine institution to investigate and deal with the matters
under its proxy.
Article 21 No inspection and quarantine report agency shall lend its name in
any form to others for them to carry out the business of inspection and
quarantine report by proxy.
Article 22 An inspection and quarantine report agency shall set up and improve
the files on the business of inspection and quarantine report by proxy,
truthfully and completely record the business of inspection and quarantine
report by proxy it has undertaken, and consciously accept the daily supervision
and annual examination by the inspection and quarantine institution.
Article 23 An inspection and quarantine report agency may make the inspection
and quarantine report to the inspection and quarantine institution by electronic
means, provided that it shall not use electronic inspection and quarantine
report enterprise software to carry out distant electronic pre-record.
Article 24 Where an inspection and quarantine report agency is under any of
the following circumstances, the inspection and quarantine bureau directly under
the AQSIQ may suspend its qualifications for inspection and quarantine report by
proxy for 3 months or 6 months:
(1) it has committed an act in violation of the provisions on inspection and
quarantine report;
?。?) it provides untrue information, and therefore causes the goods under
inspection and quarantine report by proxy unable to be inspected or quarantined;
?。?) it does not administer the inspection and quarantine reporters strictly,
and more than one reporters have been cancelled the qualifications for
inspection and quarantine report;
?。?) it delays the annual verification without the consent of the inspection
and quarantine institution;
?。?) it violatesArticle 16 of the present provisions by disclosing the
commercial secret it knows from carrying out the inspection and quarantine
report by proxy;
?。?) it violatesArticle 17 of the present provisions by failing to pay the
inspection and quarantine fee on behalf of the principal or failing to inform
the principal in written form of the information on the payment to the
inspection and quarantine institution according to the provisions, or by
charging additional fees from the principal in the name of the inspection and
quarantine institution;
(7) it violatesArticle 18 of the present provisions by charging the
intermediation service fee from the principal for the inspection and quarantine
report by proxy not according to the provisions;
?。?) it violatesArticle 20 of the present provisions by refusing to cooperate
in the investigation and punishment by the inspection and quarantine institution
on the matters under inspection and quarantine which it reports by proxy;
(9) it violatesArticle 21 of the present provisions by lending its name to
others to undertake the business of inspection and quarantine report by proxy;
?。?0) it violatesArticle 22 of the present provisions by failing to set up and
improve the files on the business of inspection and quarantine report by proxy,
and is therefore unable to truthfully and completely record the business of
inspection and quarantine report by proxy it undertakes;
?。?1) it violatesArticle 23 of the present provisions by using electronic
inspection and quarantine report enterprise software to carry out distant
electronic pre-record;
(12) its inspection and quarantine report needed to be suspended due to other
reasons.
Article 25 Where an inspection and quarantine report agency is under any of
the following circumstances, the AQSIQ may cancel its qualifications for
inspection and quarantine report by proxy:
?。?) the enterprise of inspection and quarantine report by proxy is changed,
and does no longer meet the conditions inArticle 6 of the present provisions;
?。?) it fails to attend the annual verification or fails to pass the annual
verification;
?。?) it is under anyone of the circumstances enumerated inArticle 24 of the
present provisions, and the offense is serious ;
?。?) it dos not implement its obligations within the scope of authorization,
and therefore disturbs the order of inspection and quarantine;
(5) it does not truthfully make the inspection and quarantine report, and
fraudulently obtained the inspection and quarantine documents;
?。?) it forges, alters, buys, sells or steals inspection and quarantine
documents, stamps, marks, seal indications, and quality certification marks;
?。?) its qualifications for inspection and quarantine report by proxy needs to
be cancelled due to other reasons.
Article 26 The institutions of inspection and quarantine report by proxy and
their inspection and quarantine reporters shall, if violating any law or
regulations on inspection and quarantine in their activities of inspection and
quarantine report business, be punished in accordance with the law or
regulations.
Article 27 No inspection and quarantine institution or its functionary shall
set up any inspection and quarantine report agency in any form to carry out the
work of inspection and quarantine report by proxy or seek any undue benefits.
Article 28 No inspection and quarantine institution or its functionary shall
have any interests relationship with any inspection and quarantine report
agency. The functionaries of the inspection and quarantine institutions, the
persons who should withdraw according to the relevant provisions of the state
and the persons who have left their inspection and quarantine posts for less
than 3 years, shall not hold post in the inspection and quarantine report
agencies and shall withdraw according to the relevant provisions.
Chapter V Supplementary Provisions
Article 29 The inspection and quarantine report by proxy mentioned in the
present provisions does not include the act of a production enterprise to be
entrusted by a trading company to make the inspection and quarantine report for
the sake of selling its own products to the trading company.
Article 30 The AQSIQ encourages the import and export enterprises to directly
make inspection and quarantine report to the inspection and quarantine
institution by electronic means.
Article 31 The responsibility to interpret the present provisions shall remain
with the AQSIQ.
Article 32 The present provisions shall enter into force on January 1, 2003.
