第一章 任務(wù)和基本原則CHAPTER I AIM AND BASIC PRINCIPLES
第一條 為了保證刑法的正確實(shí)施,懲罰犯罪,保護(hù)人民,保障國家安全和社會(huì)公共安全,維護(hù)社會(huì)主義社會(huì)秩序,根據(jù)憲法,制定本法。
Article 1 This Law is enacted in accordance with the Constitution and for the
purpose of ensuring correct enforcement of the Criminal Law, punishing crimes,
protecting the people, safeguarding State and public security and maintaining
socialist public order.
第二條
中華人民共和國刑事訴訟法的任務(wù),是保證準(zhǔn)確、及時(shí)地查明犯罪事實(shí),正確應(yīng)用法律,懲罰犯罪分子,保障無罪的人不受刑事追究,教育公民自覺遵守法律,積極同犯罪行為作斗爭,以維護(hù)社會(huì)主義法制,保護(hù)公民的人身權(quán)利、財(cái)產(chǎn)權(quán)利、民主權(quán)利和其他權(quán)利,保障社會(huì)主義建設(shè)事業(yè)的順利進(jìn)行。
Article 2 The aim of the Criminal Procedure Law of the People's Republic of
China is: to ensure accurate and timely ascertainment of facts about crimes,
correct application of law, punishment of criminals and protection of the
innocent against being investigated for criminal responsibility; to enhance the
citizens' awareness of the need to abide by law and to fight vigorously against
criminal acts in order to safeguard the socialist legal system, to protect the
citizens' personal rights; their property rights, democratic rights and other
rights; and to guarantee smooth progress of the cause of socialist development.
第三條
對刑事案件的偵查、拘留、執(zhí)行逮捕、預(yù)審,由公安機(jī)關(guān)負(fù)責(zé)。檢察、批準(zhǔn)逮捕、檢察機(jī)關(guān)直接受理的案件的偵查、提起公訴,由人民檢察院負(fù)責(zé)。審判由人民法院負(fù)責(zé)。除法律特別規(guī)定的以外,其他任何機(jī)關(guān)、團(tuán)體和個(gè)人都無權(quán)行使這些權(quán)力。
Article 3 The public security organs shall be responsible for investigation,
detention, execution of arrests and preliminary inquiry in criminal cases. The
People's Procuratorates shall be responsible for procuratorial work, authorizing
approval of arrests, conducting investigation and initiating public prosecution
of cases directly accepted by the procuratorial organs. The People's Courts
shall be responsible for adjudication. Except as otherwise provided by law, no
other organs, organizations or individuals shall have the authority to exercise
such powers.
人民法院、人民檢察院和公安機(jī)關(guān)進(jìn)行刑事訴訟,必須嚴(yán)格遵守本法和其他法律的有關(guān)規(guī)定。
In conducting criminal proceedings, the People's Courts, the People's
Procuratorates and the public security organs must strictly observe this Law and
any relevant stipulations of other laws.
第四條 國家安全機(jī)關(guān)依照法律規(guī)定,辦理危害國家安全的刑事案件,行使與公安機(jī)關(guān)相同的職權(quán)。
Article 4 State security organs shall, in accordance with law, handle cases of
crimes that endanger State security, performing the same functions and powers as
the public security organs.
第五條 人民法院依照法律規(guī)定獨(dú)立行使審判權(quán),人民檢察院依照法律規(guī)定獨(dú)立行使檢察權(quán),不受行政機(jī)關(guān)、社會(huì)團(tuán)體和個(gè)人的干涉。
Article 5 The People's Courts shall exercise judicial power independently in
accordance with law and the People's Procuratorates shall exercise procuratorial
power independently in accordance with law, and they shall be free from
interference by any administrative organ, public organization or individual.
第六條 人民法院、人民檢察院和公安機(jī)關(guān)進(jìn)行刑事訴訟,必須依靠群眾,必須以事實(shí)為根據(jù),以法律為準(zhǔn)繩。
Article 6 In conducting criminal proceedings, the People's Courts, the
People's Procuratorates and the public security organs must rely on the masses,
base themselves on facts and take law as the criterion.
對于一切公民,在適用法律上一律平等,在法律面前,不允許有任何特權(quán)。
The law applies equally to all citizens and no privilege whatsoever is
permissible before law.
第七條 人民法院、人民檢察院和公安機(jī)關(guān)進(jìn)行刑事訴訟,應(yīng)當(dāng)分工負(fù)責(zé),互相配合,互相制約,以保證準(zhǔn)確有效地執(zhí)行法律。
Article 7 In conducting criminal proceedings, the People's Courts, the
People's Procuratorates and the public security organs shall divide
responsibilities, coordinate their efforts and check each other to ensure the
correct and effective enforcement of law.
第八條 人民檢察院依法對刑事訴訟實(shí)行法律監(jiān)督。
Article 8 The People's Procuratorates shall, in accordance with law, exercise
legal supervision over criminal proceedings.
第九條 各民族公民都有用本民族語言文字進(jìn)行訴訟的權(quán)利。
Article 9 Citizens of all nationalities shall have the right to use their
native spoken and written languages in court proceedings.
人民法院、人民檢察院和公安機(jī)關(guān)對于不通曉當(dāng)?shù)赝ㄓ玫恼Z言文字的訴訟參與人,應(yīng)當(dāng)為他們翻譯。
The People's Courts, the People's Procuratorates and the public security
organs shall provide translations for any party to the court proceedings who is
not familiar with the spoken or written language commonly used in the locality.
在少數(shù)民族聚居或者多民族雜居的地區(qū),應(yīng)當(dāng)用當(dāng)?shù)赝ㄓ玫恼Z言進(jìn)行審訊,用當(dāng)?shù)赝ㄓ玫奈淖职l(fā)布判決書、布告和其他文件。
Where people of a minority nationality live in a concentrated community or
where a number of nationalities live together in one area, court hearings shall
be conducted in the spoken language commonly used in the locality, and
judgments, notices and other documents shall be issued in the written language
commonly used in the locality.
第十條 人民法院審判案件,實(shí)行兩審終審制。
Article 10 In trying cases, the People's Courts shall apply the system whereby
the second instance is final.
第十一條 人民法院審判案件,除本法另有規(guī)定的以外,一律公開進(jìn)行。
Article 11 Cases in the People's Courts shall be heard in public, unless
otherwise provided by this Law.
被告人有權(quán)獲得辯護(hù),人民法院有義務(wù)保證被告人獲得辯護(hù)。
A defendant shall have the right to defence, and the People's Courts shall
have the duty to guarantee his defence.
第十二條 未經(jīng)人民法院依法判決,對任何人都不得確定有罪。
Article 12 No person shall be found guilty without being judged as such by a
People's Court according to law.
第十三條 人民法院審判案件,依照本法實(shí)行人民陪審員陪審的制度。
Article 13 In trying cases, the People's Courts shall apply the system of
people's assessors taking part in trials in accordance with this Law.
第十四條 人民法院、人民檢察院和公安機(jī)關(guān)應(yīng)當(dāng)保障訴訟參與人依法享有的訴訟權(quán)利。
Article 14 The People's Courts, the People's Procuratorates and the public
security organs shall safeguard the procedural rights to which participants in
proceedings are entitled according to law.
對于不滿十八歲的未成年人犯罪的案件,在訊問和審判時(shí),可以通知犯罪嫌疑人、被告人的法定代理人到場。
In cases where a minor under the age of 18 commits a crime, the criminal
suspect and the legal representative of the defendant may be notified to be
present at the time of interrogation and trial.
訴訟參與人對于審判人員、檢察人員和偵查人員侵犯公民訴訟權(quán)利和人身侮辱的行為,有權(quán)提出控告。
Participants in proceedings shall have the right to file charges against
judges, procurators and investigators whose acts infringe on their citizen's
procedural rights or subject their persons to indignities.
第十五條 有下列情形之一的,不追究刑事責(zé)任,已經(jīng)追究的,應(yīng)當(dāng)撤銷案件,或者不起訴,或者終止審理,或者宣告無罪:
Article 15 In any of the following circumstances, no criminal responsibility
shall be investigated; if investigation has already been undertaken, the case
shall be dismissed, or prosecution shall not be initiated, or the handling shall
be terminated, or innocence shall be declared:
?。ㄒ唬┣楣?jié)顯著輕微、危害不大,不認(rèn)為是犯罪的;
?。?) if an act is obviously minor, causing no serious harm, and is therefore
not deemed a crime;
?。ǘ┓缸镆堰^追訴時(shí)效期限的;
?。?) if the limitation period for criminal prosecution has expired;
?。ㄈ┙?jīng)特赦令免除刑罰的;
?。?) if an exemption of criminal punishment has been granted in a special
amnesty decree;
(四)依照刑法告訴才處理的犯罪,沒有告訴或者撤回告訴的;
(4) if the crime is to be handled only upon complaint according to the
Criminal Law, but there has been no complaint or the complaint has been
withdrawn;
(五)犯罪嫌疑人、被告人死亡的;
?。?) if the criminal suspect or defendant is deceased; or
?。┢渌梢?guī)定免予追究刑事責(zé)任的。
?。?) if other laws provide an exemption from investigation of criminal
responsibility.
第十六條 對于外國人犯罪應(yīng)當(dāng)追究刑事責(zé)任的,適用本法的規(guī)定。
Article 16 Provisions of this Law shall apply to foreigners who commit crimes
for which criminal responsibility should be investigated.
對于享有外交特權(quán)和豁免權(quán)的外國人犯罪應(yīng)當(dāng)追究刑事責(zé)任的,通過外交途徑解決。
If foreigners with diplomatic privileges and immunities commit crimes for
which criminal responsibility should be investigated, those cases shall be
resolved through diplomatic channels.
第十七條 根據(jù)中華人民共和國締結(jié)或者參加的國際條約,或者按照互惠原則,我國司法機(jī)關(guān)和外國司法機(jī)關(guān)可以相互請求刑事司法協(xié)助。
Article 17 In accordance with the international treaties which the People's
Republic of China has concluded or acceded to or on the principle of
reciprocity, the judicial organs of China and that of other countries may
request judicial assistance from each other in criminal affairs.
第十八條 刑事案件的偵查由公安機(jī)關(guān)進(jìn)行,法律另有規(guī)定的除外。
Article 18 Investigation in criminal cases shall be conducted by the public
security organs, except as otherwise provided by law.
貪污賄賂犯罪,國家工作人員的瀆職犯罪,國家機(jī)關(guān)工作人員利用職權(quán)實(shí)施的非法拘禁、刑訊逼供、報(bào)復(fù)陷害、非法搜查的侵犯公民人身權(quán)利的犯罪以及侵犯公民民主權(quán)利的犯罪,由人民檢察院立案偵查。
Crimes of embezzlement and bribery, crimes of dereliction of duty committed by
State functionaries, and crimes involving violations of a citizen's personal
rights such as illegal detention, extortion of confessions by torture,
retaliation, frame-up and illegal search and crimes involving infringement of a
citizen's democratic rights —— committed by State functionaries by taking
advantage of their functions and powers —— shall be placed on file for
investigation by the People's Procuratorates.
對于國家機(jī)關(guān)工作人員利用職權(quán)實(shí)施的其他重大的犯罪案件,需要由人民檢察院直接受理的時(shí)候,經(jīng)省級(jí)以上人民檢察院決定,可以由人民檢察院立案偵查。
If cases involving other grave crimes committed by State functionaries by
taking advantage of their functions and powers need be handled directly by the
People's Procuratorates, they may be placed on file for investigation by the
People's Procuratorates upon decision by the People's Procuratorates at or above
the provincial level.
自訴案件,由人民法院直接受理。
Cases of private prosecution shall be handled directly by the People's Courts.
第十九條 基層人民法院管轄第一審普通刑事案件,但是依照本法由上級(jí)人民法院管轄的除外。
Article 19 The Primary People's Courts shall have jurisdiction as courts of
first instance over ordinary criminal cases; however, those cases which fall
under the jurisdiction of the People's Courts at higher levels as stipulated by
this Law shall be exceptions.
第二十條 中級(jí)人民法院管轄下列第一審刑事案件:
Article 20 The Intermediate People's Courts shall have jurisdiction as courts
of first instance over the following criminal cases:
(一)反革命案件、危害國家安全案件;
?。?) counterrevolutionary cases and cases endangering State security;
(二)可能判處無期徒刑、死刑的普通刑事案件;
?。?) ordinary criminal cases punishable by life imprisonment or the death
penalty; and
(三)外國人犯罪的刑事案件。
(3) criminal cases in which the offenders are foreigners.
第二十一條 高級(jí)人民法院管轄的第一審刑事案件,是全省(自治區(qū)、直轄市)性的重大刑事案件。
Article 21 The Higher People's Courts shall have jurisdiction as courts of
first instance over major criminal cases that pertain to an entire province (or
autonomous region, or municipality directly under the Central Government)。
第二十二條 最高人民法院管轄的第一審刑事案件,是全國性的重大刑事案件。
Article 22 The Supreme People's Court shall have jurisdiction as the court of
first instance over major criminal cases that pertain to the whole nation.
第二十三條 上級(jí)人民法院在必要的時(shí)候,可以審判下級(jí)人民法院管轄的第一審刑事案件;
Article 23 When necessary, People's Courts at higher levels may try criminal
cases over which People's Courts at lower levels have jurisdiction as courts of
first instance;
下級(jí)人民法院認(rèn)為案情重大、復(fù)雜需要由上級(jí)人民法院審判的第一審刑事案件,可以請求移送上一級(jí)人民法院審判。
If a People's Court at a lower level considers the circumstances of a criminal
case in the first instance to be major or complex and to necessitate a trial by
a People's Court at a higher level, it may request that the case be transferred
to the People's Court at the next higher level for trial.
第二十四條 刑事案件由犯罪地的人民法院管轄。如果由被告人居住地的人民法院審判更為適宜的,可以由被告人居住地的人民法院管轄。
Article 24 A criminal case shall be under the jurisdiction of the People's
Court in the place where the crime was committed. If it is more appropriate for
the case to be tried by the People's Court in the place where the defendant
resides, then that court may have jurisdiction over the case.
第二十五條 幾個(gè)同級(jí)人民法院都有權(quán)管轄的案件,由最初受理的人民法院審判。
Article 25 When two or more People's Courts at the same level have
jurisdiction over a case, it shall be tried by the People's Court that first
accepted it.
在必要的時(shí)候,可以移送主要犯罪地的人民法院審判。
When necessary the case may be transferred for trial to the People's Court in
the principal place where the crime was committed.
第二十六條 上級(jí)人民法院可以指定下級(jí)人民法院審判管轄不明的案件,也可以指定下級(jí)人民法院將案件移送其他人民法院審判。
Article 26 A People's Court at a higher level may instruct a People's Court at
a lower level to try a case over which jurisdiction is unclear and may also
instruct a People's Court at a lower level to transfer the case to another
People's Court for trial.
第二十七條 專門人民法院案件的管轄另行規(guī)定。
Article 27 The jurisdiction over cases in special People's Courts shall be
stipulated separately.
第二十八條 審判人員、檢察人員、偵查人員有下列情形之一的,應(yīng)當(dāng)自行回避,當(dāng)事人及其法定代理人也有權(quán)要求他們回避:
Article 28 In any of the following situations, a member of the judicial,
procuratorial or investigatory personnel shall voluntarily withdraw, and the
parties to the case and their legal representatives shall have the right to
demand his withdrawal:
?。ㄒ唬┦潜景傅漠?dāng)事人或者是當(dāng)事人的近親屬的;
?。?) if he is a party or a near relative of a party to the case;
(二)本人或者他的近親屬和本案有利害關(guān)系的;
?。?) if he or a near relative of his has an interest in the case;
?。ㄈ?dān)任過本案的證人、鑒定人、辯護(hù)人、訴訟代理人的;
(3) if he has served as a witness, expert witness, defender or agent ad litem
in the current case; or
?。ㄋ模┡c本案當(dāng)事人有其他關(guān)系,可能影響公正處理案件的。
?。?) if he has any other relations with a party to the case that could affect
the impartial handling of the case.
第二十九條 審判人員、檢察人員、偵查人員不得接受當(dāng)事人及其委托的人的請客送禮,不得違反規(guī)定會(huì)見當(dāng)事人及其委托的人。
Article 29 Judges, procurators or investigators shall not accept invitations
to dinner or presents from the parties to a case or the persons entrusted by the
parties and shall not in violation of regulations meet with the parties to a
case or the persons entrusted by the parties.
審判人員、檢察人員、偵查人員違反前款規(guī)定的,應(yīng)當(dāng)依法追究法律責(zé)任。
Any judge, procurator or investigator who violates the provisions in the
preceding paragraph shall be investigated for legal responsibility.
當(dāng)事人及其法定代理人有權(quán)要求他們回避。
The parties to the case and their legal representatives shall have the right
to request him to withdraw.
第三十條 審判人員、檢察人員、偵查人員的回避,應(yīng)當(dāng)分別由院長、檢察長、公安機(jī)關(guān)負(fù)責(zé)人決定;
Article 30 The withdrawal of a judge, procurator and investigator shall be
determined respectively by the president of the court, the chief procurator, and
the head of a public security organ;
院長的回避,由本院審判委員會(huì)決定;檢察長和公安機(jī)關(guān)負(fù)責(zé)人的回避,由同級(jí)人民檢察院檢察委員會(huì)決定。
the withdrawal of the president of the court shall be determined by the
court's judicial committee; and the withdrawal of the chief procurator or the
head of a public security organ shall be determined by the procuratorial
committee of the People's Procuratorate at the corresponding level.
對偵查人員的回避作出決定前,偵查人員不能停止對案件的偵查。
An investigator may not suspend investigation of a case before a decision is
made on his withdrawal.
對駁回申請回避的決定,當(dāng)事人及其法定代理人可以申請復(fù)議一次。
If a decision has been made to reject his application for withdrawal, the
party or his legal representative may apply for reconsideration once.
第三十一條 本法第二十八條、第二十九條、第三十條的規(guī)定也適用于書記員、翻譯人員和鑒定人。
Article 31 The provisions of Articles 28, 29 and 30 of this Law shall also
apply to court clerks, interpreters and expert witnesses.
第四章 辯護(hù)與代理CHAPTER IV DEFENCE AND REPRESENTATION
第三十二條 犯罪嫌疑人、被告人除自己行使辯護(hù)權(quán)以外,還可以委托一至二人作為辯護(hù)人。下列的人可以被委托為辯護(hù)人:
Article 32 In addition to exercising the right to defend himself, a criminal
suspect or a defendant may entrust one or two persons as his defenders. The
following persons may be entrusted as defenders:
?。ㄒ唬┞蓭?;
(1) lawyers;
?。ǘ┤嗣駡F(tuán)體或者犯罪嫌疑人、被告人所在單位推薦的人;
?。?) persons recommended by a public organization or the unit to which the
criminal suspect or the defendant belongs; and
?。ㄈ┓缸锵右扇?、被告人的監(jiān)護(hù)人、親友。
(3) guardians or relatives and friends of the criminal suspect or the
defendant.
正在被執(zhí)行刑罰或者依法被剝奪、限制人身自由的人,不得擔(dān)任辯護(hù)人。
Persons who are under criminal punishment or whose personal freedom is
deprived of or restricted according to law shall not serve as defenders.
第三十三條 公訴案件自案件移送審查起訴之日起,犯罪嫌疑人有權(quán)委托辯護(hù)人。
Article 33 A criminal suspect in a case of public prosecution shall have the
right to entrust persons as his defenders from the date on which the case is
transferred for examination before prosecution.
自訴案件的被告人有權(quán)隨時(shí)委托辯護(hù)人。
A defendant in a case of private prosecution shall have the right to entrust
persons as his defenders at any time.
人民檢察院自收到移送審查起訴的案件材料之日起三日以內(nèi),應(yīng)當(dāng)告知犯罪嫌疑人有權(quán)委托辯護(hù)人。
A People's Procuratorate shall, within three days from the date of receiving
the file record of a case transferred for examination before prosecution, inform
the criminal suspect that he has the right to entrust persons as his defenders.
人民法院自受理自訴案件之日起三日以內(nèi),應(yīng)當(dāng)告知被告人有權(quán)委托辯護(hù)人。
A People's Court shall, within three days from the date of accepting a case of
private prosecution, inform the defendant that he has the right to entrust
persons as his defenders.
第三十四條 公訴人出庭公訴的案件,被告人因經(jīng)濟(jì)困難或者其他原因沒有委托辯護(hù)人的,人民法院可以指定承擔(dān)法律援助義務(wù)的律師為其提供辯護(hù)。
Article 34 If a case is to be brought in court by a public prosecutor and the
defendant involved has not entrusted anyone to be his defender due to financial
difficulties or other reasons, the People's Court may designate a lawyer that is
obligated to provide legal aid to serve as a defender.
被告人是盲、聾、啞或者未成年人而沒有委托辯護(hù)人的,人民法院應(yīng)當(dāng)指定承擔(dān)法律援助義務(wù)的律師為其提供辯護(hù)。
If the defendant is blind, deaf or mute, or if he is a minor, and thus has not
entrusted anyone to be his defender, the People's Court shall designate a lawyer
that is obligated to provide legal aid to serve as a defender.
被告人可能被判處死刑而沒有委托辯護(hù)人的,人民法院應(yīng)當(dāng)指定承擔(dān)法律援助義務(wù)的律師為其提供辯護(hù)。
If there is the possibility that the defendant may be sentenced to death and
yet he has not entrusted anyone to be his defender, the People's Court shall
designate a lawyer that is obligated to provide legal aid to serve as a
defender.
第三十五條 辯護(hù)人的責(zé)任是根據(jù)事實(shí)和法律,提出證明犯罪嫌疑人、被告人無罪、罪輕或者減輕、免除其刑事責(zé)任的材料和意見,維護(hù)犯罪嫌疑人、被告人的合法權(quán)益。
Article 35 The responsibility of a defender shall be to present, according to
the facts and law, materials and opinions proving the innocence of the criminal
suspect or defendant, the pettiness of his crime and the need for a mitigated
punishment or exemption from criminal responsibility, thus safeguarding the
lawful rights and interests of the criminal suspect or the defendant.
第三十六條 辯護(hù)律師自人民檢察院對案件審查起訴之日起,可以查閱、摘抄、復(fù)制本案的訴訟文書、技術(shù)性鑒定材料,可以同在押的犯罪嫌疑人會(huì)見和通信。
Article 36 Defence lawyers may, from the date on which the People's
Procuratorate begins to examine a case for prosecution, consult, extract and
duplicate the judicial documents pertaining to the current case and the
technical verification material, and may meet and correspond with the criminal
suspect in custody.
其他辯護(hù)人經(jīng)人民檢察院許可,也可以查閱、摘抄、復(fù)制上述材料,同在押的犯罪嫌疑人會(huì)見和通信。
Other defenders, with permission of the People's Procuratorate, may also
consult, extract and duplicate the above-mentioned material, meet and correspond
with the criminal suspect in custody.
辯護(hù)律師自人民法院受理案件之日起,可以查閱、摘抄、復(fù)制本案所指控的犯罪事實(shí)的材料,可以同在押的被告人會(huì)見和通信。其他辯護(hù)人經(jīng)人民法院許可,也可以查閱、摘抄、復(fù)制上述材料,同在押的被告人會(huì)見和通信。
Defence lawyers may, from the date on which the People's Court accepts a case,
consult, extract and duplicate the material of the facts of the crime accused in
the current case, and may meet and correspond with the defendant in custody.
Other defenders, with permission of the People's Court, may also consult,
extract and duplicate the above-mentioned material, and may meet and correspond
with the defendant in custody.
第三十七條
辯護(hù)律師經(jīng)證人或者其他有關(guān)單位和個(gè)人同意,可以向他們收集與本案有關(guān)的材料,也可以申請人民檢察院、人民法院收集、調(diào)取證據(jù),或者申請人民法院通知證人出庭作證。
Article 37 Defence lawyers may, with the consent of the witnesses or other
units and individuals concerned, collect information pertaining to the current
case from them and they may also apply to the People's Procuratorate or the
People's Court for the collection and obtaining of evidence, or request the
People's Court to inform the witnesses to appear in court and give testimony.
辯護(hù)律師經(jīng)人民檢察院或者人民法院許可,并且經(jīng)被害人或者其近親屬、被害人提供的證人同意,可以向他們收集與本案有關(guān)的材料。
With permission of the People's Procuratorate or the People's Court and with
the consent of the victim, his near relatives or the witnesses provided by the
victim, defence lawyers may collect information pertaining to the current case
from them.
第三十八條
辯護(hù)律師和其他辯護(hù)人,不得幫助犯罪嫌疑人、被告人隱匿、毀滅、偽造證據(jù)或者串供,不得威脅、引誘證人改變證言或者作偽證以及進(jìn)行其他干擾司法機(jī)關(guān)訴訟活動(dòng)的行為。
Article 38 Defense lawyers and other defenders shall not help the criminal
suspects or defendants to conceal, destroy or falsify evidence or to tally their
confessions, and shall not intimidate or induce the witnesses to modify their
testimony or give false testimony or conduct other acts to interfere with the
proceedings of the judicial organs.
違反前款規(guī)定的,應(yīng)當(dāng)依法追究法律責(zé)任。
Whoever violates the provisions of the preceding paragraph shall be
investigated for legal responsibility according to law.
第三十九條 在審判過程中,被告人可以拒絕辯護(hù)人繼續(xù)為他辯護(hù),也可以另行委托辯護(hù)人辯護(hù)。
Article 39 During a trial, the defendant may refuse to have his defendant
continue to defend him and may entrust his defence to another defender.
第四十條 公訴案件的被害人及其法定代理人或者近親屬,附帶民事訴訟的當(dāng)事人及其法定代理人,自案件移送審查起訴之日起,有權(quán)委托訴訟代理人。
Article 40 A victim in a case of public prosecution, his legal representatives
or near relatives, and a party in an incidental civil action and his legal
representatives shall, from the date on which the case is transferred for
examination before prosecution, have the right to entrust agents ad litem.
自訴案件的自訴人及其法定代理人,附帶民事訴訟的當(dāng)事人及其法定代理人,有權(quán)隨時(shí)委托訴訟代理人。
A private prosecutor in a case of private prosecution and his legal
representatives, and a party in an incidental civil action and his legal
representatives shall have the right to entrust agents ad litem at any time.
人民檢察院自收到移送審查起訴的案件材料之日起三日以內(nèi),應(yīng)當(dāng)告知被害人及其法定代理人或者其近親屬、附帶民事訴訟的當(dāng)事人及其法定代理人有權(quán)委托訴訟代理人。
The People's Procuratorate shall, within three days from the date of receiving
the file record of a case transferred for examination before prosecution, notify
the victim and his legal representatives or near relatives and the party in an
incidental civil action and his legal representatives that they have the right
to entrust agents ad litem.
人民法院自受理自訴案件之日起三日以內(nèi),應(yīng)當(dāng)告知自訴人及其法定代理人、附帶民事訴訟的當(dāng)事人及其法定代理人有權(quán)委托訴訟代理人。
The People's Court shall, within three days from the date of accepting a case
of private prosecution, notify the private prosecutor and his legal
representatives and the party in an incidental civil action and his legal
representatives that they have the right to entrust agents ad litem.
第四十一條 委托訴訟代理人,參照本法第三十二條的規(guī)定執(zhí)行。
Article 41 With regard to entrusting of agents ad litem, the provisions of
Article 32 of this Law shall be applied mutatis mutandis.
第四十二條 證明案件真實(shí)情況的一切事實(shí),都是證據(jù)。
Article 42 All facts that prove the true circumstances of a case shall be
evidence.
證據(jù)有下列七種:
There shall be the following seven categories of evidence:
?。ㄒ唬┪镒C、書證;
?。?) material evidence and documentary evidence;
?。ǘ┳C人證言;
?。?) testimony of witnesses;
?。ㄈ┍缓θ岁愂?;
?。?) statements of victims;
?。ㄋ模┓缸锵右扇?、被告人供述和辯解;
?。?) statements and exculpations of criminal suspects or defendants;
?。ㄎ澹╄b定結(jié)論;
?。?) expert conclusions;
?。┛彬?yàn)、檢查筆錄;
?。?) records of inquests and examination; and
?。ㄆ撸┮暵犢Y料。
?。?) audio-visual materials.
以上證據(jù)必須經(jīng)過查證屬實(shí),才能作為定案的根據(jù)。
Any of the above evidence must be verified before it can be used as the basis
for deciding cases.
第四十三條 審判人員、檢察人員、偵查人員必須依照法定程序,收集能夠證實(shí)犯罪嫌疑人、被告人有罪或者無罪、犯罪情節(jié)輕重的各種證據(jù)。
Article 43 Judges, procurators and investigators must, in accordance with the
legally prescribed process, collect various kinds of evidence that can prove the
criminal suspect's or defendant's guilt or innocence and the gravity of his
crime.
嚴(yán)禁刑訊逼供和以威脅、引誘、欺騙以及其他非法的方法收集證據(jù)。
It shall be strictly forbidden to extort confessions by torture and to collect
evidence by threat, enticement, deceit or other unlawful means.
必須保證一切與案件有關(guān)或者了解案情的公民,有客觀地充分地提供證據(jù)的條件,除特殊情況外,并且可以吸收他們協(xié)助調(diào)查。
Conditions must be guaranteed for all citizens who are involved in a case or
who have information about the circumstances of a case to objectively and fully
furnish evidence and, except in special circumstances, they may be brought in to
help the investigation.
第四十四條 公安機(jī)關(guān)提請批準(zhǔn)逮捕書、人民檢察院起訴書、人民法院判決書,必須忠實(shí)于事實(shí)真象。
Article 44 The public security organ's requests for approval of arrest, the
People's Procuratorate's bills of prosecution and the People's Court's written
judgments must be faithful to the facts.
故意隱瞞事實(shí)真象的,應(yīng)當(dāng)追究責(zé)任。
The responsibility of anyone who intentionally conceals the facts shall be
investigated.
第四十五條 人民法院、人民檢察院和公安機(jī)關(guān)有權(quán)向有關(guān)單位和個(gè)人收集、調(diào)取證據(jù)。
Article 45 The People's Courts, the People's Procuratorates and the public
security organs shall have the authority to collect or obtain evidence from the
units and individuals concerned.
有關(guān)單位和個(gè)人應(yīng)當(dāng)如實(shí)提供證據(jù)。
The units and individuals concerned shall provide truthful evidence.
對于涉及國家秘密的證據(jù),應(yīng)當(dāng)保密。
Evidence involving State secrets shall be kept confidential.
凡是偽造證據(jù)、隱匿證據(jù)或者毀滅證據(jù)的,無論屬于何方,必須受法律追究。
Anyone that falsifies, conceals or destroys evidence, regardless of which side
of a case he belongs to, must be investigated under law.
第四十六條 對一切案件的判處都要重證據(jù),重調(diào)查研究,不輕信口供。
Article 46 In the decision of all cases, stress shall be laid on evidence,
investigation and study; credence shall not be readily given to oral statements.
只有被告人供述,沒有其他證據(jù)的,不能認(rèn)定被告人有罪和處以刑罰;沒有被告人供述,證據(jù)充分確實(shí)的,可以認(rèn)定被告人有罪和處以刑罰。
A defendant cannot be found guilty and sentenced to a criminal punishment if
there is only his statement but no evidence; the defendant may be found guilty
and sentenced to a criminal punishment if evidence is sufficient and reliable,
even without his statement.
第四十七條 證人證言必須在法庭上經(jīng)過公訴人、被害人和被告人、辯護(hù)人雙方訊問、質(zhì)證,聽取各方證人的證言并且經(jīng)過查實(shí)以后,才能作為定案的根據(jù)。
Article 47 The testimony of a witness may be used as a basis in deciding a
case only after the witness has been questioned and cross-examined in the
courtroom by both sides, that is, the public prosecutor and victim as well as
the defendant and defenders, and after the testimonies of the witnesses on all
sides have been heard and verified.
法庭查明證人有意作偽證或者隱匿罪證的時(shí)候,應(yīng)當(dāng)依法處理。
If a court discovers through investigation that a witness has intentionally
given false testimony or concealed criminal evidence, it shall handle the matter
in accordance with law.
第四十八條 凡是知道案件情況的人,都有作證的義務(wù)。
Article 48 All those who have information about a case shall have the duty to
testify.
生理上、精神上有缺陷或者年幼,不能辨別是非、不能正確表達(dá)的人,不能作證人。
Physically or mentally handicapped persons or minors who cannot distinguish
right from wrong or cannot properly express themselves shall not be qualified as
witnesses.
第四十九條 人民法院、人民檢察院和公安機(jī)關(guān)應(yīng)當(dāng)保障證人及其近親屬的安全。
Article 49 The People's Courts, the People's Procuratorates and the public
security organs shall insure the safety of witnesses and their near relatives.
對證人及其近親屬進(jìn)行威脅、侮辱、毆打或者打擊報(bào)復(fù),構(gòu)成犯罪的,依法追究刑事責(zé)任;尚不夠刑事處罰的,依法給予治安管理處罰。
Anyone who intimidates, humiliates, beats or retaliates against a witness or
his near relatives, if his act constitutes a crime, shall be investigated for
criminal responsibility according to law; if the case is not serious enough for
criminal punishment, he shall be punished for violation of public security in
accordance with law.
第五十條 人民法院、人民檢察院和公安機(jī)關(guān)根據(jù)案件情況,對犯罪嫌疑人、被告人可以拘傳、取保候?qū)徎蛘弑O(jiān)視居住。
Article 50 The People's Courts, the People's Procuratorates and the public
security organs may, according to the circumstances of a case, issue a warrant
to compel the appearance of the criminal suspect or defendant, order him to
obtain a guarantor pending trial or subject him to residential surveillance.
第五十一條 人民法院、人民檢察院和公安機(jī)關(guān)對于有下列情形之一的犯罪嫌疑人、被告人,可以取保候?qū)徎蛘弑O(jiān)視居?。?
Article 51 The People's Courts, the People's Procuratorates and the public
security organs may allow criminal suspects or defendants under any of the
following conditions to obtain a guarantor pending trial or subject them to
residential surveillance:
?。ㄒ唬┛赡芘刑幑苤?、拘役或者獨(dú)立適用附加刑的;
?。?) They may be sentenced to public surveillance, criminal detention or simply
imposed with supplementary punishments; or
(二)可能判處有期徒刑以上刑罰,采取取保候?qū)?、監(jiān)視居住不致發(fā)生社會(huì)危險(xiǎn)性的。
?。?) They may be imposed with a punishment of fixed-term imprisonment at least
and would not endanger society if they are allowed to obtain a guarantor pending
trial or are placed under residential surveillance.
取保候?qū)?、監(jiān)視居住由公安機(jī)關(guān)執(zhí)行。
The public security organs shall execute the decision on allowing a criminal
suspect or defendant to obtain a guarantor pending trial or on subjecting him to
residential surveillance.
第五十二條 被羈押的犯罪嫌疑人、被告人及其法定代理人、近親屬有權(quán)申請取保候?qū)彙?
Article 52 A criminal suspect or defendant in custody and his legal
representatives or near relatives shall have the right to apply for obtaining a
guarantor pending trial.
第五十三條 人民法院、人民檢察院和公安機(jī)關(guān)決定對犯罪嫌疑人、被告人取保候?qū)?,?yīng)當(dāng)責(zé)令犯罪嫌疑人、被告人提出保證人或者交納保證金。
Article 53 If the People's Courts, the People's Procuratorates or the public
security organs decide to allow a criminal suspect or defendant to obtain a
guarantor pending trial, they shall order the criminal suspect or defendant to
provide a guarantor or pay guaranty money.
第五十四條 保證人必須符合下列條件:
Article 54 A guarantor must be a person who meets the following conditions:
(一)與本案無牽連;
(1) to be not involved in the current case;
?。ǘ┯心芰β男斜WC義務(wù);
?。?) to be able to perform a guarantor's duties;
?。ㄈ┫碛姓螜?quán)利,人身自由未受到限制;
?。?) to be entitled to political rights and not subjected to restriction of
personal freedom; and
(四)有固定的住處和收入。
(4) to have a fixed domicile and steady income.
第五十五條 保證人應(yīng)當(dāng)履行以下義務(wù):
Article 55 A guarantor shall perform the following duties:
?。ㄒ唬┍O(jiān)督被保證人遵守本法第五十六條的規(guī)定;
?。?) to see to it that the person under his guarantee observes the provisions
of Article 56 of this Law; and
(二)發(fā)現(xiàn)被保證人可能發(fā)生或者已經(jīng)發(fā)生違反本法第五十六條規(guī)定的行為的,應(yīng)當(dāng)及時(shí)向執(zhí)行機(jī)關(guān)報(bào)告。
?。?) to promptly report to the executing organ when finding that the person
under his guarantee may commit or has already committed acts in violation of the
provisions of Article 56 of this Law.
被保證人有違反本法第五十六條規(guī)定的行為,保證上人未及時(shí)報(bào)告的,對保證人處以罰款,構(gòu)成犯罪的,依法追究刑事責(zé)任。
If the guarantor fails to report promptly when the person under his guarantee
has committed an act in violation of the provisions of Article 56 of this Law,
he shall be fined. If the case constitutes a crime, criminal responsibility
shall be investigated according to law.
第五十六條 被取保候?qū)彽姆缸锵右扇恕⒈桓嫒藨?yīng)當(dāng)遵守以下規(guī)定:
Article 56 A criminal suspect or defendant who has obtained a guarantor
pending trial shall observe the following provisions:
?。ㄒ唬┪唇?jīng)執(zhí)行機(jī)關(guān)批準(zhǔn)不得離開所居住的市、縣;
?。?) not to leave the city or county where he resides without permission of the
executing organ;
?。ǘ┰趥饔嵉臅r(shí)候及時(shí)到案;
?。?) to be present in time at a court when summoned;
?。ㄈ┎坏靡匀魏涡问礁蓴_證人作證;
?。?) not to interfere in any form with the witness when the latter gives
testimony; and
?。ㄋ模┎坏脷?、偽造證據(jù)或者串供。
(4) not to destroy or falsify evidence or tally confessions.
被取保候?qū)彽姆缸锵右扇?、被告人違反前款規(guī)定,已交納保證金的,沒收保證金,If a criminal suspect or defendant who has
obtained a guarantor pending trial violates the provisions of the preceding
paragraph, the guaranty money paid shall be confiscated.
并且區(qū)別情形,責(zé)令犯罪嫌疑人、被告人具結(jié)悔過,重新交納保證金、提出保證人或者監(jiān)視居住、予以逮捕。
In addition, in light of specific circumstances, the criminal suspect or
defendant shall be ordered to write a statement of repentance, pay guaranty
money or provide a guarantor again, or shall be subjected to residential
surveillance or arrested.
犯罪嫌疑人、被告人在取保候?qū)徠陂g未違反前款規(guī)定的,取保候?qū)徑Y(jié)束的時(shí)候,應(yīng)當(dāng)退還保證金。
If a criminal suspect or defendant is found not to have violated the
provisions in the preceding paragraph during the period when he has obtained a
guarantor pending trial, the guaranty money shall be returned to him at the end
of the period.
第五十七條 被監(jiān)視居住的犯罪嫌疑人、被告人應(yīng)當(dāng)遵守以下規(guī)定:
Article 57 A criminal suspect or defendant under residential surveillance
shall observe the following provisions:
(一)未經(jīng)執(zhí)行機(jī)關(guān)批準(zhǔn)不得離開住處,無固定住處的,未經(jīng)批準(zhǔn)不得離開指定的居所;
?。?) not to leave his domicile without permission of the executing organ or, if
he has no fixed domicile, not to leave the designated residence without
permission;
?。ǘ┪唇?jīng)執(zhí)行機(jī)關(guān)批準(zhǔn)不得會(huì)見他人;
(2) not to meet with others without permission of the executing organ;
?。ㄈ┰趥饔嵉臅r(shí)候及時(shí)到案;
?。?) to be present in time at a court when summoned;
?。ㄋ模┎坏靡匀魏涡问礁蓴_證人作證;
(4) not to interfere in any form with the witness when the latter gives
testimony; and
(五)不得毀滅、偽造證據(jù)或者串供。
?。?) not to destroy or falsify evidence or tally confessions.
被監(jiān)視居住的犯罪嫌疑人、被告人違反前款規(guī)定,情節(jié)嚴(yán)重的,予以逮捕。
If a criminal suspect or defendant under residential surveillance violates the
provisions of the preceding paragraph and if the case is serious, he shall be
arrested.
第五十八條 人民法院、人民檢察院和公安機(jī)關(guān)對犯罪嫌疑人、被告人取保候?qū)徸铋L不得超過十二個(gè)月,監(jiān)視居住最長不得超過六個(gè)月。
Article 58 The period granted by a People's Court, People's Procuratorate or
public security organ to a criminal suspect or defendant for awaiting trial
after obtaining a guarantor shall not exceed twelve months; the period for
residential surveillance shall not exceed six months.
在取保候?qū)彙⒈O(jiān)視居住期間,不得中斷對案件的偵查、起訴和審理。
During the period when the criminal suspect or defendant is awaiting trial
after obtaining a guarantor or when he is under residential surveillance,
investigation, prosecution and handling of the case shall not be suspended.
對于發(fā)現(xiàn)不應(yīng)當(dāng)追究刑事責(zé)任或者取保候?qū)彙⒈O(jiān)視居住期限屆滿的,應(yīng)當(dāng)及時(shí)解除取保候?qū)?、監(jiān)視居住。
If it is discovered that the criminal suspect or the defendant should not be
investigated for criminal responsibility or when the period for awaiting trial
after obtaining a guarantor or the period of residential surveillance has
expired, such period shall be terminated without delay.
解除取保候?qū)彙⒈O(jiān)視居住,應(yīng)當(dāng)及時(shí)通知被取保候?qū)?、監(jiān)視居住人和有關(guān)單位。
The person who has obtained a guarantor pending trial or who is under
residential surveillance and the units concerned shall be notified of the
termination immediately.
第五十九條 逮捕犯罪嫌疑人、被告人,必須經(jīng)過人民檢察院批準(zhǔn)或者人民法院決定,由公安機(jī)關(guān)執(zhí)行。
Article 59 Arrests of criminal suspects or defendants shall be subject to
approval by a People's Procuratorate or decision by a People's Court and shall
be executed by a public security organ.
第六十條
對有證據(jù)證明有犯罪事實(shí),可能判處徒刑以上刑罰的犯罪嫌疑人、被告人,采取取保候?qū)彙⒈O(jiān)視居住等方法,尚不足以防止發(fā)生社會(huì)危險(xiǎn)性,而有逮捕必要的,應(yīng)即依法逮捕。
Article 60 When there is evidence to support the facts of a crime and the
criminal suspect or defendant could be sentenced to a punishment of not less
than imprisonment, and if such measures as allowing him to obtain a guarantor
pending trial or placing him under residential surveillance would be
insufficient to prevent the occurrence of danger to society, thus necessitating
his arrest, the criminal suspect or defendant shall be immediately arrested
according to law.
對應(yīng)當(dāng)逮捕的犯罪嫌疑人、被告人,如果患有嚴(yán)重疾病,或者是正在懷孕、哺乳自己嬰兒的婦女,可以采取取保候?qū)徎蛘弑O(jiān)視居住的辦法。
If a criminal suspect or defendant who should be arrested is seriously ill or
is a pregnant woman or a woman breast-feeding her own baby, he or she may be
allowed to obtain a guarantor pending trial or be placed under residential
surveillance.
第六十一條 公安機(jī)關(guān)對于現(xiàn)行犯或者重大嫌疑分子,如果有下列情形之一的,可以先行拘留:
Article 61 Public security organs may initially detain an active criminal or a
major suspect under any of the following conditions:
?。ㄒ唬┱陬A(yù)備犯罪、實(shí)行犯罪或者在犯罪后即時(shí)被發(fā)覺的;
(1) if he is preparing to commit a crime, is in the process of committing a
crime or is discovered immediately after committing a crime;
(二)被害人或者在場親眼看見的指認(rèn)他犯罪的;
?。?) if he is identified as having committed a crime by a victim or an
eyewitness;
?。ㄈ┰谏磉吇蛘咦√幇l(fā)現(xiàn)有犯罪證據(jù)的;
?。?) if criminal evidence is found on his body or at his residence;
(四)犯罪后企圖自殺、逃跑或者在逃的;
?。?) if he attempts to commit suicide or escape after committing a crime, or he
is a fugitive;
?。ㄎ澹┯袣纭卧熳C據(jù)或者串供可能的;
(5) if there is likelihood of his destroying or falsifying evidence or
tallying confessions;
(六)不講真實(shí)姓名、住址,身份不明的;
(6) if he does not tell his true name and address and his identity is unknown;
and
(七)有流竄作案、多次作案、結(jié)伙作案重大嫌疑的。
?。?) if he is strongly suspected of committing crimes from one place to
another, repeatedly, or in a gang.
第六十二條 公安機(jī)關(guān)在異地執(zhí)行拘留、逮捕的時(shí)候,應(yīng)當(dāng)通知被拘留、逮捕人所在地的公安機(jī)關(guān),被拘留、逮捕人所在地的公安機(jī)關(guān)應(yīng)當(dāng)予以配合。
Article 62 When a public security organ is to detain or arrest a person in
another place, it shall inform the public security organ in the place where the
person to be detained or arrested stays, and the public security organ there
shall cooperate in the action.
第六十三條 對于有下列情形的人,任何公民都可以立即扭送公安機(jī)關(guān)、人民檢察院或者人民法院處理:
Article 63 The persons listed below may be seized outright by any citizen and
delivered to a public security organ, a People's Procuratorate or a People's
Court for handling:
?。ㄒ唬┱趯?shí)行犯罪或者在犯罪后即時(shí)被發(fā)覺的;
?。?) any person who is committing a crime or is discovered immediately after
committing a crime;
?。ǘ┩ň冊诎傅?;
?。?) any person who is wanted for arrest;
?。ㄈ┰姜z逃跑的;
?。?) any person who has escaped from prison; and
?。ㄋ模┱诒蛔凡兜摹?
?。?) any person who is being pursued for arrest.
第六十四條 公安機(jī)關(guān)拘留人的時(shí)候,必須出示拘留證。
Article 64 When detaining a person, a public security organ must produce a
detention warrant.
拘留后,除有礙偵查或者無法通知的情形以外,應(yīng)當(dāng)把拘留的原因和羈押的處所,在二十四小時(shí)以內(nèi),通知被拘留人的家屬或者他的所在單位。
Within 24 hours after a person has been detained, his family or the unit to
which he belongs shall be notified of the reasons for detention and the place of
custody, except in circumstances where such notification would hinder the
investigation or there is no way of notifying them.
第六十五條 公安機(jī)關(guān)對于被拘留的人,應(yīng)當(dāng)在拘留后的二十四小時(shí)以內(nèi)進(jìn)行訊問。
Article 65 A public security organ shall interrogate a detainee within 24
hours after detention.
在發(fā)現(xiàn)不應(yīng)當(dāng)拘留的時(shí)候,必須立即釋放,發(fā)給釋放證明。
If it is found that the person should not have been detained, he must be
immediately released and issued a release certificate.
對需要逮捕而證據(jù)還不充足的,可以取保候?qū)徎蛘弑O(jiān)視居住。
If the public security organ finds it necessary to arrest a detainee when
sufficient evidence is still lacking, it may allow the detainee to obtain a
guarantor pending trial or place him under residential surveillance.
第六十六條 公安機(jī)關(guān)要求逮捕犯罪嫌疑人的時(shí)候,應(yīng)當(dāng)寫出提請批準(zhǔn)逮捕書,連同案卷材料、證據(jù),一并移送同級(jí)人民檢察院審查批準(zhǔn)。
Article 66 When a public security organ wishes to arrest a criminal suspect,
it shall submit a written request for approval of arrest together with the case
file and evidence to the People's Procuratorate at the same level for
examination and approval.
必要的時(shí)候,人民檢察院可以派人參加公安機(jī)關(guān)對于重大案件的討論。
When necessary, the People's Procuratorate may send procurators to participate
in the public security organ's discussion of a major case.
第六十七條 人民檢察院審查批準(zhǔn)逮捕犯罪嫌疑人由檢察長決定。
Article 67 The chief procurator shall make the decision on a People's
Procuratorate's examination and approval of the arrest of a criminal suspect.
重大案件應(yīng)當(dāng)提交檢察委員會(huì)討論決定。
Major cases shall be submitted to the procuratorial committee for discussion
and decision.
第六十八條 人民檢察院對于公安機(jī)關(guān)提請批準(zhǔn)逮捕的案件進(jìn)行審查后,應(yīng)當(dāng)根據(jù)情況分別作出批準(zhǔn)逮捕或者不批準(zhǔn)逮捕的決定。
Article 68 After a People's Procuratorate has examined a case with respect to
which a public security organ has submitted a request for approval of arrest, it
shall decide according to the circumstances of the case either to approve the
arrest or disapprove the arrest.
對于批準(zhǔn)逮捕的決定,公安機(jī)關(guān)應(yīng)當(dāng)立即執(zhí)行,并且將執(zhí)行情況及時(shí)通知人民檢察院。
If it decides to approve the arrest, the public security organ shall execute
it immediately and inform the People's Procuratorate of the result without
delay.
對于不批準(zhǔn)逮捕的,人民檢察院應(yīng)當(dāng)說明理由,需要補(bǔ)充偵查的,應(yīng)當(dāng)同時(shí)通知公安機(jī)關(guān)。
If the People's Procuratorate disapproves the arrest, it shall give its
reasons therefor; and if it deems a supplementary investigation necessary, it
shall at the same time notify the public security organ of the need.
第六十九條 公安機(jī)關(guān)對被拘留的人,認(rèn)為需要逮捕的,應(yīng)當(dāng)在拘留后的三日以內(nèi),提請人民檢察院審查批準(zhǔn)。
Article 69 If the public security organ deems it necessary to arrest a
detainee, it shall, within three days after the detention, submit a request to
the People's Procuratorate for examination and approval.
在特殊情況下,提請審查批準(zhǔn)的時(shí)間可以延長一日至四日。
Under special circumstances, the time limit for submitting a request for
examination and approval may be extended by one to four days.
對于流竄作案、多次作案、結(jié)伙作案的重大嫌疑分子,提請審查批準(zhǔn)的時(shí)間可以延長至三十日。
As to the arrest of a major suspect involved in crimes committed from one
place to another, repeatedly, or in a gang, the time limit for submitting a
request for examination and approval may be extended to 30 days.
人民檢察院應(yīng)當(dāng)自接到公安機(jī)關(guān)提請批準(zhǔn)逮捕書后的七日以內(nèi),作出批準(zhǔn)逮捕或者不批準(zhǔn)逮捕的決定。
The People's Procuratorate shall decide either to approve or disapprove the
arrest within seven days from the date of receiving the written request for
approval of arrest submitted by a public security organ.
人民檢察院不批準(zhǔn)逮捕的,公安機(jī)關(guān)應(yīng)當(dāng)在接到通知后立即釋放,并且將執(zhí)行情況及時(shí)通知人民檢察院。
If the People's Procuratorate disapproves the arrest, the public security
organ shall, upon receiving notification, immediately release the detainee and
inform the People's Procuratorate of the result without delay.
對于需要繼續(xù)偵查,并且符合取保候?qū)彙⒈O(jiān)視居住條件的,依法取保候?qū)徎蛘弑O(jiān)視居住。
If further investigation is necessary, and if the released person meets the
conditions for obtaining a guarantor pending trial or for residential
surveillance, he shall be allowed to obtain a guarantor pending trial or
subjected to residential surveillance according to law.
第七十條 公安機(jī)關(guān)對人民檢察院不批準(zhǔn)逮捕的決定,認(rèn)為有錯(cuò)誤的時(shí)候,可以要求復(fù)議,但是必須將被拘留的人立即釋放。
Article 70 If the public security organ considers the People's Procuratorate's
decision to disapprove an arrest to be incorrect, it may request a
reconsideration but must immediately release the detainee.
如果意見不被接受,可以向上一級(jí)人民檢察院提請復(fù)核。
If the public security organ's opinion is not accepted, it may request a
review by the People's Procuratorate at the next higher level.
上級(jí)人民檢察院應(yīng)當(dāng)立即復(fù)核,作出是否變更的決定,通知下級(jí)人民檢察院和公安機(jī)關(guān)執(zhí)行。
The People's Procuratorate at the higher level shall immediately review the
matter, decide whether or not to make a change and notify the People's
Procuratorate at the lower level and the public security organ to implement its
decision.
第七十一條 公安機(jī)關(guān)逮捕人的時(shí)候,必須出示逮捕證。
Article 71 When making an arrest, a public security organ must produce an
arrest warrant.
逮捕后,除有礙偵查或者無法通知的情形以外,應(yīng)當(dāng)把逮捕的原因和羈押的處所,在二十四小時(shí)以內(nèi)通知被逮捕人的家屬或者他的所在單位。
Within 24 hours after an arrest, the family of the arrested person or the unit
to which he belongs shall be notified of the reasons for arrest and the place of
custody, except in circumstances where such notification would hinder the
investigation or there is no way of notifying them.
第七十二條 人民法院、人民檢察院對于各自決定逮捕的人,公安機(jī)關(guān)對于經(jīng)人民檢察院批準(zhǔn)逮捕的人,都必須在逮捕后的二十四小時(shí)以內(nèi)進(jìn)行訊問。
Article 72 Interrogation must be conducted within 24 hours after the arrest,
by a People's Court or People's Procuratorate with respect to a person it has
decided to arrest, and by a public security organ with respect to a person it
has arrested with the approval of the People's Procuratorate.
在發(fā)現(xiàn)不應(yīng)當(dāng)逮捕的時(shí)候,必須立即釋放,發(fā)給釋放證明。
If it is found that the person should not have been arrested, he must be
immediately released and issued a release certificate.
第七十三條 人民法院、人民檢察院和公安機(jī)關(guān)如果發(fā)現(xiàn)對犯罪嫌疑人、被告人采取強(qiáng)制措施不當(dāng)?shù)?,?yīng)當(dāng)及時(shí)撤銷或者變更。
Article 73 If a People's Court, a People's Procuratorate or a public security
organ finds that the compulsory measures adopted against a criminal suspect or
defendant are inappropriate, such measures shall be cancelled or modified
without delay.
公安機(jī)關(guān)釋放被逮捕的人或者變更逮捕措施的,應(yīng)當(dāng)通知原批準(zhǔn)的人民檢察院。
If a public security organ releases a person arrested or substitute the
measure of arrest with a different measure, it shall notify the People's
Procuratorate that approved the arrest.
第七十四條
犯罪嫌疑人、被告人被羈押的案件,不能在本法規(guī)定的偵查羈押、審查起訴、一審、二審期限內(nèi)辦結(jié),需要繼續(xù)查證、審理的,對犯罪嫌疑人、被告人可以取保候?qū)徎蛘弑O(jiān)視居住。
Article 74 If a case involving a criminal suspect or defendant in custody
cannot be closed within the time limit stipulated by this Law for keeping the
criminal suspect or defendant under custody for the sake of investigation, for
conducting examination before prosecution, or for the procedure of first or
second instance and thus further investigation, verification and handling are
needed, the criminal suspect or defendant may be allowed to obtain a guarantor
pending trial or subjected to residential surveillance.
第七十五條
犯罪嫌疑人、被告人及其法定代理人、近親屬或者犯罪嫌疑人、被告人委托的律師及其他辯護(hù)人對于人民法院、人民檢察院或者公安機(jī)關(guān)采取強(qiáng)制措施超過法定期限的,有權(quán)要求解除強(qiáng)制措施。
Article 75 If the compulsory measures adopted by a People's Court, a People's
Procuratorate or a public security organ exceed the time limit prescribed by
law, the criminal suspect or defendant, his legal representatives, near
relatives, or the lawyers or other defenders entrusted by the criminal suspect
or defendant shall have the right to demand cancellation of the compulsory
measures.
人民法院、人民檢察院或者公安機(jī)關(guān)對于被采取強(qiáng)制措施超過法定期限的犯罪嫌疑人、被告人應(yīng)當(dāng)予以釋放、解除取保候?qū)?、監(jiān)視居住或者依法變更強(qiáng)制措施。
The People's Court, the People's Procuratorate, or the public security organ
shall release the criminal suspect or defendant when the compulsory measures
adopted against him have exceeded the time limit prescribed by law, terminate
the period for awaiting trial after obtaining a guarantor or for residential
surveillance, or take different compulsory measures according to law.
第七十六條 人民檢察院在審查批準(zhǔn)逮捕工作中,如果發(fā)現(xiàn)公安機(jī)關(guān)的偵查活動(dòng)有違法情況,應(yīng)當(dāng)通知公安機(jī)關(guān)予以糾正,公安機(jī)關(guān)應(yīng)當(dāng)將糾正情況通知人民檢察院。
Article 76 If in the process of examining and approving arrests, a People's
Procuratorate discovers illegalities in the investigatory activities of a public
security organ, it shall notify the public security organ to make corrections,
and the public security organ shall notify the People's Procuratorate of the
corrections it has made.
第七章 附帶民事訴訟CHAPTER VII INCIDENTAL CIVIL ACTIONS
第七十七條 被害人由于被告人的犯罪行為而遭受物質(zhì)損失的,在刑事訴訟過程中,有權(quán)提起附帶民事訴訟。
Article 77 If a victim has suffered material losses as a result of the
defendant's criminal act, he shall have the right to file an incidental civil
action during the course of the criminal proceeding.
如果是國家財(cái)產(chǎn)、集體財(cái)產(chǎn)遭受損失的,人民檢察院在提起公訴的時(shí)候,可以提起附帶民事訴訟。
If losses have been caused to State property or collective property, the
People's Procuratorate may file an incidental civil action while initiating a
public prosecution.
人民法院在必要的時(shí)候,可以查封或者扣押被告人的財(cái)產(chǎn)。
When necessary, the People's Court may seal up or distrain upon the property
of the defendant.
第七十八條 附帶民事訴訟應(yīng)當(dāng)同刑事案件一并審判,只有為了防止刑事案件審判的過分遲延,才可以在刑事案件審判后,由同一審判組織繼續(xù)審理附帶民事訴訟。
Article 78 An incidental civil action shall be heard together with the
criminal case. Only for the purpose of preventing excessive delay in a trial of
the criminal case may the same judicial organization, after completing the trial
of the criminal case, continue to hear the incidental civil action.
第八章 期間、送達(dá)CHAPTER VIII TIME PERIODS AND SERVICE
第七十九條 期間以時(shí)、日、月計(jì)算。
Article 79 Time periods shall be calculated by the hour, the day and the
month.
期間開始的時(shí)和日不算在期間以內(nèi)。
The hour and day from which a time period begins shall not be counted as
within the time period.
法定期間不包括路途上的時(shí)間。上訴狀或者其他文件在期滿前已經(jīng)交郵的,不算過期。
A legally prescribed time period shall not include travelling time. Appeals or
other documents that have been mailed before the expiration of the time period
shall not be regarded as overdue.
第八十條 當(dāng)事人由于不能抗拒的原因或者其他正當(dāng)理由而耽誤期限的,在障礙消除后五日以內(nèi),可以申請繼續(xù)進(jìn)行應(yīng)當(dāng)在期滿以前完成的訴訟活動(dòng)。
Article 80 When a party cannot meet a deadline due to irresistible causes or
for other legitimate reasons, he may, within five days after the obstacle is
removed, apply to continue the proceedings that should have been completed
before the expiration of the time period.
前款申請是否準(zhǔn)許,由人民法院裁定。
A People's Court shall decide whether or not to approve the application
described in the preceding paragraph.
第八十一條 送達(dá)傳票、通知書和其他訴訟文件應(yīng)當(dāng)交給收件人本人;如果本人不在,可以交給他的成年家屬或者所在單位的負(fù)責(zé)人員代收。
Article 81 Summons, notices and other court documents shall be delivered to
the addressee himself; if the addressee is absent, the documents may be received
on his behalf by an adult member of his family or a responsible person of his
unit.
收件人本人或者代收人拒絕接收或者拒絕簽名、蓋章的時(shí)候,送達(dá)人可以邀請他的鄰居或者其他見證人到場,說明情況,把文件留在他的住處,在送達(dá)證上記明拒絕的事由、送達(dá)的日期,由送達(dá)人簽名,即認(rèn)為已經(jīng)送達(dá)。
If the addressee or a recipient on his behalf refuses to accept the documents
or refuses to sign and affix his seal to the receipt, the person serving the
documents may ask the addressee's neighbours or other witnesses to the scene,
explain the situation to them, leave the documents at the addressee's residence,
record on the service certificate the particulars of the refusal and the date of
service and sign his name to it; the service shall thus be deemed to have been
completed.
第八十二條 本法下列用語的含意是:
Article 82 For the purpose of this law, the definitions of the following terms
are:
?。ㄒ唬侦查斒侵腹矙C(jī)關(guān)、人民檢察院在辦理案件過程中,依照法律進(jìn)行的專門調(diào)查工作和有關(guān)的強(qiáng)制性措施;
?。?) “”Investigation“” means the specialized investigatory work and related
compulsory measures carried out according to law by the public security organs
and People's Procuratorates in the process of handling cases.
?。ǘ倒P氯藬是指被害人、自訴人、犯罪嫌疑人、被告人、附帶民事訴訟的原告人和被告人;
(2) “”Parties“” means victims, private prosecutors, criminal suspects,
defendants and the plaintiffs and defendants in incidental civil actions.
?。ㄈ法定代理人斒侵副淮砣说母改?、養(yǎng)父母、監(jiān)護(hù)人和負(fù)有保護(hù)責(zé)任的機(jī)關(guān)、團(tuán)體的代表;
?。?) “”Legal representatives“” means the parents, foster parents or guardians
of a person being represented and representatives of the State organ or public
organization responsible for that person's protection;
?。ㄋ模诉讼参与人斒侵府?dāng)事人、法定代理人、訴訟代理人、辯護(hù)人、證人、鑒定人和翻譯人員。
?。?) “”Participants in the proceedings“” means the parties, legal
representatives, agents ad litem, defenders, witnesses, expert witnesses and
interpreters;
?。ㄎ澹诉讼代理人斒侵腹V案件的被害人及其法定代理人或者近親屬、自訴案件的自訴人及其法定代理人委托代為參加訴訟的人和附帶民事訴訟的當(dāng)事人及其法定代理人委托代為參加訴訟的人;
?。?) “”agents ad litem“” means persons entrusted by victims in cases of public
prosecution and their legal representatives or near relatives and by private
prosecutors in cases of private prosecution and their legal representatives to
participate in legal proceedings on their behalf, and persons entrusted by
parties in incidental civil actions and their legal representatives to
participate in legal proceedings on their behalf.
?。近琴Y魯是指夫、妻、父、母、子、女、同胞兄弟姊妹。
?。?) “”Near relatives“” means a person's husband or wife, father, mother, sons,
daughters, and brothers and sisters born of the same parents.
第二編 立案、偵查和提起公訴PART TWO FILING A CASE, INVESTIGATION, AND INITIATION OF PUBLIC
第八十三條 公安機(jī)關(guān)或者人民檢察院發(fā)現(xiàn)犯罪事實(shí)或者犯罪嫌疑人,應(yīng)當(dāng)按照管轄范圍,立案偵查。
Article 83 The public security organs or the People's Procuratorates shall,
upon discovering facts of crimes or criminal suspects, file the cases for
investigation within the scope of their jurisdiction.
第八十四條 任何單位和個(gè)人發(fā)現(xiàn)有犯罪事實(shí)或者犯罪嫌疑人,有權(quán)利也有義務(wù)向公安機(jī)關(guān)、人民檢察院或者人民法院報(bào)案或者舉報(bào)。
Article 84 Any unit or individual, upon discovering facts of a crime or a
criminal suspect, shall have the right and duty to report the case or provide
information to a public security organ, a People's Procuratorate or a People's
Court.
被害人對侵犯其人身、財(cái)產(chǎn)權(quán)利的犯罪事實(shí)或者犯罪嫌疑人,有權(quán)向公安機(jī)關(guān)、人民檢察院或者人民法院報(bào)案或者控告。
When his personal or property rights are infringed upon, the victim shall have
the right to report to a public security organ, a People's Procuratorate or a
People's Court about the facts of the crime or bring a complaint to it against
the criminal suspect.
公安機(jī)關(guān)、人民檢察院或者人民法院對于報(bào)案、控告、舉報(bào),都應(yīng)當(dāng)接受。
The public security organ, the People's Procuratorate or the People's Court
shall accept all reports, complaints and information.
對于不屬于自己管轄的,應(yīng)當(dāng)移送主管機(jī)關(guān)處理,并且通知報(bào)案人、控告人、舉報(bào)人;
If a case does not fall under its jurisdiction, it shall refer the case to the
competent organ and notify the person who made the report, lodged the complaint
or provided the information.
對于不屬于自己管轄而又必須采取緊急措施的,應(yīng)當(dāng)先采取緊急措施,然后移送主管機(jī)關(guān)。
If the case does not fall under its jurisdiction but calls for emergency
measures, it shall take emergency measures before referring the case to the
competent organ.
犯罪人向公安機(jī)關(guān)、人民檢察院或者人民法院自首的,適用第三款規(guī)定。
Where an offender delivers himself up to a public security organ, a People's
Procuratorate or a People's Court, the provisions of the third paragraph shall
apply.
第八十五條 報(bào)案、控告、舉報(bào)可以用書面或者口頭提出。
Article 85 Reports, complaints and information may be filed in writing or
orally.
接受口頭報(bào)案、控告、舉報(bào)的工作人員,應(yīng)當(dāng)寫成筆錄,經(jīng)宣讀無誤后,由報(bào)案人、控告人、舉報(bào)人簽名或者蓋章。
The officer receiving an oral report, complaint or information shall make a
written record of it, which, after being read to the reporter, complainant or
informant and found free of error, shall be signed or sealed by him or her.
接受控告、舉報(bào)的工作人員,應(yīng)當(dāng)向控告人、舉報(bào)人說明誣告應(yīng)負(fù)的法律責(zé)任。
The officer receiving the complaint or information shall clearly explain to
the complainant or the informant the legal responsibility that shall be incurred
for making a false accusation.
但是,只要不是捏造事實(shí),偽造證據(jù),即使控告、舉報(bào)的事實(shí)有出入,甚至是錯(cuò)告的,也要和誣告嚴(yán)格加以區(qū)別。
However, a complaint or information that does not accord with the facts, or
even a mistaken complaint shall be strictly distinguished from a false
accusation, as long as no fabrication of facts or falsification of evidence is
involved.
公安機(jī)關(guān)、人民檢察院或者人民法院應(yīng)當(dāng)保障報(bào)案人、控告人、舉報(bào)人及其近親屬的安全。
The public security organs, the People's Procuratorates and the People's
Courts shall insure the safety of reporters, complainants and informants as well
as their near relatives.
報(bào)案人、控告人、舉報(bào)人如果不愿公開自己的姓名和報(bào)案、控告、舉報(bào)的行為,應(yīng)當(dāng)為他保守秘密。
If the reporters, complainants or informants wish not to make their names and
acts of reporting, complaining or informing known to the public, these shall be
kept confidential for them.
第八十六條
人民法院、人民檢察院或者公安機(jī)關(guān)對于報(bào)案、控告、舉報(bào)和自首的材料,應(yīng)當(dāng)按照管轄范圍,迅速進(jìn)行審查,認(rèn)為有犯罪事實(shí)需要追究刑事責(zé)任的時(shí)候,應(yīng)當(dāng)立案;
Article 86 A People's Court, People's Procuratorate or public security organ
shall, within the scope of its jurisdiction, promptly examine the materials
provided by a reporter, complainant or informant and the confession of an
offender who has voluntarily surrendered. If it believes that there are facts of
a crime and criminal responsibility should be investigated, it shall file a
case.
認(rèn)為沒有犯罪事實(shí),或者犯罪事實(shí)顯著輕微,不需要追究刑事責(zé)任的時(shí)候,不予立案,并且將不立案的原因通知控告人。
If it believes that there are no facts of a crime or that the facts are
obviously incidental and do not require investigation of criminal
responsibility, it shall not file a case and shall notify the complainant of the
reason.
控告人如果不服,可以申請復(fù)議。
If the complainant does not agree with the decision, he may ask for
reconsideration.
第八十七條
人民檢察院認(rèn)為公安機(jī)關(guān)對應(yīng)當(dāng)立案偵查的案件而不立案偵查的,或者被害人認(rèn)為公安機(jī)關(guān)對應(yīng)當(dāng)立案偵查的案件而不立案偵查,向人民檢察院提出的,人民檢察院應(yīng)當(dāng)要求公安機(jī)關(guān)說明不立案的理由。
Article 87 Where a People's Procuratorate considers that a case should be
filed for investigation by a public security organ but the latter has not done
so, or where a victim considers that a case should be filed for investigation by
a public security organ but the latter has not done so and the victim has
brought the matter to a People's Procuratorate, the People's Procuratorate shall
request the public security organ to state the reasons for not filing the case.
人民檢察院認(rèn)為公安機(jī)關(guān)不立案理由不能成立的,應(yīng)當(dāng)通知公安機(jī)關(guān)立案,公安機(jī)關(guān)接到通知后應(yīng)當(dāng)立案。
If the People's Procuratorate considers that the reasons for not filing the
case given by the public security organ are untenable, it shall notify the
public security organ to file the case, and upon receiving the notification, the
public security organ shall file the case.
第八十八條 對于自訴案件,被害人有權(quán)向人民法院直接起訴。
Article 88 As to a case of private prosecution, the victim shall have the
right to bring a suit directly to a People's Court.
被害人死亡或者喪失行為能力的,被害人的法定代理人、近親屬有權(quán)向人民法院起訴。人民法院應(yīng)當(dāng)依法受理。
If the victim is dead or has lost his ability of conduct, his legal
representatives and near relatives shall have the right to bring a suit to a
People's Court. The People's Court shall accept it according to law.
第八十九條 公安機(jī)關(guān)對已經(jīng)立案的刑事案件,應(yīng)當(dāng)進(jìn)行偵查,收集、調(diào)取犯罪嫌疑人有罪或者無罪、罪輕或者罪重的證據(jù)材料。
Article 89 With respect to a criminal case which has been filed, the public
security organ shall carry out investigation, collecting and obtaining evidence
to prove the criminal suspect guilty or innocent or to prove the crime to be
minor or grave.
對現(xiàn)行犯或者重大嫌疑分子可以依法先行拘留,對符合逮捕條件的犯罪嫌疑人,應(yīng)當(dāng)依法逮捕。
Active criminals or major suspects may be detained first according to law, and
criminal suspects who meet the conditions for arrest shall be arrested according
to law.
第九十條 公安機(jī)關(guān)經(jīng)過偵查,對有證據(jù)證明有犯罪事實(shí)的案件,應(yīng)當(dāng)進(jìn)行預(yù)審,對收集、調(diào)取的證據(jù)材料予以核實(shí)。
Article 90 After investigation, the public security organ shall start
preliminary inquiry into a case for which there is evidence that supports the
facts of the crime, in order to verify the evidence which has been collected and
obtained.
第二節(jié) 訊問犯罪嫌疑人SECTION 2 INTERROGATION OF THE CRIMINAL SUSPECT
第九十一條 訊問犯罪嫌疑人必須由人民檢察院或者公安機(jī)關(guān)的偵查人員負(fù)責(zé)進(jìn)行。
Article 91 Interrogation of a criminal suspect must be conducted by the
investigators of a People's Procuratorate or public security organ.
訊問的時(shí)候,偵查人員不得少于二人。
During an interrogation, there must be no fewer than two investigators
participating.
第九十二條
對于不需要逮捕、拘留的犯罪嫌疑人,可以傳喚到犯罪嫌疑人所在市、縣內(nèi)的指定地點(diǎn)或者到他的住處進(jìn)行訊問,但是應(yīng)當(dāng)出示人民檢察院或者公安機(jī)關(guān)的證明文件。
Article 92 A criminal suspect who need not be arrested or detained may be
summoned to a designated place in the city or county where the criminal suspect
stays for interrogation, or he may be interrogated at his residence. However,
the interrogators shall produce their papers issued by a People's Procuratorate
or a public security organ.
傳喚、拘傳持續(xù)的時(shí)間最長不得超過十二小時(shí)。不得以連續(xù)傳喚、拘傳的形式變相拘禁犯罪嫌疑人。
The time for interrogation through summons or forced appearance shall not
exceed 12 hours. A criminal suspect shall not be detained under the disguise of
successive summons or forced appearance.
第九十三條 偵查人員在訊問犯罪嫌疑人的時(shí)候,應(yīng)當(dāng)首先訊問犯罪嫌疑人是否有犯罪行為,讓他陳述有罪的情節(jié)或者無罪的辯解,然后向他提出問題。
Article 93 When interrogating a criminal suspect, the investigators shall
first ask the criminal suspect whether or not he has committed any criminal act,
and let him state the circumstances of his guilt or explain his innocence; then
they may ask him questions.
犯罪嫌疑人對偵查人員的提問,應(yīng)當(dāng)如實(shí)回答。但是對與本案無關(guān)的問題,有拒絕回答的權(quán)利。
The criminal suspect shall answer the investigators' questions truthfully, but
he shall have the right to refuse to answer any questions that are irrelevant to
the case.
第九十四條 訊問聾、啞的犯罪嫌疑人,應(yīng)當(dāng)有通曉聾、啞手勢的人參加,并且將這種情況記明筆錄。
Article 94 During the interrogation of a criminal suspect who is deaf or mute,
an officer who has a good command of sign language shall participate, and such
circumstances shall be noted in the record.
第九十五條 訊問筆錄應(yīng)當(dāng)交犯罪嫌疑人核對,對于沒有閱讀能力的,應(yīng)當(dāng)向他宣讀。如果記載有遺漏或者差錯(cuò),犯罪嫌疑人可以提出補(bǔ)充或者改正。
Article 95 The record of an interrogation shall be shown to the criminal
suspect for checking; if the criminal suspect cannot read, the record shall be
read to him. If there are omissions or errors in the record, the criminal
suspect may make additions or corrections.
犯罪嫌疑人承認(rèn)筆錄沒有錯(cuò)誤后,應(yīng)當(dāng)簽名或者蓋章。
When the criminal suspect acknowledges that the record is free from error, he
shall sign or affix his seal to it.
偵查人員也應(yīng)當(dāng)在筆錄上簽名。犯罪嫌疑人請求自行書寫供述的,應(yīng)當(dāng)準(zhǔn)許。
The investigators shall also sign the record. If the criminal suspect requests
to write a personal statement, he shall be permitted to do so.
必要的時(shí)候,偵查人員也可以要犯罪嫌疑人親筆書寫供詞。
When necessary, the investigators may also ask the criminal suspect to write a
personal statement.
第九十六條 犯罪嫌疑人在被偵查機(jī)關(guān)第一次訊問后或者采取強(qiáng)制措施之日起,可以聘請律師為其提供法律咨詢、代理申訴、控告。
Article 96 After the criminal suspect is interrogated by an investigation
organ for the first time or from the day on which compulsory measures are
adopted against him, he may appoint a lawyer to provide him with legal advice
and to file petitions and complaints on his behalf.
犯罪嫌疑人被逮捕的,聘請的律師可以為其申請取保候?qū)彙?
If the criminal suspect is arrested, the appointed lawyer may apply on his
behalf for obtaining a guarantor pending trial.
涉及國家秘密的案件,犯罪嫌疑人聘請律師,應(yīng)當(dāng)經(jīng)偵查機(jī)關(guān)批準(zhǔn)。
If a case involves State secrets, the criminal suspect shall have to obtain
the approval of the investigation organ for appointing a lawyer.
受委托的律師有權(quán)向偵查機(jī)關(guān)了解犯罪嫌疑人涉嫌的罪名,可以會(huì)見在押的犯罪嫌疑人,向犯罪嫌疑人了解有關(guān)案件情況。
The appointed lawyer shall have the right to find out from the investigation
organ about the crime suspected of, and may meet with the criminal suspect in
custody to enquire about the case.
律師會(huì)見在押的犯罪嫌疑人,偵查機(jī)關(guān)根據(jù)案件情況和需要可以派員在場。
When the lawyer meets with the criminal suspect in custody, the investigation
organ may, in light of the seriousness of the crime and where it deems it
necessary, send its people to be present at the meeting.
涉及國家秘密的案件,律師會(huì)見在押的犯罪嫌疑人,應(yīng)當(dāng)經(jīng)偵查機(jī)關(guān)批準(zhǔn)。
If a case involves State secrets, before the lawyer meets with the criminal
suspect, he shall have to obtain the approval of the investigation organ.
第三節(jié) 詢問證人SECTION 3 QUESTIONING OF THE WITNESSES
第九十七條 偵查人員詢問證人,可以到證人的所在單位或者住處進(jìn)行,但是必須出示人民檢察院或者公安機(jī)關(guān)的證明文件。
Article 97 Investigators may question a witness at his unit or residence, but
they must produce a certificate issued by a People's Procuratorate or public
security organ.
在必要的時(shí)候,也可以通知證人到人民檢察院或者公安機(jī)關(guān)提供證言。
When necessary, they may also notify the witness to give testimony at the
People's Procuratorate or public security organ.
詢問證人應(yīng)當(dāng)個(gè)別進(jìn)行。
Witnesses shall be questioned individually.
第九十八條 詢問證人,應(yīng)當(dāng)告知他應(yīng)當(dāng)如實(shí)地提供證據(jù)、證言和有意作偽證或者隱匿罪證要負(fù)的法律責(zé)任。
Article 98 When a witness is questioned, he shall be instructed to provide
evidence and give testimony truthfully and shall be informed of the legal
responsibility that shall be incurred for intentionally giving false testimony
or concealing criminal evidence.
詢問不滿十八歲的證人,可以通知其法定代理人到場。
When a witness under the age of 18 is questioned, his legal representative may
be notified to be present.
第九十九條 本法第九十五條的規(guī)定,也適用于詢問證人。
Article 99 The provisions of Article 95 of this Law shall also apply to the
questioning of witnesses.
第一百條 詢問被害人,適用本節(jié)各條規(guī)定。
Article 100 The provisions of all articles in this Section shall apply to the
questioning of victims.
第四節(jié) 勘驗(yàn)、檢查SECTION 4 INQUEST AND EXAMINATION
第一百零一條 偵查人員對于與犯罪有關(guān)的場所、物品、人身、尸體應(yīng)當(dāng)進(jìn)行勘驗(yàn)或者檢查。
Article 101 Investigators shall conduct an inquest or examination of the
sites, objects, people and corpses relevant to a crime.
在必要的時(shí)候,可以指派或者聘請具有專門知識(shí)的人,在偵查人員的主持下進(jìn)行勘驗(yàn)、檢查。
When necessary, experts may be assigned or invited to conduct an inquest or
examination under the direction of the investigators.
第一百零二條 任何單位和個(gè)人,都有義務(wù)保護(hù)犯罪現(xiàn)場,并且立即通知公安機(jī)關(guān)派員勘驗(yàn)。
Article 102 Each and every unit and individual shall have the duty to preserve
the scene of a crime and to immediately notify a public security organ to send
officers to hold an inquest.
第一百零三條 偵查人員執(zhí)行勘驗(yàn)、檢查,必須持有人民檢察院或者公安機(jī)關(guān)的證明文件。
Article 103 To conduct an inquest or examination, the investigators must have
papers issued by a People's Procuratorate or a public security organ.
第一百零四條 對于死因不明的尸體,公安機(jī)關(guān)有權(quán)決定解剖,并且通知死者家屬到場。
Article 104 If the cause of a death is unclear, a public security organ shall
have the power to order an autopsy and shall notify the family members of the
deceased to be present.
第一百零五條 為了確定被害人、犯罪嫌疑人的某些特征、傷害情況或者生理狀態(tài),可以對人身進(jìn)行檢查。
Article 105 An examination may be conducted of the person of the victim or
criminal suspect in order to ascertain some of his characteristics or
physiological condition, or the circumstances of the injury.
犯罪嫌疑人如果拒絕檢查,偵查人員認(rèn)為必要的時(shí)候,可以強(qiáng)制檢查。
If a criminal suspect refuses to be examined, the investigators, when they
deem it necessary, may conduct a compulsory examination.
檢查婦女的身體,應(yīng)當(dāng)由女工作人員或者醫(yī)師進(jìn)行。
Examination of the persons of women shall be conducted by female officers or
doctors.
第一百零六條 勘驗(yàn)、檢查的情況應(yīng)當(dāng)寫成筆錄,由參加勘驗(yàn)、檢查的人和見證人簽名或者蓋章。
Article 106 A record shall be made of the circumstances of an inquest or
examination, and it shall be signed or sealed by the participants in the inquest
or examination and the eyewitnesses.
第一百零七條 人民檢察院審查案件的時(shí)候,對公安機(jī)關(guān)的勘驗(yàn)、檢查,認(rèn)為需要復(fù)驗(yàn)、復(fù)查時(shí),可以要求公安機(jī)關(guān)復(fù)驗(yàn)、復(fù)查,并且可以派檢察人員參加。
Article 107 If, in reviewing a case, a People's Procuratorate deems it
necessary to repeat an inquest or examination that has been done by a public
security organ, it may ask the latter to conduct another inquest or examination
and may send procurators to participate in it.
第一百零八條 為了查明案情,在必要的時(shí)候,經(jīng)公安局長批準(zhǔn),可以進(jìn)行偵查實(shí)驗(yàn)。
Article 108 When necessary and with the approval of the director of a public
security bureau, investigative experiments may be conducted in order to clarify
the circumstances of a case.
偵查實(shí)驗(yàn),禁止一切足以造成危險(xiǎn)、侮辱人格或者有傷風(fēng)化的行為。
In conducting investigative experiments, it shall be forbidden to take any
action which is hazardous, humiliating to anyone, or offensive to public morals.
第一百零九條 為了收集犯罪證據(jù)、查獲犯罪人,偵查人員可以對犯罪嫌疑人以及可能隱藏罪犯或者犯罪證據(jù)的人的身體、物品、住處和其他有關(guān)的地方進(jìn)行搜查。
Article 109 In order to collect criminal evidence and track down an offender,
investigators may search the person, belongings and residence of the criminal
suspect and anyone who might be hiding a criminal or criminal evidence, as well
as other relevant places.
第一百一十條 任何單位和個(gè)人,有義務(wù)按照人民檢察院和公安機(jī)關(guān)的要求,交出可以證明犯罪嫌疑人有罪或者無罪的物證、書證、視聽資料。
Article 110 Any unit or individual shall have the duty, as required by the
People's Procuratorate or the public security organ, to hand over material
evidence, documentary evidence or audio-visual material which may prove the
criminal suspect guilty or innocent.
第一百一十一條 進(jìn)行搜查,必須向被搜查人出示搜查證。
Article 111 When a search is to be conducted, a search warrant must be shown
to the person to be searched.
在執(zhí)行逮捕、拘留的時(shí)候,遇有緊急情況,不另用搜查證也可以進(jìn)行搜查。
If an emergency occurs when an arrest or detention is being made, a search may
be conducted without a search warrant.
第一百一十二條 在搜查的時(shí)候,應(yīng)當(dāng)有被搜查人或者他的家屬,鄰居或者其他見證人在場。
Article 112 During a search, the person to be searched or his family members,
neighbours or other eyewitnesses shall be present at the scene.
搜查婦女的身體,應(yīng)當(dāng)由女工作人員進(jìn)行。
Searches of the persons of women shall be conducted by female officers.
第一百一十三條 搜查的情況應(yīng)當(dāng)寫成筆錄,由偵查人員和被搜查人或者他的家屬,鄰居或者其他見證人簽名或者蓋章。
Article 113 A record shall be made of the circumstances of a search, and it
shall be signed or sealed by the investigators and the person searched or his
family members, neighbours or other eyewitnesses.
如果被搜查人或者他的家屬在逃或者拒絕簽名、蓋章,應(yīng)當(dāng)在筆錄上注明。
If the person searched or his family members have become fugitives or refuse
to sign or affix their seals to the record, this shall be noted in the record.
第六節(jié) 扣押物證、書證SECTION 6 SEIZURE OF MATERIAL EVIDENCE AND DOCUMENTARY EVIDENCE
第一百一十四條 在勘驗(yàn)、搜查中發(fā)現(xiàn)的可用以證明犯罪嫌疑人有罪或者無罪的各種物品和文件,應(yīng)當(dāng)扣押;與案件無關(guān)的物品、文件,不得扣押。
Article 114 Any articles and documents discovered during an inquest or search
that may be used to prove a criminal suspect's guilt or innocence shall be
seized. Articles and documents which are irrelevant to the case may not be
seized.
對于扣押的物品、文件,要妥善保管或者封存,不得使用或者損毀。
Seized articles and documents shall be properly kept or sealed for safekeeping
and may not be utilized or damaged.
第一百一十五條
對于扣押的物品和文件,應(yīng)當(dāng)會(huì)同在場見證人和被扣押物品持有人查點(diǎn)清楚,當(dāng)場開列清單一式二份,由偵查人員、見證人和持有人簽名或者蓋章,一份交給持有人,另一份附卷備查。
Article 115 All seized articles and documents shall be carefully checked by
the investigators jointly with the eyewitnesses and the holder of the articles;
a detailed list shall be made in duplicate on the spot and shall be signed or
sealed by the investigators, the eyewitnesses and the holder. One copy of the
list shall be given to the holder, and the other copy shall be kept on file for
reference.
第一百一十六條 偵查人員認(rèn)為需要扣押犯罪嫌疑人的郵件、電報(bào)的時(shí)候,經(jīng)公安機(jī)關(guān)或者人民檢察院批準(zhǔn),即可通知郵電機(jī)關(guān)將有關(guān)的郵件、電報(bào)檢交扣押。
Article 116 If the investigators deem it necessary to seize the mail or
telegrams of a criminal suspect, they may, upon approval of a public security
organ or a People's Procuratorate, notify the post and telecommunications
offices to check and hand over the relevant mail and telegrams for seizure.
不需要繼續(xù)扣押的時(shí)候,應(yīng)即通知郵電機(jī)關(guān)。
When it becomes unnecessary to continue a seizure, the post and
telecommunications offices shall be immediately notified.
第一百一十七條 人民檢察院、公安機(jī)關(guān)根據(jù)偵查犯罪的需要,可以依照規(guī)定查詢、凍結(jié)犯罪嫌疑人的存款、匯款。
Article 117 The People's Procuratorates and the public security organs may, as
required by investigation of crimes, inquire into or freeze criminal suspects'
deposits or remittances according to regulations.
犯罪嫌疑人的存款、匯款已被凍結(jié)的,不得重復(fù)凍結(jié)。
If the deposits or remittances of the criminal suspects have been frozen, they
shall not be frozen for a second time.
第一百一十八條 對于扣押的物品、文件、郵件、電報(bào)或者凍結(jié)的存款、匯款,經(jīng)查明確實(shí)與案件無關(guān)的,應(yīng)當(dāng)在三日以內(nèi)解除扣押、凍結(jié),退還原主或者原郵電機(jī)關(guān)。
Article 118 If any seized articles, documents, mail, telegrams or frozen
deposits and remittances are proved through investigation to be truly irrelevant
to a case, the seizure and freeze shall be cancelled within three days, and the
things shall be returned to their original owners or the original post and
telecommunications offices.
第一百一十九條 為了查明案情,需要解決案件中某些專門性問題的時(shí)候,應(yīng)當(dāng)指派、聘請有專門知識(shí)的人進(jìn)行鑒定。
Article 119 When certain special problems relating to a case need to be solved
in order to clarify the circumstances of the case, experts shall be assigned or
invited to give their evaluations.
第一百二十條 鑒定人進(jìn)行鑒定后,應(yīng)當(dāng)寫出鑒定結(jié)論,并且簽名。
Article 120 After evaluating a matter, the experts shall write a conclusion of
expert evaluation and affix his signature to it.
對人身傷害的醫(yī)學(xué)鑒定有爭議需要重新鑒定或者對精神病的醫(yī)學(xué)鑒定,由省級(jí)人民政府指定的醫(yī)院進(jìn)行。
Reverification necessitated by disputes over medical verification of personal
injuries and medical verification of mental illness shall be conducted by a
hospital designated by a people's government at the provincial level.
鑒定人進(jìn)行鑒定后,應(yīng)當(dāng)寫出鑒定結(jié)論,并且由鑒定人簽名,醫(yī)院加蓋公章。
After verification, the expert shall make a conclusion in writing, to which
his signature and the hospital's seal shall be affixed.
鑒定人故意作虛假鑒定的,應(yīng)當(dāng)承擔(dān)法律責(zé)任。
If an expert intentionally makes a false verification, he shall assume legal
responsibility.
第一百二十一條 偵查機(jī)關(guān)應(yīng)當(dāng)將用作證據(jù)的鑒定結(jié)論告知犯罪嫌疑人、被害人。
Article 121 The investigation organ shall notify the criminal suspect and the
victim of the conclusion of the expert verification which will be used as
evidence in his case.
如果犯罪嫌疑人、被害人提出申請,可以補(bǔ)充鑒定或者重新鑒定。
A supplementary expert verification or another expert verification may be
conducted upon application submitted by the criminal suspect or the victim.
第一百二十二條 對犯罪嫌疑人作精神病鑒定的期間不計(jì)入辦案期限。
Article 122 The period during which the mental illness of a criminal suspect
is under verification shall not be included in the period of time for handling
the case.
第一百二十三條 應(yīng)當(dāng)逮捕的犯罪嫌疑人如果在逃,公安機(jī)關(guān)可以發(fā)布通緝令,采取有效措施,追捕歸案。
Article 123 If a criminal suspect who should be arrested is a fugitive, a
public security organ may issue a wanted order and take effective measures to
pursue him for arrest and bring him to justice.
各級(jí)公安機(jī)關(guān)在自己管轄的地區(qū)以內(nèi),可以直接發(fā)布通緝令;超出自己管轄的地區(qū),應(yīng)當(dāng)報(bào)請有權(quán)決定的上級(jí)機(jī)關(guān)發(fā)布。
Public security organs at any level may directly issue wanted orders within
the areas under their jurisdiction; they shall request a higher- level organ
with the proper authority to issue such orders for areas beyond their
jurisdiction.
第九節(jié) 偵查終結(jié)SECTION 9 CONCLUSION OF INVESTIGATION
第一百二十四條 對犯罪嫌疑人逮捕后的偵查羈押期限不得超過二個(gè)月。
Article 124 The time limit for holding a criminal suspect in custody during
investigation after arrest shall not exceed two months.
案情復(fù)雜、期限屆滿不能終結(jié)的案件,可以經(jīng)上一級(jí)人民檢察院批準(zhǔn)延長一個(gè)月。
If the case is complex and cannot be concluded within the time limit, an
extension of one month may be allowed with the approval of the People's
Procuratorate at the next higher level.
第一百二十五條 因?yàn)樘厥庠?,在較長時(shí)間內(nèi)不宜交付審判的特別重大復(fù)雜的案件,由最高人民檢察院報(bào)請全國人民代表大會(huì)常務(wù)委員會(huì)批準(zhǔn)延期審理。
Article 125 If due to special reasons, it is not appropriate to hand over a
particularly grave and complex case for trial even within a relatively long
period of time, the Supreme People's Procuratorate shall submit a report to the
Standing Committee of the National People's Congress for approval of postponing
the hearing of the case.
第一百二十六條 下列案件在本法第一百二十四條規(guī)定的期限屆滿不能偵查終結(jié)的,經(jīng)省、自治區(qū)、直轄市人民檢察院批準(zhǔn)或者決定,可以延長二個(gè)月:
Article 126 With respect to the following cases, if investigation cannot be
concluded within the time limit specified in Article 124 of this Law, an
extension of two months may be allowed upon approval or decision by the People's
Procuratorate of a province, autonomous region or municipality directly under
the Central Government:
(一)交通十分不便的邊遠(yuǎn)地區(qū)的重大復(fù)雜案件;
?。?) grave and complex cases in outlying areas where traffic is most
inconvenient;
(二)重大的犯罪集團(tuán)案件;
(2) grave cases that involve criminal gangs;
?。ㄈ┝鞲Z作案的重大復(fù)雜案件;
?。?) grave and complex cases that involve people who commit crimes from one
place to another; and
?。ㄋ模┓缸锷婕懊鎻V,取證困難的重大復(fù)雜案件。
?。?) grave and complex cases that involve various quarters and for which it is
difficult to obtain evidence.
第一百二十七條
對犯罪嫌疑人可能判處十年有期徒刑以上刑罰,依照本法第一百二十六條規(guī)定延長期限屆滿,仍不能偵查終結(jié)的,經(jīng)省、自治區(qū)、直轄市人民檢察院批準(zhǔn)或者決定,可以再延長二個(gè)月。
Article 127 If in the case of a criminal suspect who may be sentenced to
fixed-term imprisonment of ten years at least, investigation of the case can
still not be concluded upon expiration of the extended time limit as provided in
Article 126 of this Law, another extension of two months may be allowed upon
approval or decision by the People's Procuratorate of a province, autonomous
region or municipality directly under the Central Government.
第一百二十八條 在偵查期間,發(fā)現(xiàn)犯罪嫌疑人另有重要罪行的,自發(fā)現(xiàn)之日起依照本法第一百二十四條的規(guī)定重新計(jì)算偵查羈押期限。
Article 128 If during the period of investigation a criminal suspect is found
to have committed other major crimes, the time limit for holding the criminal
suspect in custody during investigation shall be recalculated, in accordance
with the provisions of Article 124 of this Law, from the date on which such
crimes are found.
犯罪嫌疑人不講真實(shí)姓名、住址,身份不明的,偵查羈押期限自查清其身份之日起計(jì)算,但是不得停止對其犯罪行為的偵查取證。
If a criminal suspect does not tell his true name and address and his identity
is unknown, the time limit for holding him in custody during investigation shall
be calculated from the date on which his identity is found out. However, before
then, the investigation into his crime and obtaining of evidence shall not be
ceased.
對于犯罪事實(shí)清楚,證據(jù)確實(shí)、充分的,也可以按其自報(bào)的姓名移送人民檢察院審查起訴。
If the facts of a crime are clear and the evidence is reliable and sufficient,
the case may, by the name given by the criminal suspect himself, be transferred
to a People's Procuratorate for examination and prosecution.
第一百二十九條 公安機(jī)關(guān)偵查終結(jié)的案件,應(yīng)當(dāng)做到犯罪事實(shí)清楚,證據(jù)確實(shí)、充分,并且寫出起訴意見書,連同案卷材料、證據(jù)一并移送同級(jí)人民檢察院審查決定。
Article 129 After a public security organ has concluded its investigation of a
case, the facts should be clear and the evidence reliable and sufficient and, in
addition, it shall make a written recommendation for prosecution, which shall be
transferred, together with the case file and evidence, to the People's
Procuratorate at the same level for examination and decision.
第一百三十條 在偵查過程中,發(fā)現(xiàn)不應(yīng)對犯罪嫌疑人追究刑事責(zé)任的,應(yīng)當(dāng)撤銷案件;
Article 130 If it is discovered during investigation that a criminal suspect's
criminal responsibility should not have been investigated, the case shall be
dismissed;
犯罪嫌疑人已被逮捕的,應(yīng)當(dāng)立即釋放,發(fā)給釋放證明,并且通知原批準(zhǔn)逮捕的人民檢察院。
if the criminal suspect is under arrest, he shall be released immediately and
issued a release certificate, and the People's Procuratorate which originally
approved the arrest shall be notified.
第十節(jié) 人民檢察院對直接受理的案件的偵查SECTION 10 INVESTIGATION OF CASES DIRECTLY ACCEPTED BY THE
PEOPLE'S
第一百三十一條 人民檢察院對直接受理的案件的偵查適用本章規(guī)定。
Article 131 Investigation of cases directly accepted by the People's
Procuratorates shall be governed by the provisions of this Chapter.
第一百三十二條
人民檢察院直接受理的案件中符合本法第六十條、第六十一條第四項(xiàng)、第五項(xiàng)規(guī)定情形,需要逮捕、拘留犯罪嫌疑人的,由人民檢察院作出決定,由公安機(jī)關(guān)執(zhí)行。
Article 132 If a case directly accepted by a People's Procuratorate conforms
with the conditions provided in Article 60 and in sub-paragraph (4) or
sub-paragraph (5) of Article 61 of this Law, thus arrest or detention of the
criminal suspect is necessitated, the decision thereon shall be made by the
People's Procuratorate and executed by a public security organ.
第一百三十三條
人民檢察院對直接受理的案件中被拘留的人,應(yīng)當(dāng)在拘留后的二十四小時(shí)以內(nèi)進(jìn)行訊問。在發(fā)現(xiàn)不應(yīng)當(dāng)拘留的時(shí)候,必須立即釋放,發(fā)給釋放證明。對需要逮捕而證據(jù)還不充足的,可以取保候?qū)徎蛘弑O(jiān)視居住。
Article 133 A detainee in a case directly accepted by a People's Procuratorate
shall be interrogated within 24 hours after the detention. If it is found that
the person should not have been detained, he must be released immediately and
issued a release certificate. If an arrest is necessitated but the evidence is
insufficient, the detainee may be allowed to obtain a guarantor pending trial or
be subjected to residential surveillance.
第一百三十四條 人民檢察院對直接受理的案件中被拘留的人,認(rèn)為需要逮捕的,應(yīng)當(dāng)在十日以內(nèi)作出決定。
Article 134 If a People's Procuratorate deems it necessary to arrest a
detainee in a case directly accepted by it, it shall make a decision thereon
within 10 days after the detention.
在特殊情況下,決定逮捕的時(shí)間可以延長一日至四日。
Under special circumstances, the time limit for deciding on an arrest may be
extended by one to four days.
對不需要逮捕的,應(yīng)當(dāng)立即釋放;
If arrest is unnecessary, the detainee shall be released immediately;
對于需要繼續(xù)偵查,并且符合取保候?qū)彙⒈O(jiān)視居住條件的,依法取保候?qū)徎蛘弑O(jiān)視居住。
if the case requires further investigation and the detainee meets the
conditions for obtaining a guarantor pending trial or for residential
surveillance, he shall be allowed to obtain a guarantor pending trial or be
subjected to residential surveillance according to law.
第一百三十五條 人民檢察院偵查終結(jié)的案件,應(yīng)當(dāng)作出提起公訴、不起訴或者撤銷案件的決定。
Article 135 After a People's Procuratorate has concluded its investigation of
a case, it shall make a decision to initiate public prosecution, not to initiate
a prosecution or to dismiss the case.
第三章 提起公訴CHAPTER III INITIATION OF PUBLIC PROSECUTION
第一百三十六條 凡需要提起公訴的案件,一律由人民檢察院審查決定。
Article 136 All cases requiring initiation of a public prosecution shall be
examined for decision by the People's Procuratorates.
第一百三十七條 人民檢察院審查案件的時(shí)候,必須查明:
Article 137 In examining a case, a People's Procuratorate shall ascertain:
(一)犯罪事實(shí)、情節(jié)是否清楚,證據(jù)是否確實(shí)、充分,犯罪性質(zhì)和罪名的認(rèn)定是否正確;
?。?) whether the facts and circumstances of the crime are clear, whether the
evidence is reliable and sufficient and whether the charge and the nature of the
crime has been correctly determined;
?。ǘ┯袩o遺漏罪行和其他應(yīng)當(dāng)追究刑事責(zé)任的人;
?。?) whether there are any crimes that have been omitted or other persons whose
criminal responsibility should be investigated;
(三)是否屬于不應(yīng)追究刑事責(zé)任的;
?。?) whether it is a case in which criminal responsibility should not be
investigated;
?。ㄋ模┯袩o附帶民事訴訟;
?。?) whether the case has an incidental civil action; and
?。ㄎ澹﹤刹榛顒?dòng)是否合法。
?。?) whether the investigation of the case is being lawfully conducted.
第一百三十八條 人民檢察院對于公安機(jī)關(guān)移送起訴的案件,應(yīng)當(dāng)在一個(gè)月以內(nèi)作出決定,重大、復(fù)雜的案件,可以延長半個(gè)月。
Article 138 A People's Procuratorate shall make a decision within one month on
a case that a public security organ has transferred to it with a recommendation
to initiate a prosecution; an extension of a half month may be allowed for major
or complex cases.
人民檢察院審查起訴的案件,改變管轄的,從改變后的人民檢察院收到案件之日起計(jì)算審查起訴期限。
If jurisdiction over a case to be examined and prosecuted by a People's
Procuratorate is altered, the time limit for examination and prosecution shall
be calculated from the date on which another People's Procuratorate receives the
case after the alteration.
第一百三十九條 人民檢察院審查案件,應(yīng)當(dāng)訊問犯罪嫌疑人,聽取被害人和犯罪嫌疑人、被害人委托的人的意見。
Article 139 When examining a case, the People's Procuratorate shall
interrogate the criminal suspect and heed the opinions of the victim and of the
persons entrusted by the criminal suspect and the victim.
第一百四十條 人民檢察院審查案件,可以要求公安機(jī)關(guān)提供法庭審判所必需的證據(jù)材料。
Article 140 In examining a case, the People's Procuratorate may request a
public security organ to provide the evidence that is essential to the trial in
court.
人民檢察院審查案件,對于需要補(bǔ)充偵查的,可以退回公安機(jī)關(guān)補(bǔ)充偵查,也可以自行偵查。
In examining a case that requires supplementary investigation, the People's
Procuratorate may remand the case to a public security organ for supplementary
investigation or conduct the investigation itself.
對于補(bǔ)充偵查的案件,應(yīng)當(dāng)在一個(gè)月以內(nèi)補(bǔ)充偵查完畢。補(bǔ)充偵查以二次為限。
In cases where supplementary investigation is to be conducted, it shall be
completed within one month. Supplementary investigation may be conducted twice
at most.
補(bǔ)充偵查完畢移送人民檢察院后,人民檢察院重新計(jì)算審查起訴期限。
When supplementary investigation is completed and the case is transferred to
the People's Procuratorate, the time limit for examination and prosecution shall
be recalculated by the People's Procuratorate.
對于補(bǔ)充偵查的案件,人民檢察院仍然認(rèn)為證據(jù)不足,不符合起訴條件的,可以作出不起訴的決定。
With respect to a case for which supplementary investigation has been
conducted, if the People's Procuratorate still believes that the evidence is
insufficient and the case does not meet the conditions for initiation of a
prosecution, the People's Procuratorate may decide not to initiate a
prosecution.
第一百四十一條
人民檢察院認(rèn)為犯罪嫌疑人的犯罪事實(shí)已經(jīng)查清,證據(jù)確實(shí)、充分,依法應(yīng)當(dāng)追究刑事責(zé)任的,應(yīng)當(dāng)作出起訴決定,按照審判管轄的規(guī)定,向人民法院提起公訴。
Article 141 When a People's Procuratorate considers that the facts of a
criminal suspect's crime have been ascertained, that the evidence is reliable
and sufficient and that criminal responsibility should be investigated according
to law, it shall make a decision to initiate a prosecution and shall, in
accordance with the provisions for trial jurisdiction, initiate a public
prosecution in a People's Court.
第一百四十二條 犯罪嫌疑人有本法第十五條規(guī)定的情形之一的,人民檢察院應(yīng)當(dāng)作出不起訴決定。
Article 142 If a criminal suspect is found to be under one of the
circumstances provided in Article 15 of this Law, the People's Procuratorate
shall make a decision not to initiate a prosecution.
對于犯罪情節(jié)輕微,依照刑法規(guī)定不需要判處刑罰或者免除刑罰的,人民檢察院可以作出不起訴決定。
With respect to a case that is minor and the offender need not be given
criminal punishment or need be exempted from it according to the Criminal Law,
the People's Procuratorate may decide not to initiate a prosecution.
人民檢察院決定不起訴的案件,應(yīng)當(dāng)同時(shí)對偵查中扣押、凍結(jié)的財(cái)物解除扣押、凍結(jié)。
With respect to a case for which the People's Procuratorate has decided not to
initiate a prosecution, the People's Procuratorate shall, at the same time,
cancel the seizure or freeze of the property or things of value seized or frozen
during the period of investigation.
對被不起訴人需要給予行政處罰、行政處分或者需要沒收其違法所得的,人民檢察院應(yīng)當(dāng)提出檢察意見,移送有關(guān)主管機(jī)關(guān)處理。
If the person against whom prosecution is not to be initiated need be given
administrative penalty or administrative sanction or his illegal gains need be
confiscated, the People's Procuratorate shall make suggestions to such an effect
and transfer the case to the competent organ for handling.
有關(guān)主管機(jī)關(guān)應(yīng)當(dāng)將處理結(jié)果及時(shí)通知人民檢察院。
The competent organ shall, without delay, inform the People's Procuratorate of
how it has handled the case.
第一百四十三條 不起訴的決定,應(yīng)當(dāng)公開宣布,并且將不起訴決定書送達(dá)被不起訴人和他的所在單位。如果被不起訴人在押,應(yīng)當(dāng)立即釋放。
Article 143 A decision not to initiate a prosecution shall be announced
publicly, and the decision shall, in written form, be delivered to the person
who is not to be prosecuted and his unit. If the said person is in custody, he
shall be released immediately.
第一百四十四條 對于公安機(jī)關(guān)移送起訴的案件,人民檢察院決定不起訴的,應(yīng)當(dāng)將不起訴決定書送達(dá)公安機(jī)關(guān)。
Article 144 With respect to a case transferred by a public security organ for
prosecution, if the People's Procuratorate decides not to initiate a
prosecution, it shall deliver the decision in writing to the public security
organ.
公安機(jī)關(guān)認(rèn)為不起訴的決定有錯(cuò)誤的時(shí)候,可以要求復(fù)議,如果意見不被接受,可以向上一級(jí)人民檢察院提請復(fù)核。
If the public security organ considers that the decision not to initiate a
prosecution is wrong, it may demand reconsideration, and if the demand is
rejected, it may submit the matter to the People's Procuratorate at the next
higher level for review.
第一百四十五條 對于有被害人的案件,決定不起訴的,人民檢察院應(yīng)當(dāng)將不起訴決定書送達(dá)被害人。
Article 145 If the People's Procuratorate decides not to initiate a
prosecution with respect to a case that involves a victim, it shall send the
decision in writing to the victim.
被害人如果不服,可以自收到?jīng)Q定書后七日以內(nèi)向上一級(jí)人民檢察院申訴,請求提起公訴。
If the victim refuses to accept the decision, he may, within seven days after
receiving the written decision, present a petition to the People's Procuratorate
at the next higher level and request the latter to initiate a public
prosecution.
人民檢察院應(yīng)當(dāng)將復(fù)查決定告知被害人。
The People's Procuratorate shall notify the victim of its decision made after
reexamination.
對人民檢察院維持不起訴決定的,被害人可以向人民法院起訴。
If the People's Procuratorate upholds the decision not to initiate a
prosecution, the victim may bring a lawsuit to a People's Court.
被害人也可以不經(jīng)申訴,直接向人民法院起訴。
The victim may also bring a lawsuit directly to a People's Court without
presenting a petition first.
人民法院受理案件后,人民檢察院應(yīng)當(dāng)將有關(guān)案件材料移送人民法院。
After the People's Court has accepted the case, the People's Procuratorate
shall transfer the relevant case file to the People's Court.
第一百四十六條 對于人民檢察院依照本法第一百四十二條第二款規(guī)定作出的不起訴決定,被不起訴人如果不服,可以自收到?jīng)Q定書后七日以內(nèi)向人民檢察院申訴。
Article 146 If the person against whom a People's Procuratorate decides, in
accordance with the provisions of the second paragraph of Article 142 of this
Law, not to initiate a prosecution still refuses to accept the decision, he may
present a petition to the People's Procuratorate within seven days after
receiving the written decision.
人民檢察院應(yīng)當(dāng)作出復(fù)查決定,通知被不起訴的人,同時(shí)抄送公安機(jī)關(guān)。
The People's Procuratorate shall make a decision to conduct a reexamination,
notify the person against whom no prosecution is to be initiated and at the same
time send a copy of the decision to the public security organ.
第一百四十七條
基層人民法院、中級(jí)人民法院審判第一審案件,應(yīng)當(dāng)由審判員三人或者由審判員和人民陪審員共三人組成合議庭進(jìn)行,但是基層人民法院適用簡易程序的案件可以由審判員一人獨(dú)任審判。
Article 147 Trials of cases of first instance in the Primary and Intermediate
People's Courts shall be conducted by a collegial panel composed of three judges
or of judges and people's assessors totalling three. However, cases in which
summary procedure is applied in the Primary People's Courts may be tried by a
single judge alone.
高級(jí)人民法院、最高人民法院審判第一審案件,應(yīng)當(dāng)由審判員三人至七人或者由審判員和人民陪審員共三人至七人組成合議庭進(jìn)行。
Trials of cases of first instance in the Higher People's Courts or the Supreme
People's Court shall be conducted by a collegial panel composed of three to
seven judges or of judges and people's assessors totalling three to seven.
人民陪審員在人民法院執(zhí)行職務(wù),同審判員有同等的權(quán)利。
When performing their functions in the People's Courts, the people's assessors
shall enjoy equal rights with the judges.
人民法院審判上訴和抗訴案件,由審判員三人至五人組成合議庭進(jìn)行。
Trials of appealed and protested cases in the People's Courts shall be
conducted by a collegial panel composed of three to five judges.
合議庭的成員人數(shù)應(yīng)當(dāng)是單數(shù)。
The members of a collegial panel shall be odd in number.
合議庭由院長或者庭長指定審判員一人擔(dān)任審判長。
The president of the People's Court or the chief judge of a division shall
designate one judge to be the presiding judge of the collegial panel.
院長或者庭長參加審判案件的時(shí)候,自己擔(dān)任審判長。
If the president of the court or the chief judge of a division participates in
a trial, he himself shall serve as the presiding judge.
第一百四十八條 合議庭進(jìn)行評議的時(shí)候,如果意見分歧,應(yīng)當(dāng)按多數(shù)人的意見作出決定,但是少數(shù)人的意見應(yīng)當(dāng)寫入筆錄。
Article 148 If opinions differ when a collegial panel conducts its
deliberations, a decision shall be made in accordance with the opinions of the
majority, but the opinions of the minority shall be entered in the records.
評議筆錄由合議庭的組成人員簽名。
The records of the deliberations shall be signed by the members of the
collegial panel.
第一百四十九條 合議庭開庭審理并且評議后,應(yīng)當(dāng)作出判決。
Article 149 After the hearings and deliberations, the collegial panel shall
render a judgment.
對于疑難、復(fù)雜、重大的案件,合議庭認(rèn)為難以作出決定的,由合議庭提請?jiān)洪L決定提交審判委員會(huì)討論決定。
With respect to a difficult, complex or major case, on which the collegial
panel considers it difficult to make a decision, the collegial panel shall refer
the case to the president of the court for him to decide whether to submit the
case to the judicial committee for discussion and decision.
審判委員會(huì)的決定,合議庭應(yīng)當(dāng)執(zhí)行。
The collegial panel shall execute the decision of the judicial committee.
第二章 第一審程序CHAPTER II PROCEDURE OF FIRST INSTANCE
第一節(jié) 公訴案件SECTION 1 CASES OF PUBLIC PROSECUTION
第一百五十條 人民法院對提起公訴的案件進(jìn)行審查后,對于起訴書中有明確的指控犯罪事實(shí)并且附有證據(jù)目錄、證人名單和主要證據(jù)復(fù)印件或者照片的,應(yīng)當(dāng)決定開庭審判。
Article 150 After a People's Court has examined a case in which public
prosecution was initiated, it shall decide to open the court session and try the
case, if the bill of prosecution contains clear facts of the crime accused and,
in addition, there are a list of evidence and a list of witnesses as well as
duplicates or photos of major evidence attached to it.
第一百五十一條 人民法院決定開庭審判后,應(yīng)當(dāng)進(jìn)行下列工作:
Article 151 After a People's Court has decided to open a court session, it
shall proceed with the following work:
?。ㄒ唬┐_定合議庭的組成人員;
?。?) to determine the members of the collegial panel;
?。ǘ⑷嗣駲z察院的起訴書副本至遲在開庭十日以前送達(dá)被告人。
(2) to deliver to the defendant a copy of the bill of prosecution of the
People's Procuratorate no later than ten days before the opening of the court
session.
對于被告人未委托辯護(hù)人的,告知被告人可以委托辯護(hù)人,或者在必要的時(shí)候指定承擔(dān)法律授助義務(wù)的律師為其提供辯護(hù);
If the defendant has not appointed a defender, he shall be informed that he
may appoint a defender or, when necessary, designate a lawyer that is obligated
to provide legal aid to serve as a defender for him;
?。ㄈ㈤_庭的時(shí)間、地點(diǎn)在開庭三日以前通知人民檢察院;
?。?) to notify the People's Procuratorate of the time and place of the court
session three days before the opening of the session;
(四)傳喚當(dāng)事人,通知辯護(hù)人、訴訟代理人、證人、鑒定人和翻譯人員,傳票和通知書至遲在開庭三日以前送達(dá);
?。?) to summon the parties and notify the defenders, agents ad litem,
witnesses, expert witnesses and interpreters, and deliver the summons and
notices no later than three days before the opening of the court session; and
?。ㄎ澹┕_審判的案件,在開庭三日以前先期公布案由、被告人姓名、開庭時(shí)間和地點(diǎn)。
?。?) to announce, three days before the opening of the session, the subject
matter of the case to be heard in public, the name of the defendant and the time
and place of the court session.
上述活動(dòng)情形應(yīng)當(dāng)寫入筆錄,由審判人員和書記員簽名。
The circumstances of the above-mentioned proceedings shall be entered in the
written record, which shall be signed by the judges and the court clerk.
第一百五十二條 人民法院審判第一審案件應(yīng)當(dāng)公開進(jìn)行。
Article 152 Cases of first instance in a People's Court shall be heard in
public.
但是有關(guān)國家秘密或者個(gè)人隱私的案件,不公開審理。
However, cases involving State secrets or private affairs of individuals shall
not be heard in public.
十四歲以上不滿十六歲未成年人犯罪的案件,一律不公開審理。
No cases involving crimes committed by minors who have reached the age of 14
but not the age of 16 shall be heard in public.
十六歲以上不滿十八歲未成年人犯罪的案件,一般也不公開審理。
Generally, cases involving crimes committed by minors who have reached the age
of 16 but not the age of 18 shall also not be heard in public.
對于不公開審理的案件,應(yīng)當(dāng)當(dāng)庭宣布不公開審理的理由。
The reason for not hearing a case in public shall be announced in court.
第一百五十三條 人民法院審判公訴案件,人民檢察院應(yīng)當(dāng)派員出席法庭支持公訴,但是依照本法第一百七十五條的規(guī)定適用簡易程序的,人民檢察院可以不派員出席法庭。
Article 153 When a case of public prosecution is being tried in a People's
Court, the People's Procuratorate shall send its procurators to the court to
support the public prosecution. However, when a case is to be tried through
summary procedure, the People's Procuratorate may send no procurators to the
court, as provided by the provisions of Article 175 of this Law.
第一百五十四條 開庭的時(shí)候,審判長查明當(dāng)事人是否到庭,宣布案由;
Article 154 When a court session opens, the presiding judge shall ascertain if
all the parties have appeared in court and announce the subject matter of the
case.
宣布合議庭的組成人員、書記員、公訴人、辯護(hù)人、訴訟代理人、鑒定人和翻譯人員的名單;
He shall announce the roll, naming the members of the collegial panel, the
court clerk, the public prosecutor, the defender, agent ad litem, the expert
witnesses and the interpreter;
告知當(dāng)事人有權(quán)對合議庭組成人員、書記員、公訴人、鑒定人和翻譯人員申請回避;告知被告人享有辯護(hù)權(quán)利。
he shall inform the parties of their right to apply for withdrawal of any
member of the collegial panel, the court clerk, the public prosecutor, any
expert witnesses or the interpreter; and he shall inform the defendant of his
right to defence.
第一百五十五條 公訴人在法庭上宣讀起訴書后,被告人、被害人可以就起訴書指控的犯罪進(jìn)行陳述,公訴人可以訊問被告人。
Article 155 After the public prosecutor has read out the bill of prosecution
in court, the defendant and the victim may present statements regarding the
crime accused in the bill of prosecution, and the public prosecutor may
interrogate the defendant.
被害人、附帶民事訴訟的原告人和辯護(hù)人、訴訟代理人,經(jīng)審判長許可,可以向被告人發(fā)問。
The victim, the plaintiff and defender in an incidental civil action and the
agents ad litem may, with the permission of the presiding judge, put questions
to the defendant.
審判人員可以訊問被告人。
The judges may interrogate the defendant.
第一百五十六條 證人作證,審判人員應(yīng)當(dāng)告知他要如實(shí)地提供證言和有意作偽證或者隱匿罪證要負(fù)的法律責(zé)任。
Article 156 Before a witness gives testimony, the judges shall instruct him to
give testimony truthfully and explain to him the legal responsibility that shall
be incurred for intentionally giving false testimony or concealing criminal
evidence.
公訴人、當(dāng)事人和辯護(hù)人、訴訟代理人經(jīng)審判長許可,可以對證人、鑒定人發(fā)問。
The public prosecutor, the parties, the defenders and agents ad litem, with
the permission of the presiding judge, may question the witnesses and expert
witnesses.
審判長認(rèn)為發(fā)問的內(nèi)容與案件無關(guān)的時(shí)候,應(yīng)當(dāng)制止。
If the presiding judge considers any questioning irrelevant to the case, he
shall put a stop to it.
審判人員可以詢問證人、鑒定人。
The judges may question the witnesses and expert witnesses.
第一百五十七條 公訴人、辯護(hù)人應(yīng)當(dāng)向法庭出示物證,讓當(dāng)事人辨認(rèn),對未到庭的證人的證言筆錄、鑒定人的鑒定結(jié)論、勘驗(yàn)筆錄和其他作為證據(jù)的文書,應(yīng)當(dāng)當(dāng)庭宣讀。
Article 157 The public prosecutor and the defenders shall show the material
evidence to the court for the parties to identify; the records of testimony of
witnesses who are not present in court, the conclusions of expert witnesses who
are not present in court, the records of inquests and other documents serving as
evidence shall be read out in court.
審判人員應(yīng)當(dāng)聽取公訴人、當(dāng)事人和辯護(hù)人、訴訟代理人的意見。
The judges shall heed the opinions of the public prosecutor, the parties, the
defenders and the agents ad litem.
第一百五十八條 法庭審理過程中,合議庭對證據(jù)有疑問的,可以宣布休庭,對證據(jù)進(jìn)行調(diào)查核實(shí)。
Article 158 During a court hearing, if the collegial panel has doubts about
the evidence, it may announce an adjournment, in order to carry out
investigation to verify the evidence.
人民法院調(diào)查核實(shí)證據(jù),可以進(jìn)行勘驗(yàn)、檢查、扣押、鑒定和查詢、凍結(jié)。
When carrying out investigation to verify evidence, the People's Court may
conduct inquest, examination, seizure, expert evaluation, as well as inquiry and
freeze.
第一百五十九條 法庭審理過程中,當(dāng)事人和辯護(hù)人、訴訟代理人有權(quán)申請通知新的證人到庭,調(diào)取新的物證,申請重新鑒定或者勘驗(yàn)。
Article 159 During a court hearing, the parties, the defenders and agents ad
litem shall have the right to request new witnesses to be summoned, new material
evidence to be obtained, a new expert evaluation to be made, and another inquest
to be held.
法庭對于上述申請,應(yīng)當(dāng)作出是否同意的決定。
The court shall make a decision whether to grant the above-mentioned requests.
第一百六十條 經(jīng)審判長許可,公訴人、當(dāng)事人和辯護(hù)人、訴訟代理人可以對證據(jù)和案件情況發(fā)表意見并且可以互相辯論。
Article 160 With the permission of the presiding judge, the public prosecutor,
the parties, the defenders and the agents ad litem may state their views on the
evidence and the case, and they may debate with each other.
審判長在宣布辯論終結(jié)后,被告人有最后陳述的權(quán)利。
After the presiding judge has declared conclusion of the debate, the defendant
shall have the right to present a final statement.
第一百六十一條 在法庭審判過程中,如果訴訟參與人或者旁聽人員違反法庭秩序,審判長應(yīng)當(dāng)警告制止。
Article 161 If any participant in the proceedings of a trial or bystander
violates the order of the courtroom, the presiding judge shall warn him to
desist.
對不聽制止的,可以強(qiáng)行帶出法庭;情節(jié)嚴(yán)重的,處以一千元以下的罰款或者十五日以下的拘留。
If any person fails to obey, he may forcibly be taken out of the courtroom. If
the violation is serious, the person shall be fined not more than 1,000 yuan or
detained not more than 15 days.
罰款、拘留必須經(jīng)院長批準(zhǔn)。
The fine or detention shall be subject to approval of the president of the
court.
被處罰人對罰款、拘留的決定不服的,可以向上一級(jí)人民法院申請復(fù)議。復(fù)議期間不停止執(zhí)行。
If the person under punishment is not satisfied with the decision on the fine
or detention, he may apply to the People's Court at the next higher level for
reconsideration. However, the execution of the fine or detention shall not be
suspended during the period of reconsideration.
對聚眾哄鬧、沖擊法庭或者侮辱、誹謗、威脅、毆打司法工作人員或者訴訟參與人,嚴(yán)重?cái)_亂法庭秩序,構(gòu)成犯罪的,依法追究刑事責(zé)任。
Whoever assembles a crowd to make an uproar or charges into the courtroom, or
humiliates, slanders, intimidates or beats up judicial officers or participants
in the proceedings, thereby seriously disturbing the order of the courtroom,
which constitutes a crime, shall be investigated for criminal responsibility
according to law.
第一百六十二條 在被告人最后陳述后,審判長宣布休庭,合議庭進(jìn)行評議,根據(jù)已經(jīng)查明的事實(shí)、證據(jù)和有關(guān)的法律規(guī)定,分別作出以下判決:
Article 162 After a defendant makes his final statement, the presiding judge
shall announce an adjournment and the collegial panel shall conduct its
deliberations and, on the basis of the established facts and evidence and in
accordance with the provisions of relevant laws, render one of the following
judgments:
?。ㄒ唬┌讣聦?shí)清楚,證據(jù)確實(shí)、充分,依據(jù)法律認(rèn)定被告人有罪的,應(yīng)當(dāng)作出有罪判決;
(1) If the facts of a case are clear, the evidence is reliable and sufficient,
and the defendant is found guilty in accordance with law, he shall be pronounced
guilty accordingly;
?。ǘ┮罁?jù)法律認(rèn)定被告人無罪的,應(yīng)當(dāng)作出無罪判決;
?。?) If the defendant is found innocent in accordance with law, he shall be
pronounced innocent accordingly;
?。ㄈ┳C據(jù)不足,不能認(rèn)定被告人有罪的,應(yīng)當(dāng)作出證據(jù)不足、指控的犯罪不能成立的無罪判決。
?。?) If the evidence is insufficient and thus the defendant cannot be found
guilty, he shall be pronounced innocent accordingly on account of the fact that
the evidence is insufficient and the accusation unfounded.
第一百六十三條 宣告判決,一律公開進(jìn)行。
Article 163 In all cases, judgments shall be pronounced publicly.
當(dāng)庭宣告判決的,應(yīng)當(dāng)在五日以內(nèi)將判決書送達(dá)當(dāng)事人和提起公訴的人民檢察院;
If the judgment on a case is pronounced in court, a written form of the
judgment shall be delivered within five days to the parties and the People's
Procuratorate that initiated the public prosecution.
定期宣告判決的,應(yīng)當(dāng)在宣告后立即將判決書送達(dá)當(dāng)事人和提起公訴的人民檢察院。
In cases where the judgment is pronounced later on a fixed date, a written
form of the judgment shall be delivered immediately after the pronouncement to
the parties and the People's Procuratorate that indicated the public
prosecution.
第一百六十四條 判決書應(yīng)當(dāng)由合議庭的組成人員和書記員署名,并且寫明上訴的期限和上訴的法院。
Article 164 The written judgment shall be signed by the members of the
collegial panel and by the court clerk, and the time limit for appeal and the
name of the appellate court shall be clearly indicated therein.
第一百六十五條 在法庭審判過程中,遇有下列情形之一,影響審判進(jìn)行的,可以延期審理:
Article 165 A hearing may be postponed if during a trial one of the following
situations affecting the conduct of the trial occurs:
(一)需要通知新的證人到庭,調(diào)取新的物證,重新鑒定或者勘驗(yàn)的;
?。?) if it is necessary to summon new witnesses, obtain new material evidence,
make a new expert evaluation or hold another inquest;
?。ǘz察人員發(fā)現(xiàn)提起公訴的案件需要補(bǔ)充偵查,提出建議的;
?。?) if the procurators find that a case for which public prosecution has been
initiated requires supplementary investigation, and they make a proposal to that
effect; or
(三)由于當(dāng)事人申請回避而不能進(jìn)行審判的。
?。?) if the trial cannot proceed because a party applies for the withdrawal of
a judicial officer.
第一百六十六條 依照本法第一百六十五條第二項(xiàng)的規(guī)定延期審理的案件,人民檢察院應(yīng)當(dāng)在一個(gè)月以內(nèi)補(bǔ)充偵查完畢。
Article 166 If the hearings of a case is postponed in accordance with the
provisions of sub-paragraph (2) in Article 165 of this Law, the People's
Procuratorate shall complete the supplementary investigation within one month.
第一百六十七條 法庭審判的全部活動(dòng),應(yīng)當(dāng)由書記員寫成筆錄,經(jīng)審判長審閱后,由審判長和書記員簽名。
Article 167 The court clerk shall make a written record of the entire court
proceedings, which shall be examined by the presiding judge and then signed by
him and the court clerk.
法庭筆錄中的證人證言部分,應(yīng)當(dāng)當(dāng)庭宣讀或者交給證人閱讀。
That portion of the courtroom record comprising the testimony of witnesses
shall be read out in court or given to the witnesses to read.
證人在承認(rèn)沒有錯(cuò)誤后,應(yīng)當(dāng)簽名或者蓋章。
After the witnesses acknowledge that the record is free of error, they shall
sign or affix their seals to it.
法庭筆錄應(yīng)當(dāng)交給當(dāng)事人閱讀或者向他宣讀。
The courtroom record shall be given to the parties to read or shall be read
out to them.
當(dāng)事人認(rèn)為記載有遺漏或者差錯(cuò)的,可以請求補(bǔ)充或者改正。
If a party considers that there are omissions or errors in the record, he may
request additions or corrections to be made.
當(dāng)事人承認(rèn)沒有錯(cuò)誤后,應(yīng)當(dāng)簽名或者蓋章。
After the parties acknowledge that the record is free of error, they shall
sign or affix their seals to it.
第一百六十八條 人民法院審理公訴案件,應(yīng)當(dāng)在受理后一個(gè)月以內(nèi)宣判,至遲不得超過一個(gè)半月。
Article 168 A People's Court shall pronounce judgment on a case of public
prosecution within one month or, one and a half months at the latest, after
accepting it.
有本法第一百二十六條規(guī)定情形之一的,經(jīng)省、自治區(qū)、直轄市高級(jí)人民法院批準(zhǔn)或者決定,可以再延長一個(gè)月。
Under one of the situations provided in Article 126 of this Law, the period
may be extended by one more month upon approval or decision by the Higher
People's Court of a province, autonomous region or municipality directly under
the Central Government.
人民法院改變管轄的案件,從改變后的人民法院收到案件之日起計(jì)算審理期限。
If jurisdiction of a People's Court over a case is altered, the time limit for
handling the case shall be calculated from the date on which another People's
Court receives the case after the alteration.
人民檢察院補(bǔ)充偵查的案件,補(bǔ)充偵查完畢移送人民法院后,人民法院重新計(jì)算審理期限。
As to a case for which a People's Procuratorate has to conduct supplementary
investigation, the People's Court shall start to calculate anew the time lime
for handling the case after the supplementary investigation has been completed
and the case has been transferred to it.
第一百六十九條 人民檢察院發(fā)現(xiàn)人民法院審理案件違反法律規(guī)定的訴訟程序,有權(quán)向人民法院提出糾正意見。
Article 169 If a People's Procuratorate discovers that in handling a case a
People's Court has violated the litigation procedure prescribed by law, it shall
have the power to suggest to the People's Court that it should set it right.
第二節(jié) 自訴案件SECTION 2 CASES OF PRIVATE PROSECUTION
第一百七十條 自訴案件包括下列案件:
Article 170 Cases of private prosecution include the following:
(一)告訴才處理的案件;
(1) cases to be handled only upon complaint;
?。ǘ┍缓θ擞凶C據(jù)證明的輕微刑事案件;
?。?) cases for which the victims have evidence to prove that those are minor
criminal cases; and
?。ㄈ┍缓θ擞凶C據(jù)證明對被告人侵犯自己人身、財(cái)產(chǎn)權(quán)利的行為應(yīng)當(dāng)依法追究刑事責(zé)任,而公安機(jī)關(guān)或者人民檢察院不予追究被告人刑事責(zé)任的案件。
?。?) cases for which the victims have evidence to prove that the defendants
should be investigated for criminal responsibility according to law because
their acts have infringed upon the victims' personal or property rights,
whereas, the public security organs or the People's Procuratorates do not
investigate the criminal responsibility of the accused.
第一百七十一條 人民法院對于自訴案件進(jìn)行審查后,按照下列情形分別處理:
Article 171 After examining a case of private prosecution, the People's Court
shall handle it in one of the following manners in light of the different
situations:
?。ㄒ唬┓缸锸聦?shí)清楚,有足夠證據(jù)的案件,應(yīng)當(dāng)開庭審判;
?。?) If the facts of the crime are clear and the evidence is sufficient, the
case shall be tried at a court session; or
?。ǘ┤狈ψ镒C的自訴案件,如果自訴人提不出補(bǔ)充證據(jù),應(yīng)當(dāng)說服自訴人撤回自訴,或者裁定駁回。
?。?) In a case of private prosecution for which criminal evidence is lacking,
if the private prosecutor cannot present supplementary evidence, the court shall
persuade him to withdraw his prosecution or order its rejection.
自訴人經(jīng)兩次依法傳喚,無正當(dāng)理由拒不到庭的,或者未經(jīng)法庭許可中途退庭的,按撤訴處理。
If a private prosecutor, having been served twice with a summons according to
law, refuses to appear in court without justifiable reasons, or if he withdraws
from a court session without permission of the court, the case may be considered
withdrawn by him.
法庭審理過程中,審判人員對證據(jù)有疑問,需要調(diào)查核實(shí)的,適用本法第一百五十八條的規(guī)定。
If during the trial of a case the judges have doubts about the evidence and
consider it necessary to conduct investigation to verify the evidence, the
provisions of Article 158 of this Law shall apply.
第一百七十二條 人民法院對自訴案件,可以進(jìn)行調(diào)解;自訴人在宣告判決前,可以同被告人自行和解或者撤回自訴。本法第一百七十條第三項(xiàng)規(guī)定的案件不適用調(diào)解。
Article 172 A People's Court may conduct mediation in a case of private
prosecution; the private prosecutor may arrange a settlement with the defendant
or withdraw his prosecution before a judgment is pronounced. Mediation shall not
be conducted for cases stipulated in sub-paragraph (3) of Article 170 of this
Law.
第一百七十三條 自訴案件的被告人在訴訟過程中,可以對自訴人提起反訴。反訴適用自訴的規(guī)定。
Article 173 In the process of the proceedings, the defendant in a case of
private prosecution may raise a counterclaim against the private prosecutor. The
provisions governing private prosecutions shall apply to counterclaims.
第一百七十四條 人民法院對于下列案件,可以適用簡易程序,由審判員一人獨(dú)任審判:
Article 174 The People's Court may apply summary procedure to the following
cases, which shall be tried by a single judge alone:
?。ㄒ唬σ婪赡芘刑幦暌韵掠衅谕叫?、拘役、管制、單處罰金的公訴案件,事實(shí)清楚、證據(jù)充分,人民檢察院建議或者同意適用簡易程序的;
?。?) cases of public prosecution where the defendants may be lawfully sentenced
to fixed-term imprisonment of not more than three years, criminal detention,
public surveillance or punished with fines exclusively, where the facts are
clear and the evidence is sufficient, and for which the People's Procuratorate
suggests or agrees to the application of summary procedure;
?。ǘ└嬖V才處理的案件;
?。?) cases to be handled only upon complaint; and
?。ㄈ┍缓θ似鹪V的有證據(jù)證明的輕微刑事案件。
?。?) cases prosecuted by the victims, for which there is evidence to prove that
they are minor criminal cases.
第一百七十五條 適用簡易程序?qū)徖砉V案件,人民檢察院可以不派員出席法庭。
Article 175 For a case of public prosecution that is tried through summary
procedure, the People's Procuratorate may send no procurators to the court.
被告人可以就起訴書指控的犯罪進(jìn)行陳述和辯護(hù)。
The defendant may present a statement and defend himself regarding the crimes
accused in the bill of prosecution.
人民檢察院派員出席法庭的,經(jīng)審判人員許可,被告人及其辯護(hù)人可以同公訴人互相辯論。
In cases where the People's Procuratorate sends procurators to the court, the
defendant and his defenders may, with permission of the judges, debate with the
public prosecutor.
第一百七十六條 適用簡易程序?qū)徖碜栽V案件,宣讀起訴書后,經(jīng)審判人員許可,被告人及其辯護(hù)人可以同自訴人及其訴訟代理人互相辯論 . Article 176 In
a case of private prosecution that is tried through summary procedure, after the
bill of prosecution is read out, the defendant and his defenders may, with the
permission of the judges, debate with the private prosecutor and his agents ad
litem.
第一百七十七條 適用簡易程序?qū)徖戆讣?,不受本章第一?jié)關(guān)于訊問被告人、詢問證人、鑒定人、出示證據(jù)、法庭辯論程序規(guī)定的限制。
Article 177 Trial of cases through summary procedure shall not be subject to
the provisions of Section 1 of this Chapter governing the procedures of
interrogating the defendant, questioning the witnesses and expert witnesses,
showing the evidence, and debating in court.
但在判決宣告前應(yīng)當(dāng)聽取被告人的最后陳述意見。
However, before the judgment is pronounced, the final statement of the
defendant shall be heard.
第一百七十八條 適用簡易程序?qū)徖戆讣?,人民法院?yīng)當(dāng)在受理后二十日以內(nèi)審結(jié)。
Article 178 For a case to be tried through summary procedure, the People's
Court shall conclude it within 20 days after accepting it.
第一百七十九條 人民法院在審理過程中,發(fā)現(xiàn)不宜適用簡易程序的,應(yīng)當(dāng)按照本章第一節(jié)或者第二節(jié)的規(guī)定重新審理。
Article 179 If in the course of trying a case the People's Court discovers
that the summary procedure is not appropriate for the case, it shall try it anew
in accordance with the provisions in Section 1 or Section 2 of this Chapter.
第三章 第二審程序CHAPTER III PROCEDURE OF SECOND INSTANCE
第一百八十條 被告人、自訴人和他們的法定代理人,不服地方各級(jí)人民法院第一審的判決、裁定,有權(quán)用書狀或者口頭向上一級(jí)人民法院上訴。
Article 180 If the defendant, private prosecutor or their legal
representatives refuse to accept a judgment or order of first instance made by a
local People's Court at any level, they shall have the right to appeal in
writing or orally to the People's Court at the next higher level.
被告人的辯護(hù)人和近親屬,經(jīng)被告人同意,可以提出上訴。
Defenders or near relatives of the defendant may, with the consent of the
defendant, file appeals.
附帶民事訴訟的當(dāng)事人和他們的法定代理人,可以對地方各級(jí)人民法院第一審的判決、裁定中的附帶民事訴訟部分,提出上訴。
A party to an incidental civil action or his legal representative may file an
appeal against that part of a judgment or order of first instance made by a
local People's Court at any level that deals with the incidental civil action.
對被告人的上訴權(quán),不得以任何借口加以剝奪。
A defendant shall not be deprived on any pretext of his right to appeal.
第一百八十一條 地方各級(jí)人民檢察院認(rèn)為本級(jí)人民法院第一審的判決、裁定確有錯(cuò)誤的時(shí)候,應(yīng)當(dāng)向上一級(jí)人民法院提出抗訴。
Article 181 If a local People's Procuratorate at any level considers that
there is some definite error in a judgment or order of first instance made by a
People's Court at the same level, it shall present a protest to the People's
Court at the next higher level.
第一百八十二條 被害人及其法定代理人不服地方各級(jí)人民法院第一審的判決的,自收到判決書后五日以內(nèi),有權(quán)請求人民檢察院提出抗訴。
Article 182 If the victim or his legal representative refuses to accept a
judgment of first instance made by a local People's Court at any level, he
shall, within five days from the date of receiving the written judgment, have
the right to request the People's Procuratorate to present a protest.
人民檢察院自收到被害人及其法定代理人的請求后五日以內(nèi),應(yīng)當(dāng)作出是否抗訴的決定并且答復(fù)請求人。
The People's Procuratorate shall, within five days from the date of receiving
the request made by the victim or his legal representative, decide whether to
present the protest or not and give him a reply.
第一百八十三條 不服判決的上訴和抗訴的期限為十日,不服裁定的上訴和抗訴的期限為五日,從接到判決書、裁定書的第二日起算。
Article 183 The time limit for an appeal or a protest against a judgment shall
be 10 days and the time limit for an appeal or a protest against an order shall
be five days; the time limit shall be counted from the day after the written
judgment or order is received.
第一百八十四條
被告人、自訴人、附帶民事訴訟的原告人和被告人通過原審人民法院提出上訴的,原審人民法院應(yīng)當(dāng)在三日以內(nèi)將上訴狀連同案卷、證據(jù)移送上一級(jí)人民法院,同時(shí)將上訴狀副本送交同級(jí)人民檢察院和對方當(dāng)事人。
Article 184 If a defendant, private prosecutor, or a plaintiff or defendant in
an incidental civil action files an appeal through the People's Court which
originally tried the case, the People's Court shall within three days transfer
the petition of appeal together with the case file and the evidence to the
People's Court at the next higher level; at the same time it shall deliver
duplicates of the petition of appeal to the People's Procuratorate at the same
level and to the other party.
被告人、自訴人、附帶民事訴訟的原告人和被告人直接向第二審人民法院提出上訴的,第二審人民法院應(yīng)當(dāng)在三日以內(nèi)將上訴狀交原審人民法院送交同級(jí)人民檢察院和對方當(dāng)事人。
If a defendant, private prosecutor, or a plaintiff or defendant in an
incidental civil action files an appeal directly to the People's Court of second
instance, the People's Court shall within three days transfer the petition of
appeal to the People's Court which originally tried the case for delivery to the
People's Procuratorate at the same level and to the other party.
第一百八十五條
地方各級(jí)人民檢察院對同級(jí)人民法院第一審判決、裁定的抗訴,應(yīng)當(dāng)通過原審人民法院提出抗訴書,并且將抗訴書抄送上一級(jí)人民檢察院。原審人民法院應(yīng)當(dāng)將抗訴書連同案卷、證據(jù)移送上一級(jí)人民法院,并且將抗訴書副本送交當(dāng)事人。
Article 185 If a local People's Procuratorate protests against a judgment or
order of first instance made by the People's Court at the same level, it shall
present a written protest through the People's Court which originally tried the
case and send a copy of the written protest to the People's Procuratorate at the
next higher level. The People's Court which originally tried the case shall
transfer the written protest together with the case file and evidence to the
People's Court at the next higher level and shall deliver duplicates of the
written protest to the parties.
上級(jí)人民檢察院如果認(rèn)為抗訴不當(dāng),可以向同級(jí)人民法院撤回抗訴,并且通知下級(jí)人民檢察院。
If the People's Procuratorate at the next higher level considers the protest
inappropriate, it may withdraw the protest from the People's Court at the same
level and notify the People's Procuratorate at the next lower level.
第一百八十六條 第二審人民法院應(yīng)當(dāng)就第一審判決認(rèn)定的事實(shí)和適用法律進(jìn)行全面審查,不受上訴或者抗訴范圍的限制。
Article 186 A People's Court of second instance shall conduct a complete
review of the facts determined and the application of law in the judgment of
first instance and shall not be limited by the scope of appeal or protest.
共同犯罪的案件只有部分被告人上訴的,應(yīng)當(dāng)對全案進(jìn)行審查,一并處理。
If an appeal is filed by only some of the defendants in a case of joint crime,
the case shall still be reviewed and handled as a whole.
第一百八十七條 第二審人民法院對上訴案件,應(yīng)當(dāng)組成合議庭,開庭審理。
Article 187 A People's Court of second instance shall form a collegial panel
and open a court session to hear a case of appeal.
合議庭經(jīng)過閱卷,訊問被告人、聽取其他當(dāng)事人、辯護(hù)人、訴訟代理人的意見,對事實(shí)清楚的,可以不開庭審理。
However, if after consulting the case file, interrogating the defendant and
heeding the opinions of the other parties, defenders and agents ad litem, the
collegial panel thinks the criminal facts are clear, it may open no court
session.
對人民檢察院抗訴的案件,第二審人民法院應(yīng)當(dāng)開庭審理。
A People's Court of second instance shall open a court session to hear a case
protested by a People's Procuratorate.
第二審人民法院開庭審理上訴、抗訴案件,可以到案件發(fā)生地或者原審人民法院所在地進(jìn)行。
When a People's Court of second instance opens a court session to hear a case
of appeal or protest, it may do so in the place where the case occurred or in
the place where the People's Court which originally tried the case is located.
第一百八十八條 人民檢察院提出抗訴的案件或者第二審人民法院開庭審理的公訴案件,同級(jí)人民檢察院都應(yīng)當(dāng)派員出庭。
Article 188 With respect to both cases protested by a People's Procuratorate
and cases of public prosecution tried by a People's Court of second instance in
a court session, the People's Procuratorate at the same level shall send its
procurators to the court.
第二審人民法院必須在開庭十日以前通知人民檢察院查閱案卷。
The People's Court of second instance must, 10 days before opening of the
court session, notify the People's Procuratorate to examine the case files.
第一百八十九條 第二審人民法院對不服第一審判決的上訴、抗訴案件,經(jīng)過審理后,應(yīng)當(dāng)按照下列情形分別處理:
Article 189 After hearing a case of appeal or protest against a judgment of
first instance, the People's Court of second instance shall handle it in one of
the following manners in light of the different situations:
?。ㄒ唬┰袥Q認(rèn)定事實(shí)和適用法律正確、量刑適當(dāng)?shù)模瑧?yīng)當(dāng)裁定駁回上訴或者抗訴,維持原判;
?。?) if the original judgment was correct in the determination of facts and the
application of law and appropriate in the meting out of punishment, the People's
Court shall order rejection of the appeal or protest and affirm the original
judgment.
?。ǘ┰袥Q認(rèn)定事實(shí)沒有錯(cuò)誤,但適用法律有錯(cuò)誤,或者量刑不當(dāng)?shù)?,?yīng)當(dāng)改判;
?。?) if the original judgment contained no error in the determination of facts
but the application of law was incorrect or the punishment was inappropriately
meted out, the People's Court shall revise the judgment.
?。ㄈ┰袥Q事實(shí)不清楚或者證據(jù)不足的,可以在查清事實(shí)后改判;也可以裁定撤銷原判,發(fā)回原審人民法院重新審判。
?。?) if the facts in the original judgment were unclear or the evidence
insufficient, the People's Court may revise the judgment after ascertaining the
facts, or it may rescind the original judgment and remand the case to the
People's Court which originally tried it for retrial.
第一百九十條 第二審人民法院審判被告人或者他的法定代理人、辯護(hù)人、近親屬上訴的案件,不得加重被告人的刑罰。
Article 190 In the trial of a case appealed by a defendant, or his legal
representative, defender or near relative, the People's Court of second instance
may not increase the criminal punishment on the defendant.
人民檢察院提出抗訴或者自訴人提出上訴的,不受前款規(guī)定的限制。
The restriction laid down in the preceding paragraph shall not apply to cases
protested by a People's Procuratorate or cases appealed by private prosecutors.
第一百九十一條 第二審人民法院發(fā)現(xiàn)第一審人民法院的審理有下列違反法律規(guī)定的訴訟程序的情形之一的,應(yīng)當(dāng)裁定撤銷原判,發(fā)回原審人民法院重新審判:
Article 191 If a People's Court of second instance discovers that when hearing
a case, a People's Court of first instance violates the litigation procedures
prescribed by law in one of the following ways, it shall rule to rescind the
original judgment and remand the case to the People's Court which originally
tried it for retrial:

?。?) violating the provisions of this Law regarding trial in public;
?。ǘ┻`反回避制度的;
?。?) violating the withdrawal system;
?。ㄈ﹦儕Z或者限制了當(dāng)事人的法定訴訟權(quán)利,可能影響公正審判的;
?。?) depriving the parties of their litigation rights prescribed by law or
restricting, such rights, which may hamper impartiality of a trial;
?。ㄋ模徟薪M織的組成不合法的;
?。?) unlawful formation of a judicial organization; or
?。ㄎ澹┢渌`反法律規(guī)定的訴訟程序,可能影響公正審判的。
(5) other violations against the litigation procedures prescribed by law which
may hamper impartiality of a trial.
第一百九十二條 原審人民法院對于發(fā)回重新審判的案件,應(yīng)當(dāng)另行組成合議庭,依照第一審程序進(jìn)行審判。
Article 192 The People's Court which originally tried a case shall form a new
collegial panel for the case remanded to it for retrial, in accordance with the
procedure of first instance.
對于重新審判后的判決,依照本法第一百八十條、第一百八十一條、第一百八十二條的規(guī)定可以上訴、抗訴。
With respect to the judgment rendered after the retrial, an appeal or protest
may be lodged in accordance with the provisions of Article 180, 181 or 182 of
this Law.
第一百九十三條
第二審人民法院對不服第一審裁定的上訴或者抗訴,經(jīng)過審查后,應(yīng)當(dāng)參照本法第一百八十九條、第一百九十一條和第一百九十二條的規(guī)定,分別情形用裁定駁回上訴、抗訴,或者撤銷、變更原裁定。
Article 193 After a People's Court of second instance has reviewed an appeal
or protest against an order of first instance, it shall order rejection of the
appeal or protest or rescind or revise the original order respectively with
reference to the provisions of Article 189, 190 or 192 of this Law.
第一百九十四條 第二審人民法院發(fā)回原審人民法院重新審判的案件,原審人民法院從收到發(fā)回的案件之日起,重新計(jì)算審理期限。
Article 194 The People's Court which originally tried a case shall calculate
the time limit anew for the trial of the case remanded to it by the People's
Court of second instance from the date of receiving the case remanded.
第一百九十五條 第二審人民法院審判上訴或者抗訴案件的程序,除本章已有規(guī)定的以外,參照第一審程序的規(guī)定進(jìn)行。
Article 195 A People's Court of second instance shall try cases of appeal or
protest with reference to the procedure of first instance, in addition to
applying the provisions in this Chapter.
第一百九十六條 第二審人民法院受理上訴、抗訴案件,應(yīng)當(dāng)在一個(gè)月以內(nèi)審結(jié),至遲不得超過一個(gè)半月。
Article 196 After accepting a case of appeal or protest, a People's Court of
second instance shall conclude the trial of the case within one month, or one
and a half months at the latest.
有本法第一百二十六條規(guī)定情形之一的,經(jīng)省、自治區(qū)、直轄市高級(jí)人民法院批準(zhǔn)或者是決定,可以再延長一個(gè)月,Under one of the situations
provided in Article 126 of this Law, the period may be extended by one month
upon the approval or decision by the Higher People's Court of a province,
autonomous region or municipality directly under the Central Government.
但是最高人民法院受理的上訴、抗訴案件,由最高人民法院決定。
However, with respect to cases of appeal or protest accepted by the Supreme
People's Court, the matter shall be decided by the Supreme People's Court
itself.
第一百九十七條 第二審的判決、裁定和最高人民法院的判決、裁定,都是終審的判決、裁定。
Article 197 All judgments and orders of second instance and all judgments and
orders of the Supreme People's Court are final.
第一百九十八條 公安機(jī)關(guān)、人民檢察院和人民法院對于扣押、凍結(jié)犯罪嫌疑人、被告人的財(cái)物及其孳息,應(yīng)當(dāng)妥善保管,以供核查。
Article 198 The public security organs, People's Procuratorates and People's
Courts shall have the property, things of value of the criminal suspects and
defendants, as well as the fruits accruing therefrom, that they have seized or
frozen well kept for examination.
任何單位和個(gè)人不得挪用或者自行處理。
No units or individuals shall misappropriate them or dispose of them without
authorization.
對被害人的合法財(cái)產(chǎn),應(yīng)當(dāng)及時(shí)返還。
The lawful property of the victims shall be returned to them without delay.
對違禁品或者不宜長期保存的物品,應(yīng)當(dāng)依照國家有關(guān)規(guī)定處理。
Prohibited articles and perishable things shall be disposed of in accordance
with the relevant regulations of the State.
對作為證據(jù)使用的實(shí)物應(yīng)當(dāng)隨案移送,對不宜移送的,應(yīng)當(dāng)將其清單、照片或者其他證明文件隨案移送。
Things that serve as tangible evidence shall be transferred together with the
case, but for things that are unsuitable to be transferred, their inventory and
photos and other documents of certification shall be transferred together with
the case.
人民法院作出的判決生效以后,對被扣押、凍結(jié)的贓款贓物及其孳息,除依法返還被害人的以外,一律沒收,上繳國庫。
After a judgment rendered by the People's Court becomes effective, all the
seized or frozen illicit money and goods as well as the fruits accruing
therefrom, except those that are returned to the victim according to law, shall
be confiscated and turned over to the State Treasury.
司法工作人員貪污、挪用或者私自處理被扣押、凍結(jié)的贓款贓物及其孳息的,依法追究刑事責(zé)任;不構(gòu)成犯罪的,給予處分。
Any judicial officer who embezzles or misappropriates or disposes of the
seized or frozen illicit money and goods as well as the fruits accruing
therefrom without authorization shall be investigated for criminal
responsibility according to law; if the offence does not constitute a crime, he
shall be given administrative sanction.
第四章 死刑復(fù)核程序CHAPTER IV PROCEDURE FOR REVIEW OF DEATH SENTENCES
第一百九十九條 死刑由最高人民法院核準(zhǔn)。
Article 199 Death sentences shall be subject to approval by the Supreme
People's Court.
第二百條 中級(jí)人民法院判處死刑的第一審案件,被告人不上訴的,應(yīng)當(dāng)由高級(jí)人民法院復(fù)核后,報(bào)請最高人民法院核準(zhǔn)。
Article 200 A case of first instance where an Intermediate People's Court has
imposed a death sentence and the defendant does not appeal shall be reviewed by
a Higher People's Court and submitted to the Supreme People's Court for
approval.
高級(jí)人民法院不同意判處死刑的,可以提審或者發(fā)回重新審判。
If the Higher People's Court does not agree with the death sentence, it may
bring the case up for trial or remand the case for retrial.
高級(jí)人民法院判處死刑的第一審案件被告人不上訴的,和判處死刑的第二審案件,都應(yīng)當(dāng)報(bào)請最高人民法院核準(zhǔn)。
Cases of first instance where a Higher People's Court has imposed a death
sentence and the defendant does not appeal, and cases of second instance where a
death sentence has been imposed shall all be submitted to the Supreme People's
Court for approval.
第二百零一條 中級(jí)人民法院判處死刑緩期二年執(zhí)行的案件,由高級(jí)人民法院核準(zhǔn)。
Article 201 A case where an Intermediate People's Court has imposed a death
sentence with a two-year suspension of execution, shall be subject to approval
by a Higher People's Court.
第二百零二條 最高人民法院復(fù)核死刑案件,高級(jí)人民法院復(fù)核死刑緩期執(zhí)行的案件,應(yīng)當(dāng)由審判員三人組成合議庭進(jìn)行。
Article 202 Reviews by the Supreme People's Court of cases involving death
sentences and reviews by a Higher People's Court of cases involving death
sentences with a suspension of execution shall be conducted by collegial panels
each composed of three judges.
第五章 審判監(jiān)督程序CHAPTER V PROCEDURE FOR TRIAL SUPERVISION
第二百零三條 當(dāng)事人及其法定代理人、近親屬,對已經(jīng)發(fā)生法律效力的判決、裁定,可以向人民法院或者人民檢察院提出申訴,但是不能停止判決、裁定的執(zhí)行。
Article 203 A party or his legal representative or his near relative may
present a petition to a People's Court or a People's Procuratorate regarding a
legally effective judgment or order, however, execution of the judgment or order
shall not be suspended.
第二百零四條 當(dāng)事人及其法定代理人、近親屬的申訴符合下列情形之一的,人民法院應(yīng)當(dāng)重新審判:
Article 204 If a petition presented by a party or his legal representative or
his near relative conforms to any of the following conditions, the People's
Court shall retry the case:
(一)有新的證據(jù)證明原判決、裁定認(rèn)定的事實(shí)確有錯(cuò)誤的;
?。?) There is new evidence to prove that the confirmation of the facts in the
original judgment or order is definitely wrong;
?。ǘ?jù)以定罪量刑的證據(jù)不確實(shí)、不充分或者證明案件事實(shí)的主要證據(jù)之間存在矛盾的;
?。?) The evidence upon which the condemnation was made and punishment meted out
is unreliable and insufficient, or the major pieces of evidence for supporting
the facts of the case contradict each other;
?。ㄈ┰袥Q、裁定適用法律確有錯(cuò)誤的;
?。?) The application of law in making the original judgment or order is
definitely incorrect; or
?。ㄋ模徟腥藛T在審理該案件的時(shí)候,有貪污受賄,徇私舞弊,枉法裁判行為的。
?。?) The judges in trying the case committed acts of embezzlement, bribery, or
malpractices for personal gain, or bended the law in making judgment.
第二百零五條 各級(jí)人民法院院長對本院已經(jīng)發(fā)生法律效力的判決和裁定,如果發(fā)現(xiàn)在認(rèn)定事實(shí)上或者在適用法律上確有錯(cuò)誤,必須提交審判委員會(huì)處理。
Article 205 If the president of a People's Court at any level finds some
definite error in a legally effective judgment or order of his court as to the
determination of facts or application of law, he shall refer the matter to the
judicial committee for handling.
最高人民法院對各級(jí)人民法院已經(jīng)發(fā)生法律效力的判決和裁定,上級(jí)人民法院對下級(jí)人民法院已經(jīng)發(fā)生法律效力的判決和裁定,如果發(fā)現(xiàn)確有錯(cuò)誤,有權(quán)提審或者指令下級(jí)人民法院再審。
If the Supreme People's Court finds some definite error in a legally effective
judgment or order of a People's Court at any lower level, or if a People's Court
at a higher level finds some definite error in a legally effective judgment or
order of a People's Court at a lower level, it shall have the power to bring the
case up for trial itself or may direct a People's Court at a lower level to
conduct a retrial.
最高人民檢察院對各級(jí)人民法院已經(jīng)發(fā)生法律效力的判決和裁定,上級(jí)人民檢察院對下級(jí)人民法院已經(jīng)發(fā)生法律效力的判決和裁定,如果發(fā)現(xiàn)確有錯(cuò)誤,有權(quán)按照審判監(jiān)督程序向同級(jí)人民法院提出抗訴。
If the Supreme People's Procuratorate finds some definite error in a legally
effective judgment or order of a People's Court at any level, or if a People's
Procuratorate at a higher level finds some definite error in a legally effective
judgment or order of a People's Court at a lower level, it shall have the power
to present a protest to the People's Court at the same level against the
judgment or order in accordance with the procedure for trial supervision.
人民檢察院抗訴的案件,接受抗訴的人民法院應(yīng)當(dāng)組成合議庭重新審理,對于原判決事實(shí)不清楚或者證據(jù)不足的,可以指令下級(jí)人民法院再審。
With respect to a case protested by a People's Procuratorate, the People's
Court that has accepted the protest shall form a collegial panel for retrial; if
the facts, on the basis of which the original judgment was made, are not clear
or the evidence is not sufficient, it may direct the People's Court at the lower
level to try the case again.
第二百零六條 人民法院按照審判監(jiān)督程序重新審判的案件,應(yīng)當(dāng)另行組成合議庭進(jìn)行。
Article 206 A new collegial panel shall be formed for the retrial of a case by
a People's Court in accordance with the procedure for trial supervision.
如果原來是第一審案件,應(yīng)當(dāng)依照第一審程序進(jìn)行審判,所作的判決、裁定,可以上訴、抗訴;
If the case was originally one of first instance, it shall be tried in
accordance with the procedure of first instance and the new judgment or order
may be appealed or protested.
如果原來是第二審案件,或者是上級(jí)人民法院提審的案件,應(yīng)當(dāng)依照第二審程序進(jìn)行審判,所作的判決、裁定,是終審的判決、裁定。
If the case was originally one of second instance or was brought up for trial
by a People's Court at a higher level, it shall be tried in accordance with the
procedure of second instance and the judgment or order rendered shall be final.
第二百零七條 人民法院按照審判監(jiān)督程序重新審判的案件,應(yīng)當(dāng)在作出提審、再審決定之日起三個(gè)月以內(nèi)審結(jié),需要延長期限的,不得超過六個(gè)月。
Article 207 With respect to a case retried by a People's Court in accordance
with the procedure for trial supervision, it shall conclude the trial within
three months from the day on which it makes the decision to bring the case up
for trial itself or on which the decision is made for it to retry the case. If
it is necessary to extend the time limit, the period shall not exceed six
months.
接受抗訴的人民法院按照審判監(jiān)督程序?qū)徟锌乖V的案件,審理期限適用前款規(guī)定;
The provisions of the preceding paragraph shall apply to the time limit for
the trial of a protested case that is accepted by a People's Court and is to be
tried by it in accordance with the procedure for trial supervision.
對需要指令下級(jí)人民法院再審的,應(yīng)當(dāng)自接受抗訴之日起一個(gè)月以內(nèi)作出決定,下級(jí)人民法院審理案件的期限適用前款規(guī)定。
Where it is necessary to direct a People's Court at a lower level to try a
protested case again, a decision to such an effect shall be made within one
month from the day on which the protested case is accepted; the provisions of
the preceding paragraph shall apply to the time limit for the trial of the case
by the People's Court at the lower level.
第二百零八條 判決和裁定在發(fā)生法律效力后執(zhí)行。
Article 208 Judgments and orders shall be executed after they become legally
effective.
下列判決和裁定是發(fā)生法律效力的判決和裁定:
The following judgments and orders are legally effective:
?。ㄒ唬┮堰^法定期限沒有上訴、抗訴的判決和裁定;
?。?) judgments and orders against which no appeal or protest has been filed
within the legally prescribed time limit;
?。ǘ┙K審的判決和裁定;
(2) judgments and orders of final instance; and
(三)最高人民法院核準(zhǔn)的死刑的判決和高級(jí)人民法院核準(zhǔn)的死刑緩期二年執(zhí)行的判決。
?。?) judgments of the death penalty approved by the Supreme People's Court and
judgments of the death penalty with a two-year suspension of execution approved
by a Higher People's Court.
第二百零九條 第一審人民法院判決被告人無罪、免除刑事處罰的,如果被告人在押,在宣判后應(yīng)當(dāng)立即釋放。
Article 209 If a defendant in custody is given the verdict of not guilty or
exempted from criminal punishment by a People's Court of first instance, he
shall be released immediately after the judgment is pronounced.
第二百一十條 最高人民法院判處和核準(zhǔn)的死刑立即執(zhí)行的判決,應(yīng)當(dāng)由最高人民法院院長簽發(fā)執(zhí)行死刑的命令。
Article 210 When a judgment of the death penalty with immediate execution is
pronounced or approved by the Supreme People's Court, the President of the
Supreme People's Court shall sign and issue an order to execute the death
sentence.
被判處死刑緩期二年執(zhí)行的罪犯,在死刑緩期執(zhí)行期間,如果沒有故意犯罪,死刑緩期執(zhí)行期滿,應(yīng)當(dāng)予以減刑,由執(zhí)行機(jī)關(guān)提出書面意見,報(bào)請高級(jí)人民法院裁定;
If a criminal sentenced to death with a two-year suspension of execution
commits no intentional offense during the period of suspension of the sentence
and his punishment should therefore be commuted according to law on expiration
of such period, the executing organ shall submit a written recommendation to a
Higher People's Court for an order;
如果故意犯罪,查證屬實(shí),應(yīng)當(dāng)執(zhí)行死刑,由高級(jí)人民法院報(bào)請最高人民法院核準(zhǔn)。
if there is verified evidence that the criminal has committed intentional
offense and his death sentence should therefore be executed, the Higher People's
Court shall submit the matter to the Supreme People's Court for examination and
approval.
第二百一十一條 下級(jí)人民法院接到最高人民法院執(zhí)行死刑的命令后,應(yīng)當(dāng)在七日以內(nèi)交付執(zhí)行。
Article 211 After receiving an order from the Supreme People's Court to
execute a death sentence, the People's Court at a lower level shall cause the
sentence to be executed within seven days.
但是發(fā)現(xiàn)有下列情形之一的,應(yīng)當(dāng)停止執(zhí)行,并且立即報(bào)告最高人民法院,由最高人民法院作出裁定:
However, under one of the following conditions the People's Court at a lower
level shall suspend execution and immediately submit a report to the Supreme
People's Court for an order:
(一)在執(zhí)行前發(fā)現(xiàn)判決可能有錯(cuò)誤的;
?。?) If it is discovered before the execution of the sentence that the judgment
may contain an error;
(二)在執(zhí)行前罪犯揭發(fā)重大犯罪事實(shí)或者有其他重大立功表現(xiàn),可能需要改判的;
?。?) If, before the execution of the sentence, the criminal exposes major
criminal facts or renders other significantly meritorious service, thus the
sentence may need to be revised; or
?。ㄈ┳锓刚趹言小?
?。?) If the criminal is pregnant.
前款第一項(xiàng)、第二項(xiàng)停止執(zhí)行的原因消失后,必須報(bào)請最高人民法院院長再簽發(fā)執(zhí)行死刑的命令才能執(zhí)行;
If the reason given in sub-paragraph (1) or (2) of the preceding paragraph
which caused the suspension of the sentence has disappeared, the sentence may be
executed only after a report is submitted to the President of the Supreme
People's Court for him to sign and issue another order for execution of the
death sentence.
由于前款第三項(xiàng)原因停止執(zhí)行的,應(yīng)當(dāng)報(bào)請最高人民法院依法改判。
If execution is suspended for the reason given in sub-paragraph (3) of the
preceding paragraph, a request shall be submitted to the Supreme People's Court
for it to alter the sentence according to law.
第二百一十二條 人民法院在交付執(zhí)行死刑前,應(yīng)當(dāng)通知同級(jí)人民檢察院派員臨場監(jiān)督。
Article 212 Before a People's Court causes a death sentence to be executed, it
shall notify the People's Procuratorate at the same level to send an officer to
supervise the execution.
死刑采用槍決或者注射等方法執(zhí)行。
A death sentence shall be executed by such means as shooting or injection.
死刑可以在刑場或者指定的羈押場所內(nèi)執(zhí)行。
A death sentence may be executed on the execution ground or in a designated
place of custody.
指揮執(zhí)行的審判人員,對罪犯應(yīng)當(dāng)驗(yàn)明正身,訊問有無遺言、信札,然后交付執(zhí)行人員執(zhí)行死刑。
The judicial officer directing the execution shall verify the identity of the
criminal, ask him if he has any last words or letters and then deliver him to
the executioner for execution of the death sentence.
在執(zhí)行前,如果發(fā)現(xiàn)可能有錯(cuò)誤,應(yīng)當(dāng)暫停執(zhí)行,報(bào)請最高人民法院裁定。
If it is discovered before the execution that there may be an error, the
execution shall be suspended and a report submitted to the Supreme People's
Court for an order.
執(zhí)行死刑應(yīng)當(dāng)公布,不應(yīng)示眾。
Executions of death sentences shall be announced but shall not be held in
public.
執(zhí)行死刑后,在場書記員應(yīng)當(dāng)寫成筆錄。交付執(zhí)行的人民法院應(yīng)當(dāng)將執(zhí)行死刑情況報(bào)告最高人民法院。
After a death sentence is executed, the court clerk on the scene shall prepare
a written record of it. The People's Court that caused the death sentence to be
executed shall submit a report on the execution to the Supreme People's Court.
執(zhí)行死刑后,交付執(zhí)行的人民法院應(yīng)當(dāng)通知罪犯家屬。
After a death sentence is executed, the People's Court that caused the death
sentence to be executed shall notify the family members of the criminal.
第二百一十三條 罪犯被交付執(zhí)行刑罰的時(shí)候,應(yīng)當(dāng)由交付執(zhí)行的人民法院將有關(guān)的法律文書送達(dá)監(jiān)獄或者其他執(zhí)行機(jī)關(guān)。
Article 213 When a criminal is handed over for execution of his criminal
punishment, the People's Court that caused the sentence to be executed shall
deliver the relevant legal documents to a prison or other executing organ.
對于被判處死刑緩期二年執(zhí)行、無期徒刑、有期徒刑的罪犯,由公安機(jī)關(guān)依法將該罪犯送交監(jiān)獄執(zhí)行刑罰。
A criminal sentenced to death with a two-year suspension of execution, or life
imprisonment, or fixed-term imprisonment shall, according to law, be handed over
by a public security organ to a prison for execution of his criminal punishment.
對于被判處有期徒刑的罪犯,在被交付執(zhí)行刑罰前,剩余刑期在一年以下的,由看守所代為執(zhí)行。
As to a criminal sentenced to fixed-term imprisonment, if the remaining term
of sentence is not more than one year before he is handed over for execution of
his criminal punishment, the sentence shall be executed by a detention house
instead.
對于被判處拘役的罪犯,由公安機(jī)關(guān)執(zhí)行。
As to a criminal sentenced to criminal detention, the sentence shall be
executed by a public security organ.
對未成年犯應(yīng)當(dāng)在未成年犯管教所執(zhí)行刑罰。
As to a juvenile delinquent, his criminal punishment shall be executed in a
reformatory for juvenile delinquents.
執(zhí)行機(jī)關(guān)應(yīng)當(dāng)將罪犯及時(shí)收押,并且通知罪犯家屬。
An executing organ shall take a criminal into custody without delay and notify
the family members of the criminal.
判處有期徒刑、拘役的罪犯,執(zhí)行期滿,應(yīng)當(dāng)由執(zhí)行機(jī)關(guān)發(fā)給釋放證明書。
A criminal sentenced to fixed-term imprisonment or criminal detention, upon
completion of execution of the sentence, shall be issued a certificate of
release by the executing organ.
第二百一十四條 對于被判處有期徒刑或者拘役的罪犯,有下列情形之一的,可以暫予監(jiān)外執(zhí)行:
Article 214 A criminal sentenced to fixed-term imprisonment or criminal
detention, under either of the following conditions, may be permitted to
temporarily serve his sentence outside prison:
?。ㄒ唬┯袊?yán)重疾病需要保外就醫(yī)的;
?。?) If the criminal is seriously ill and needs to be released on parole for
medical treatment; or
?。ǘ言谢蛘哒诓溉樽约簨雰旱膵D女。
?。?) If the criminal is pregnant or is breast-feeding her own baby.
對于適用保外就醫(yī)可能有社會(huì)危險(xiǎn)性的罪犯,或者自傷自殘的罪犯,不得保外就醫(yī)。
If a criminal to be released on parole for medical treatment may endanger the
community or if a criminal injures himself or makes himself disabled, he may not
be released on parole for medical treatment.
對于罪犯確有嚴(yán)重疾病,必須保外就醫(yī)的,由省級(jí)人民政府指定的醫(yī)院開具證明文件,依照法律規(guī)定的程序?qū)徟?
If a criminal is truly ill seriously and must be released on parole for
medical treatment, a supporting document prepared by the hospital designated by
a people's government at the provincial level shall be needed, and the matter
shall be subject to examination and approval according to the procedure
prescribed by law.
發(fā)現(xiàn)被保外就醫(yī)的罪犯不符合保外就醫(yī)條件的,或者嚴(yán)重違反有關(guān)保外就醫(yī)的規(guī)定的,應(yīng)當(dāng)及時(shí)收監(jiān)。
If it is found that a criminal released on parole for medical treatment does
not meet the conditions for release on parole for medical treatment or the
criminal has gravely violated the regulations regarding such release, he shall
be taken back to prison without delay.
對于被判處有期徒刑、拘役,生活不能自理,適用暫予監(jiān)外執(zhí)行不致危害社會(huì)的罪犯,可以暫予監(jiān)外執(zhí)行。
As to a criminal sentenced to fixed-term imprisonment or criminal detention
who is unable to look after himself in everyday life, if his service of sentence
outside prison would not endanger the community, he may be permitted to serve
his sentence outside prison temporarily.
對于暫予監(jiān)外執(zhí)行的罪犯,由居住地公安機(jī)關(guān)執(zhí)行,執(zhí)行機(jī)關(guān)應(yīng)當(dāng)對其嚴(yán)格管理監(jiān)督,基層組織或者罪犯的原所在單位協(xié)助進(jìn)行監(jiān)督。
If a criminal is permitted to serve his sentence outside prison temporarily,
the sentence shall be executed by the public security organ in the place where
the criminal resides, the executing organ shall exercise strict control and
supervision over him and the grass-roots organizations or the unit where the
criminal originally belonged shall assist in supervision.
第二百一十五條 批準(zhǔn)暫予監(jiān)外執(zhí)行的機(jī)關(guān)應(yīng)當(dāng)將批準(zhǔn)的決定抄送人民檢察院。
Article 215 The organ that approved the temporary service of sentence outside
prison shall send a copy of its decision on the approval to a People's
Procuratorate.
人民檢察院認(rèn)為暫予監(jiān)外執(zhí)行不當(dāng)?shù)?,?yīng)當(dāng)自接到通知之日起一個(gè)月以內(nèi)將書面意見送交批準(zhǔn)暫予監(jiān)外執(zhí)行的機(jī)關(guān),批準(zhǔn)暫予監(jiān)外執(zhí)行的機(jī)關(guān)接到人民檢察院的書面意見后,應(yīng)當(dāng)立即對該決定進(jìn)行重新核查。
If the People's Procuratorate considers the temporary service of sentence
outside prison improper, it shall within one month from the date of receiving
the notification, submit its recommendation in writing to the organ that
approved the temporary service of sentence outside prison, which shall, upon
receiving the written recommendation of the People's Procuratorate, reexamine
its decision without delay.
第二百一十六條 暫予監(jiān)外執(zhí)行的情形消失后,罪犯刑期未滿的,應(yīng)當(dāng)及時(shí)收監(jiān)。
Article 216 As soon as the conditions under which a criminal is permitted to
serve his sentence outside prison temporarily cease to exist, if the criminal's
term of sentence has not expired, he shall be taken back to prison without
delay.
罪犯在暫予監(jiān)外執(zhí)行期間死亡的,應(yīng)當(dāng)及時(shí)通知監(jiān)獄。
If a criminal dies during the period in which he is serving his sentence
outside prison temporarily, the prison shall be informed thereof without delay.
第二百一十七條 對于被判處徒刑緩刑的罪犯,由公安機(jī)關(guān)交所在單位或者基層組織予以考察。
Article 217 A criminal who has been sentenced to imprisonment with a
suspension of execution shall be placed by the public security organ under the
observation of his unit or a grass-roots organization.
對于被假釋的罪犯,在假釋考驗(yàn)期限內(nèi),由公安機(jī)關(guān)予以監(jiān)督。
A criminal released on parole shall be supervised by a public security organ
during the test period of parole.
第二百一十八條 對于被判處管制、剝奪政治權(quán)利的罪犯,由公安機(jī)關(guān)執(zhí)行。
Article 218 Sentence of public surveillance or deprivation of political rights
that has been imposed on a criminal shall be executed by a public security
organ.
執(zhí)行期滿,應(yīng)當(dāng)由執(zhí)行機(jī)關(guān)通知本人,并向有關(guān)群眾公開宣布解除管制或者恢復(fù)政治權(quán)利。
After the sentence is served, the executing organ shall notify the criminal
himself and publicly announce to the people concerned that public surveillance
is ended or that his political rights are restored.
第二百一十九條 被判處罰金的罪犯,期滿不繳納的,人民法院應(yīng)當(dāng)強(qiáng)制繳納;
Article 219 If a criminal sentenced to a fine fails to pay the fine within the
time limit, the People's Court shall compel him to pay.
如果由于遭遇不能抗拒的災(zāi)禍繳納確實(shí)有困難的,可以裁定減少或者免除。
If he has true difficulty in paying because he has suffered an irresistible
disaster, an order may be made to reduce the fine or exempt him from payment.
第二百二十條 沒收財(cái)產(chǎn)的判決,無論附加適用或者獨(dú)立適用,都由人民法院執(zhí)行;在必要的時(shí)候,可以會(huì)同公安機(jī)關(guān)執(zhí)行。
Article 220 All judgments on confiscation of property, whether imposed as a
supplementary punishment or independently, shall be executed by the People's
Courts; when necessary, the People's Courts may execute such judgments jointly
with the public security organs.
第二百二十一條 罪犯在服刑期間又犯罪的,或者發(fā)現(xiàn)了判決的時(shí)候所沒有發(fā)現(xiàn)的罪行,由執(zhí)行機(jī)關(guān)移送人民檢察院處理。
Article 221 If a criminal commits a crime again while serving his sentence, or
if a criminal act that is discovered was not known at the time of judgment, he
shall be transferred by the executing organ to a People's Procuratorate for
handling.
被判處管制、拘役、有期徒刑或者無期徒刑的罪犯,在執(zhí)行期間確有悔改或者立功表現(xiàn),應(yīng)當(dāng)依法予以減刑、假釋的時(shí)候,由執(zhí)行機(jī)關(guān)提出建議書,報(bào)請人民法院審核裁定。
If a criminal sentenced to public surveillance, criminal detention, fixed-term
imprisonment or life imprisonment shows true repentance or renders meritorious
service while serving his sentence and should be granted a commutation of
sentence or be released on parole according to law, the executing organ shall
submit a written recommendation to a People's Court for examination and an
order.
第二百二十二條 人民檢察院認(rèn)為人民法院減刑、假釋的裁定不當(dāng),應(yīng)當(dāng)在收到裁定書副本后二十日以內(nèi),向人民法院提出書面糾正意見。
Article 222 If a People's Procuratorate considers that the order on
commutation of sentence or on parole made by a People's Court is improper, it
shall, within 20 days from the date of receiving a copy of the written order,
submit a written recommendation to the People's Court for correction.
人民法院應(yīng)當(dāng)在收到糾正意見后一個(gè)月以內(nèi)重新組成合議庭進(jìn)行審理,作出最終裁定。
The People's Court shall, within one month from the date of receiving the
recommendation, form a new collegial panel to handle the case and render a final
order.
第二百二十三條 監(jiān)獄和其他執(zhí)行機(jī)關(guān)在刑罰執(zhí)行中,如果認(rèn)為判決有錯(cuò)誤或者罪犯提出申訴,應(yīng)當(dāng)轉(zhuǎn)請人民檢察院或者原判人民法院處理。
Article 223 If, during execution of a criminal punishment, the prison or any
other executing organ believes that there is an error in the judgment or the
criminal lodges a petition, it shall refer the matter to the People's
Procuratorate or the People's Court that pronounced the original judgment for
handling.
第二百二十四條 人民檢察院對執(zhí)行機(jī)關(guān)執(zhí)行刑罰的活動(dòng)是否合法實(shí)行監(jiān)督。如果發(fā)現(xiàn)有違法的情況,應(yīng)當(dāng)通知執(zhí)行機(jī)關(guān)糾正。
Article 224 The People's Procuratorates shall supervise the execution of
criminal punishments by executing organs to see if the execution conforms to
law. If they discover any illegalities, they shall notify the executing organs
to correct them.
第二百二十五條 軍隊(duì)保衛(wèi)部門對軍隊(duì)內(nèi)部發(fā)生的刑事案件行使偵查權(quán)。
Article 225 The security departments of the Army shall exercise the power of
investigation with respect to criminal offences that have occurred in the Army.
對罪犯在監(jiān)獄內(nèi)犯罪的案件由監(jiān)獄進(jìn)行偵查。
Crimes committed by criminals in prison shall be investigated by the prison.
軍隊(duì)保衛(wèi)部門、監(jiān)獄辦理刑事案件,適用本法的有關(guān)規(guī)定。
The handling of criminal cases by the security departments of the Army and by
prisions shall be governed by the relevant provisions of this law.
