第一章總則

  Chapter I General Provisions

  第一條為了防治洪水,防御、減輕洪澇災(zāi)害,維護(hù)人民的生命和財(cái)產(chǎn)安全,保障社會(huì)主義現(xiàn)代化建設(shè)順利進(jìn)行,制定本法。

  Article 1 This Law is enacted with a view to preventing and controlling flood, taking precautions against and alleviating calamities by flood and waterlogging, maintaining the safety of people's lives and property, and safeguarding the smooth progress of the socialist modernization construction.

  第二條防洪工作實(shí)行全面規(guī)劃、統(tǒng)籌兼顧、預(yù)防為主、綜合治理、局部利益服從全局利益的原則。

  Article 2 The work for flood control shall observe the principles of unified planning, overall consideration, focusing on prevention, integrated measures for treatment and subordinating local interests to general interests.

  第三條防洪工程設(shè)施建設(shè),應(yīng)當(dāng)納入國(guó)民經(jīng)濟(jì)和社會(huì)發(fā)展計(jì)劃。

  Article 3 The construction if flood control works should be incorporated into the national economic and social development plan.

  防洪費(fèi)用按照政府投入同受益者合理承擔(dān)相結(jié)合的原則籌集。

  Flood control funds shall be raised according to the principle of combining government input with rational payment by beneficiaries.

  第四條開發(fā)利用和保護(hù)水資源,應(yīng)當(dāng)服從防洪總體安排,實(shí)行興利與除害相結(jié)合的原則。

  Article 4 The exploration and protection of water resources should be subject to the overall arrangements for flood control and observe the principle of combining the promotion of advantages with the elimination of disadvantages.

  江河、湖泊治理以及防洪工程設(shè)施建設(shè),應(yīng)當(dāng)符合流域綜合規(guī)劃,與流域水資源的綜合開發(fā)相結(jié)合。

  The control of rivers and lakes and the construction of flood control works should conform to the comprehensive plans for river basins and be integrated with the comprehensive exploration of water resources in river basins.

  本法所稱綜合規(guī)劃是指開發(fā)利用水資源和防治水害的綜合規(guī)劃。

  The comprehensive plans referred to in this Law mean those for the exploration of water resources and the prevention and control of water disasters.

  第五條防洪工作按照流域或者區(qū)域?qū)嵭薪y(tǒng)一規(guī)劃、分級(jí)實(shí)施和流域管理與行政區(qū)域管理相結(jié)合的制度。

  Article 5 The work for flood control shall be carried out in the light of river basins or administrative areas and according to a system by which unified planning shall be implemented at different levels and consideration given to the administration of river basins as well as the administration of administrative areas.

  第六條任何單位和個(gè)人都有保護(hù)防洪工程設(shè)施和依法參加防汛抗洪的義務(wù)。

  Article 6 All units and individuals shall have the obligations to protect flood control works and to take part in flood control and flood fighting according to law.

  第七條各級(jí)人民政府應(yīng)當(dāng)加強(qiáng)對(duì)防洪工作的統(tǒng)一領(lǐng)導(dǎo),組織有關(guān)部門、單位,動(dòng)員社會(huì)力量,依靠科技進(jìn)步,有計(jì)劃地進(jìn)行江河、湖泊治理,采取措施加強(qiáng)防洪工程設(shè)施建設(shè),鞏固、提高防洪能力。

  Article 7 People's governments at all levels should intensify the unified leadership over the work for flood control, organize departments and units concerned, mobilize social forces, depend on scientific and technological progress, harness rivers and lakes in a planned way and take measures to enforce the construction of flood control works in order to consolidate and enhance flood control capacity.

  各級(jí)人民政府應(yīng)當(dāng)組織有關(guān)部門、單位,動(dòng)員社會(huì)力量,做好防汛抗洪和洪澇災(zāi)害后的恢復(fù)與救濟(jì)工作。

  People's governments at all levels should organize departments and units concerned and mobilize social forces to ensure flood control and flood fighting and reconstruction and relief work after flood or waterlogging calamities.

  各級(jí)人民政府應(yīng)當(dāng)對(duì)蓄滯洪區(qū)予以扶持;蓄滯洪后,應(yīng)當(dāng)依照國(guó)家規(guī)定予以補(bǔ)償或者救助。

  People's governments at all levels should lend support to flood storage and detention areas and provide compensations and aids according to the state provisions after flood storing and detaining.

  第八條國(guó)務(wù)院水行政主管部門在國(guó)務(wù)院的領(lǐng)導(dǎo)下,負(fù)責(zé)全國(guó)防洪的組織、協(xié)調(diào)、監(jiān)督、指導(dǎo)等日常工作。

  Article 8 The water conservancy administrative department under the State Council shall, under the leadership of the State Council, be responsible for routine duties of organization, coordination, supervision and guidance for flood control nationwide.

  國(guó)務(wù)院水行政主管部門在國(guó)家確定的重要江河、湖泊設(shè)立的流域管理機(jī)構(gòu),在所管轄的范圍內(nèi)行使法律、行政法規(guī)規(guī)定和國(guó)務(wù)院水行政主管部門授權(quán)的防洪協(xié)調(diào)和監(jiān)督管理職責(zé)。

  River basins administrative agencies set up by the water conservancy administrative department under the State Council for major. rivers and lakes as designated by the state shall perform duties of coordination, supervision and administration of flood control within their jurisdiction as provided for by laws and administrative regulations and authorized by the water conservancy administrative department under the State Council.

  國(guó)務(wù)院建設(shè)行政主管部門和其他有關(guān)部門在國(guó)務(wù)院的領(lǐng)導(dǎo)下,按照各自的職責(zé),負(fù)責(zé)有關(guān)的防洪工作。

  The construction administrative department and other relevant departments under the State Council shall, under the leadership of the State Council, be responsible for relevant work of flood control within their scope of powers and duties.

  縣級(jí)以上地方人民政府水行政主管部門在本級(jí)人民政府的領(lǐng)導(dǎo)下,負(fù)責(zé)本行政區(qū)域內(nèi)防洪的組織、協(xié)調(diào)、監(jiān)督、指導(dǎo)等日常工作。

  Water conservancy administrative department s under local people's governments at or above the county level shall, under the leadership of the people's governments at the same level, be responsible for routine duties of organization, coordination, supervision and guidance for flood control within their respective administrative areas.

  縣級(jí)以上地方人民政府建設(shè)行政主管部門和其他有關(guān)部門在本級(jí)人民政府的領(lǐng)導(dǎo)下,按照各自的職責(zé),負(fù)責(zé)有關(guān)的防洪工作。

  Construction administrative departments and other relevant administrative departments under local people's governments at or above the county level shall, under the leadership of the people's governments at the same level, be responsible for relevant work of flood control within their scope of powers and duties.

  第二章防洪規(guī)劃

  Chapter II Flood Control Planning

  第九條防洪規(guī)劃是指為防治某一流域、河段或者區(qū)域的洪澇災(zāi)害而制定的總體部署,包括國(guó)家確定的重要江河、湖泊的流域防洪規(guī)劃,其他江河、河段、湖泊的防洪規(guī)劃以及區(qū)域防洪規(guī)劃。

  Article 9 Flood control planning refers to the overall arrangement for the prevention and control of flood and waterlogging calamities in a certain river basin, river course or region, including river bas in flood control planning for major rivers and lakes designated by the state, flood control planning of other rivers, river courses and lakes as well as regional flood control planning.

  防洪規(guī)劃應(yīng)當(dāng)服從所在流域、區(qū)域的綜合規(guī)劃;區(qū)域防洪規(guī)劃應(yīng)當(dāng)服從所在流域的流域防洪規(guī)劃。

  Flood control planning should be subject to the comprehensive planning of a certain river basin or region. Regional flood control planning should be subject to the flood control planning for a certain river basin.

  防洪規(guī)劃是江河、湖泊治理和防洪工程設(shè)施建設(shè)的基本依據(jù)。

  Flood control planning constitutes the bas is for the control of rivers and lakes and the construction of flood control works.

  第十條國(guó)家確定的重要江河、湖泊的防洪規(guī)劃,由國(guó)務(wù)院水行政主管部門依據(jù)該江河、湖泊的流域綜合規(guī)劃,會(huì)同有關(guān)部門和有關(guān)省、自治區(qū)、直轄市人民政府編制,報(bào)國(guó)務(wù)院批準(zhǔn)。

  Article 10 Flood control planning for major rivers and lakes designated by the state shall, in accordance with comprehensive river basin planning for these rivers and lakes, be formulated by the water conservancy administrative department under the State Council in conjunction with other relevant departments and the people's government(s) of the province(s), autonomous region(s) and municipality(s) concerned directly under the Central Government, and submitted to the State Council for approval.

  其他江河、河段、湖泊的防洪規(guī)劃或者區(qū)域防洪規(guī)劃,由縣級(jí)以上地方人民政府水行政主管部門分別依據(jù)流域綜合規(guī)劃、區(qū)域綜合規(guī)劃,會(huì)同有關(guān)部門和有關(guān)地區(qū)編制,報(bào)本級(jí)人民政府批準(zhǔn),并報(bào)上一級(jí)人民政府水行政主管部門備案;

  Flood control planning for other rivers, river courses and lakes or regional flood control planning shall, separately in accordance with comprehensive river bas in planning and comprehensive regional planning, be formulated by water conservancy administrative department s under local people's governments at or above the county level in conjunction with other relevant departments or regions, submitted to the people's governments at the same level for approval and then submitted to the water conservancy administrative departments under the people's governments at the next higher level for the record.

  跨省、自治區(qū)、直轄市的江河、河段、湖泊的防洪規(guī)劃由有關(guān)流域管理機(jī)構(gòu)會(huì)同江河、河段、湖泊所在地的省、自治區(qū)、直轄市人民政府水行政主管部門、有關(guān)主管部門擬定,分別經(jīng)有關(guān)省、自治區(qū)、直轄市人民政府審查提出意見后,報(bào)國(guó)務(wù)院水行政主管部門批準(zhǔn)。

  Flood control planning for rivers, river courses or lakes involving two or more provinces , autonomous regions and municipalities directly under the Central Government shall be drafted by the administrative agency for the relevant river basin in conjunction with the water conservancy administrative departments and other relevant departments under the people's government(s) of the province(s), autonomous region(s) and municipality(s) directly under the Central Government wherein the river, river course or lake drains water and, after the people's government(s) of the province(s), autonomous region(s) and municipality(s) involved directly under the Central Government examines it and comes up with comments, be submitted to the water conservancy administrative department under the State Council for approval.

  城市防洪規(guī)劃,由城市人民政府組織水行政主管部門、建設(shè)行政主管部門和其他有關(guān)部門依據(jù)流域防洪規(guī)劃、上一級(jí)人民政府區(qū)域防洪規(guī)劃編制,按照國(guó)務(wù)院規(guī)定的審批程序批準(zhǔn)后納入城市總體規(guī)劃。

  Urban flood control planning shall, in accordance with the river basin flood control planning and the regional flood control planning of the people's government at the next higher level, be formulated by the water conservancy administrative department, the construct ion administrative department and other relevant administrative departments under the people's government of a city which shall organize those administrative departments in the formulation of the planning, and be included into the overall urban planning subject to approval through the examination and approval procedures stipulated by the State Council.

  修改防洪規(guī)劃,應(yīng)當(dāng)報(bào)經(jīng)原批準(zhǔn)機(jī)關(guān)批準(zhǔn)。

  Amendment to flood control planning should be subject to the approval from the original approval organ.

  第十一條編制防洪規(guī)劃,應(yīng)當(dāng)遵循確保重點(diǎn)、兼顧一般,以及防汛和抗旱相結(jié)合、工程措施和非工程措施相結(jié)合的原則,充分考慮洪澇規(guī)律和上下游、左右岸的關(guān)系以及國(guó)民經(jīng)濟(jì)對(duì)防洪的要求,并與國(guó)土規(guī)劃和土地利用總體規(guī)劃相協(xié)調(diào)。

  Article 11 The formulation of flood control planning should, following the principle of ensuring key projects and considering others at the same time, and integrating flood control with drought fighting, engineering measures with non--engineering measures, take full account of the flood--drought law, the relation of the upper and lower reaches and of both banks of a river, and the requirements for flood control in the national economy, and be coordinated with the national land planning and the overall land use planning as well.

  防洪規(guī)劃應(yīng)當(dāng)確定防護(hù)對(duì)象、治理目標(biāo)和任務(wù)、防洪措施和實(shí)施方案,劃定洪泛區(qū)、蓄滯洪區(qū)和防洪保護(hù)區(qū)的范圍,規(guī)定蓄滯洪區(qū)的使用原則。

  Flood control planning should include the protected objects, aims and tasks of flood control, flood control measures and act ion plans, delimit the flooded area, the flood storage and detention area and the flood control protected area, and determine the principle for use of the flood storage and detention area.

  第十二條受風(fēng)暴潮威脅的沿海地區(qū)的縣級(jí)以上地方人民政府,應(yīng)當(dāng)把防御風(fēng)暴潮納入本地區(qū)的防洪規(guī)劃,加強(qiáng)海堤(海塘)、擋潮閘和沿海防護(hù)林等防御風(fēng)暴潮工程體系建設(shè),監(jiān)督建筑物、構(gòu)筑物的設(shè)計(jì)和施工符合防御風(fēng)暴潮的需要。

  Article 12 Local people's governments at or above the county level in coastal areas which are threatened by storm tides should include the prevention of storm tides into the flood control planning within their respective areas , strengthen the construct ion of systems of anti--storm tides works including seawalls (sea dykes), tidewater gates and coastal shelter--forest, and supervise the design and construct ion of buildings and constructions that should meet the requirements for the prevention of storm tides.

  第十三條山洪可能誘發(fā)山體滑坡、崩塌和泥石流的地區(qū)以及其他山洪多發(fā)地區(qū)的縣級(jí)以上地方人民政府,應(yīng)當(dāng)組織負(fù)責(zé)地質(zhì)礦產(chǎn)管理工作的部門、水行政主管部門和其他有關(guān)部門對(duì)山體滑坡、崩塌和泥石流隱患進(jìn)行全面調(diào)查,劃定重點(diǎn)防治區(qū),采取防治措施。

  Article 13 Local people's governments at or above the county level in areas where mountain torrents may trigger landslides, collapses and mud--rock flows and in other area where mountain torrents frequently occur should organize the departments in charge of geological and mineral administration, water conservancy administrative department s and other relevant department s to conduct a general investigation on hidden dangers of landslides, collapses and mud--rock flows, to delimit zones for focal control, and to take prevention and control measures.

  城市、村鎮(zhèn)和其他居民點(diǎn)以及工廠、礦山、鐵路和公路干線的布局,應(yīng)當(dāng)避開山洪威脅;已經(jīng)建在受山洪威脅的地方的,應(yīng)當(dāng)采取防御措施。

  Distribution of cities, towns and other inhabited areas as well as factories , mines and trunk lines of railways and highways should avert the threat of mountain torrents; for those having been built in places threatened by mountain torrents, precautions should be taken.

  第十四條平原、洼地、水網(wǎng)圩區(qū)、山谷、盆地等易澇地區(qū)的有關(guān)地方人民政府,應(yīng)當(dāng)制定除澇治澇規(guī)劃,組織有關(guān)部門、單位采取相應(yīng)的治理措施,完善排水系統(tǒng),發(fā)展耐澇農(nóng)作物種類和品種,開展洪澇、干旱、鹽堿綜合治理。

  Article 14 Local people's governments concerned in areas liable to waterlogging such as plains, depressions, river networks and embankment areas, valleys and basins should formulate planning for elimination and control of waterlogging, organize relevant departments and units to take corresponding control measures, ,improve drainage systems, develop types and varieties of waterlogging-enduring crops and take integrated measures for controlling flood and water logging, drought, saline and alkaline land.

  城市人民政府應(yīng)當(dāng)加強(qiáng)對(duì)城區(qū)排澇管網(wǎng)、泵站的建設(shè)和管理。

  People's governments of cities and towns should strengthen the administration and construction of waterlogging drainage piping systems and pumping stations in urban areas.

  第十五條國(guó)務(wù)院水行政主管部門應(yīng)當(dāng)會(huì)同有關(guān)部門和省、自治區(qū)、直轄市人民政府制定長(zhǎng)江、黃河、珠江、遼河、淮河、海河入海河口的整治規(guī)劃。

  Article 15 The water conservancy administrative department under the State Council should, in conjunction with the relevant departments and the people's governments concerned of provinces, autonomous regions and municipalities directly under the Central Government, formulate the planning for controlling estuaries in the Yangtze River, Yellow River, Pearl River, Liao River, Huai River and Hai River.

  在前款入海河口圍海造地,應(yīng)當(dāng)符合河口整治規(guī)劃。

  Reclaiming land from seawaters in estuaries mentioned in the preceding paragraph should conform to the planning for controlling estuaries.

  第十六條防洪規(guī)劃確定的河道整治計(jì)劃用地和規(guī)劃建設(shè)的堤防用地范圍內(nèi)的土地,經(jīng)土地管理部門和水行政主管部門會(huì)同有關(guān)地區(qū)核定,報(bào)經(jīng)縣級(jí)以上人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限批準(zhǔn)后,可以劃定為規(guī)劃保留區(qū);該規(guī)劃保留區(qū)范圍內(nèi)的土地涉及其他項(xiàng)目用地的,有關(guān)土地管理部門和水行政主管部門核定時(shí),應(yīng)當(dāng)征求有關(guān)部門的意見。

  Article 16 Land to be used for realignment of river courses as planned in flood control planning and land to be used for dykes in planned construction projects may be delimited as planned reserve zones upon verification by the land administrative department and the water conservancy administrative department in conjunction with the involved areas, and submitted for approval of the people's government at or above the county level within the scope of powers authorized by the State Council. If land within the planned reserve zones involves that to be used in other projects, the land administrative department and the water conservancy administrative department should consul t with departments concerned for verification of land.

  規(guī)劃保留區(qū)依照前款規(guī)定劃定后,應(yīng)當(dāng)公告。

  The planned reserve zones should be announced upon delimitation according to the provisions of the preceding paragraph.

  前款規(guī)劃保留區(qū)內(nèi)不得建設(shè)與防洪無關(guān)的工礦工程設(shè)施;在特殊情況下,國(guó)家工礦建設(shè)項(xiàng)目確需占用前款規(guī)劃保留區(qū)內(nèi)的土地的,應(yīng)當(dāng)按照國(guó)家規(guī)定的基本建設(shè)程序報(bào)請(qǐng)批準(zhǔn),并征求有關(guān)水行政主管部門的意見。

  No industrial or mining facilities not related to flood control may be constructed within the planned reserve zones. If special circumstances exist under which it is really necessary for state industrial and mining projects to occupy land within the planned reserve zones mentioned in the preceding paragraph, approval should be obtained according to the procedures set by the state for capital construct ion and consultations should be made with the relevant water conservancy administrative department.

  防洪規(guī)劃確定的擴(kuò)大或者開辟的人工排洪道用地范圍內(nèi)的土地,經(jīng)省級(jí)以上人民政府土地管理部門和水行政主管部門會(huì)同有關(guān)部門、有關(guān)地區(qū)核定,報(bào)省級(jí)以上人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限批準(zhǔn)后,可以劃定為規(guī)劃保留區(qū),適用前款規(guī)定。

  Land to be used for expanding or exploring man--made floodwater drainage channels as determined in flood control planning may be delimited as planned reserve zones to which the provisions in the preceding paragraph shall apply upon verification by the land administrative department and the water conservancy administrative department of the people's government at or above the provincial level in conjunction with other relevant departments and regions and submitted for approval of the people's government at or above the provincial level within the scope of powers authorized by the State Council.

  第十七條在江河、湖泊上建設(shè)防洪工程和其他水工程、水電站等,應(yīng)當(dāng)符合防洪規(guī)劃的要求;水庫應(yīng)當(dāng)按照防洪規(guī)劃的要求留足防洪庫容。

  Article 17 Construction of flood control works or other hydraulic works and hydropower s tat ions in rivers and lakes should conform to the requirements of flood control planning. Reservoirs should keep adequate storage capacity for flood control according to the requirements of flood control planning.

  前款規(guī)定的防洪工程和其他水工程、水電站的可行性研究報(bào)告按照國(guó)家規(guī)定的基本建設(shè)程序報(bào)請(qǐng)批準(zhǔn)時(shí),應(yīng)當(dāng)附具有關(guān)水行政主管部門簽署的符合防洪規(guī)劃要求的規(guī)劃同意書。

  When the feasibility study report for flood control works or other hydraulic works and hydropower stat ions stipulated in the preceding paragraph is submitted for approval pursuant to the procedures set by the state for capital construction, a consent document for planning issued by the relevant water conservancy administrative department which conforms to the requirements of flood control planning should be enclosed as an appendix.

  第三章治理與防護(hù)

  Chapter III Control and Prevention

  第十八條防治江河洪水,應(yīng)當(dāng)蓄泄兼施,充分發(fā)揮河道行洪能力和水庫、洼淀、湖泊調(diào)蓄洪水的功能,加強(qiáng)河道防護(hù),因地制宜地采取定期清淤疏浚等措施,保持行洪暢通。

  Article l8 For the prevention and control of flood in rivers, attention should be paid to flood storage as well as to flood discharge. The smooth drainage of floodwater should be ensured by giving full play to flood drainage capacity of river courses and flood redistribution and storage functions of reservoirs, depressions and lakes, intensifying the protect ion of river courses and taking measures to remove and dredge silt at regular intervals in line with local conditions.

  防治江河洪水,應(yīng)當(dāng)保護(hù)、擴(kuò)大流域林草植被,涵養(yǎng)水源,加強(qiáng)流域水土保持綜合治理。

  For the prevention and control of flood in rivers, measures should be taken to protect and expand the coverage of forest, grass and other vegetation in river basins, conserve water resources and intensify the comprehensive control of water and soil conservation in river basins.

  第十九條整治河道和修建控制引導(dǎo)河水流向、保護(hù)堤岸等工程,應(yīng)當(dāng)兼顧上下游、左右岸的關(guān)系,按照規(guī)劃治導(dǎo)線實(shí)施,不得任意改變河水流向。

  Article 19 In the realigning of river courses and building up construction projects for leading the river direction or protecting embankments, full consideration should be given to the relations between the lower and upper reaches and between both sides of a river and the planned realigning and leading line be followed. The direction of a river shall not be changed at will.

  國(guó)家確定的重要江河的規(guī)劃治導(dǎo)線由流域管理機(jī)構(gòu)擬定,報(bào)國(guó)務(wù)院水行政主管部門批準(zhǔn)。

  Planned realigning and leading lines for major rivers designated by the state shall be worked out by river basin administrative agencies and submitted to the water conservancy administrative department under the State Council for approval.

  其他江河、河段的規(guī)劃治導(dǎo)線由縣級(jí)以上地方人民政府水行政主管部門擬定,報(bào)本級(jí)人民政府批準(zhǔn);

  Planned realigning and leading lines for other rivers or river courses shall be worked out by water conservancy administrative departments under local people's governments at or above the county level and submitted to the people's governments at the same level for approval.

  跨省、自治區(qū)、直轄市的江河、河段和省、自治區(qū)、直轄市之間的省界河道的規(guī)劃治導(dǎo)線由有關(guān)流域管理機(jī)構(gòu)組織江河、河段所在地的省、自治區(qū)、直轄市人民政府水行政主管部門擬定,經(jīng)有關(guān)省、自治區(qū)、直轄市人民政府審查提出意見后,報(bào)國(guó)務(wù)院水行政主管部門批準(zhǔn)。

  Planned realigning and leading lines of rivers or river courses involving two or more provinces, autonomous, regions and municipalities directly under the Central Government and of boundary river courses of provinces, autonomous regions and municipalities directly under the Central Government shall, under the leadership of river basin administrative agencies concerned, be worked out by water conservancy administrative departments under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government of involved rivers or river courses and, after the people's governments concerned examine the proposed lines and come up with comments, submitted to the water conservancy administrative department under the State Council for approval.

  第二十條整治河道、湖泊,涉及航道的,應(yīng)當(dāng)兼顧航運(yùn)需要,并事先征求交通主管部門的意見。

  Article 20 Where the realignment of river courses or lakes involves navigable waterways, full consideration should be given to the requirements for navigation and views solicited in advance from the administrative departments for transportation.

  整治航道,應(yīng)當(dāng)符合江河、湖泊防洪安全要求,并事先征求水行政主管部門的意見。

  The realignment of navigable waterways should conform to the safety requirements for flood control in rivers and lakes and views solicited in advance from the water conservancy administrative departments.

  在竹木流放的河流和漁業(yè)水域整治河道的,應(yīng)當(dāng)兼顧竹木水運(yùn)和漁業(yè)發(fā)展的需要,并事先征求林業(yè)、漁業(yè)行政主管部門的意見。

  The realignment of river courses in rivers which are suitable for bamboo and log rafting or in fishery water areas should take into account the needs for bamboo and log water transportation and fishery development and views should be sought in advance from the administrative departments for forestry and fishery.

  在河道中流放竹木,不得影響行洪和防洪工程設(shè)施的安全。

  The bamboo and log rafting in river courses should not affect the safety of flood passage and flood control works.

  第二十一條河道、湖泊管理實(shí)行按水系統(tǒng)一管理和分級(jí)管理相結(jié)合的原則,加強(qiáng)防護(hù),確保暢通。

  Article 21 The control of rivers and lakes shall follow the principle of unified control in line with water systems combined with control at different levels in order to strength the protect ion and ensure the smooth passage.

  國(guó)家確定的重要江河、湖泊的主要河段,跨省、自治區(qū)、直轄市的重要河段、湖泊,省、自治區(qū)、直轄市之間的省界河道、湖泊以及國(guó)(邊)界河道、湖泊,由流域管理機(jī)構(gòu)和江河、湖泊所在地的省、自治區(qū)、直轄市人民政府水行政主管部門按照國(guó)務(wù)院水行政主管部門的劃定依法實(shí)施管理。

  Main courses of major rivers and lakes designated by the state, major river courses and lakes involving two or more provinces, autonomous regions or municipalities directly under the Central Government, boundary rivers and lakes of provinces, ,autonomous regions or municipalities directly under the Central Government as well as river courses and lakes which serve as national boundaries (borderlines ) shall, according to the designation of the water conservancy administrative department under the State Council, be under the control of river bas in administrative agencies and water conservancy administrative departments under the people's government s of provinces, autonomous regions and municipalities directly under the Central Government in the place where rivers and lakes are drained.

  其他河道、湖泊,由縣級(jí)以上地方人民政府水行政主管部門按照國(guó)務(wù)院水行政主管部門或者國(guó)務(wù)院水行政主管部門授權(quán)的機(jī)構(gòu)的劃定依法實(shí)施管理。

  Other river courses and lakes shall, according to the designation of the water conservancy administrative department under the State Council or its authorized agencies , be under the control of water conservancy administrative departments under local people's governments at or above the county level.

  有堤防的河道、湖泊,其管理范圍為兩岸堤防之間的水域、沙洲、灘地、行洪區(qū)和堤防及護(hù)堤地;

  The scope of control for any river course or lake with embankments shall include the water area, sandbanks, beaches, the flood passage area, the embankments and dyke protect ions between the embankments on both s ides.

  無堤防的河道、湖泊,其管理范圍為歷史最高洪水位或者設(shè)計(jì)洪水位之間的水域、沙洲、灘地和行洪區(qū)。

  The scope of control for any river course or lake without embankments shall include the water area, sandbanks, beaches and the flood passage area between the all-time high flood levels or the designed flood levels.

  流域管理機(jī)構(gòu)直接管理的河道、湖泊管理范圍,由流域管理機(jī)構(gòu)會(huì)同有關(guān)縣級(jí)以上地方人民政府依照前款規(guī)定界定;

  The scope of river courses and lakes under direct control of river basin administrative agencies shall be delimited by river bas in administrative agencies in conjunction with local people's governments concerned at or above the county level in accordance with the provisions of the preceding paragraph.

  其他河道、湖泊管理范圍,由有關(guān)縣級(jí)以上地方人民政府依照前款規(guī)定界定。

  The scope of control for other river courses and lakes shall be delimited by local people's governments concerned at or above the county level in accordance with the provisions of the preceding paragraph.

  第二十二條河道、湖泊管理范圍內(nèi)的土地和岸線的利用,應(yīng)當(dāng)符合行洪、輸水的要求。

  Article 22 The use of land and shore lines within the scope of control for any river course or lake should conform to the requirements for flood discharge and water flow.

  禁止在河道、湖泊管理范圍內(nèi)建設(shè)妨礙行洪的建筑物、構(gòu)筑物,傾倒垃圾、渣土,從事影響河勢(shì)穩(wěn)定、危害河岸堤防安全和其他妨礙河道行洪的活動(dòng)。

  Within the scope of control for any river course or lake it is prohibited to construct buildings or structures impeding flood discharge, dump garbage and waste residues or engage in activities affecting the stability of river flows, harming the safety of banks and embankments or other activities impeding flood discharge in river courses.

  禁止在行洪河道內(nèi)種植阻礙行洪的林木和高稈作物。

  It is prohibited to plant trees or long-stalk crops impeding flood discharge in river courses used for flood discharge.

  在船舶航行可能危及堤岸安全的河段,應(yīng)當(dāng)限定航速。

  Restrictions of speed should be imposed in river courses where navigation of ships may endanger the safety of embankments.

  限定航速的標(biāo)志,由交通主管部門與水行政主管部門商定后設(shè)置。

  Marks for speed restrictions shall be set up upon the consultation between administrative departments for transportation and water conservancy.

  第二十三條禁止圍湖造地。已經(jīng)圍墾的,應(yīng)當(dāng)按照國(guó)家規(guī)定的防洪標(biāo)準(zhǔn)進(jìn)行治理,有計(jì)劃地退地還湖。

  Article 23 Enclosing a lake for cultivation is prohibited. Those reclaimed lakes should be put in order according to the standards set by the state for flood control and restored from farmland in a planned way.

  禁止圍墾河道。確需圍墾的,應(yīng)當(dāng)進(jìn)行科學(xué)論證,經(jīng)水行政主管部門確認(rèn)不妨礙行洪、輸水后,報(bào)省級(jí)以上人民政府批準(zhǔn)。

  Enclosing river courses for cultivation is prohibited. If enclosure is really necessary, scientific authentication should be carried out and on confirmation by the water conservancy administrative department that there is no impediment of flood discharge and water flow, submitted to the people's government at or above the provincial level for approval.

  第二十四條對(duì)居住在行洪河道內(nèi)的居民,當(dāng)?shù)厝嗣裾畱?yīng)當(dāng)有計(jì)劃地組織外遷。

  Article 24 Local people's governments should in a planned way organize residents to move out of river courses for passage of floodwater.

  第二十五條護(hù)堤護(hù)岸的林木,由河道、湖泊管理機(jī)構(gòu)組織營(yíng)造和管理。

  Article 25 Administrative agencies for rivers and lakes shall organize the planting and maintenance of protective trees along banks and embankments.

  護(hù)堤護(hù)岸林木,不得任意砍伐。

  Protective trees along banks and embankments shall not be felled without authorization.

  采伐護(hù)堤護(hù)岸林木的,須經(jīng)河道、湖泊管理機(jī)構(gòu)同意后,依法辦理采伐許可手續(xù),并完成規(guī)定的更新補(bǔ)種任務(wù)。

  If anyone intends to fell them, he must obtain the consent from administrative agencies for river courses and lakes, go through the formalities for a felling licence and complete the task of regeneration and planting of trees a s required.

  第二十六條對(duì)壅水、阻水嚴(yán)重的橋梁、引道、碼頭和其他跨河工程設(shè)施,根據(jù)防洪標(biāo)準(zhǔn),有關(guān)水行政主管部門可以報(bào)請(qǐng)縣級(jí)以上人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限責(zé)令建設(shè)單位限期改建或者拆除。

  Article 26 For those bridges, approaches, wharves and other engineering structures across a river which seriously intercept or block water, the water conservancy administrative department concerned may, according to the flood control standards, report to the people's government at or above the county level that will, within the scope of powers provided by the State Council, order the construction unit to rebuild or dismantle them within a time limit.

  第二十七條建設(shè)跨河、穿河、穿堤、臨河的橋梁、碼頭、道路、渡口、管道、纜線、取水、排水等工程設(shè)施,應(yīng)當(dāng)符合防洪標(biāo)準(zhǔn)、岸線規(guī)劃、航運(yùn)要求和其他技術(shù)要求,不得危害堤防安全,影響河勢(shì)穩(wěn)定、妨礙行洪暢通;

  Article 27 The construction of bridges, wharves, roads, ferries, pipelines, cables and engineering structures for tapping or draining water which need to cut across rivers, through rivers or embankments, or to stand on rivers should conform to flood control standards, shore lines planning, navigation requirements and other technical requirements, and shall not endanger the safety of embankments, affect the stability of river conditions or impede the smooth passage of floodwater.

  其可行性研究報(bào)告按照國(guó)家規(guī)定的基本建設(shè)程序報(bào)請(qǐng)批準(zhǔn)前,其中的工程建設(shè)方案應(yīng)當(dāng)經(jīng)有關(guān)水行政主管部門根據(jù)前述防洪要求審查同意。

  Before the feasibility study report of the involved project is to be submitted for approval according to the procedures set by the state for capital construction, the engineering construction scheme included in the report should be subjected to the examination and approval of the relevant water conservancy administrative department in accordance with the requirements for flood control as mentioned above.

  前款工程設(shè)施需要占用河道、湖泊管理范圍內(nèi)土地,跨越河道、湖泊空間或者穿越河床的,建設(shè)單位應(yīng)當(dāng)經(jīng)有關(guān)水行政主管部門對(duì)該工程設(shè)施建設(shè)的位置和界限審查批準(zhǔn)后,方可依法辦理開工手續(xù);安排施工時(shí),應(yīng)當(dāng)按照水行政主管部門審查批準(zhǔn)的位置和界限進(jìn)行。

  If engineering structures mentioned in the preceding paragraph need to occupy land within the scope of control for any river course or lake, or to cut across the space over any river course or lake, or to go through riverbeds, the construction unit should subject the pos it ion and border of the engineering structures to the examination and approval of the relevant water conservancy administrative department before completing the formalities for starting the projects according to law.

  前款規(guī)定的工程設(shè)施竣工驗(yàn)收時(shí),應(yīng)當(dāng)有水行政主管部門參加。

  In the arrangement for the construct ion project, the position and border should be followed as approved by the water conservancy administrative department.

  第二十八條對(duì)于河道、湖泊管理范圍內(nèi)依照本法規(guī)定建設(shè)的工程設(shè)施,水行政主管部門有權(quán)依法檢查;

  Article 28 The water conservancy administrative department shall have the right to inspect engineering structures constructed according to the provisions of this Law within the scope of control for river courses or lakes. When the water conservancy administrative department exercises inspect ion, the inspected should truthfully provide the information and materials concerned.

  水行政主管部門檢查時(shí),被檢查者應(yīng)當(dāng)如實(shí)提供有關(guān)的情況和資料。

  The acceptance of engineering structures mentioned in the preceding paragraph upon completion should be taken part in by the water conservancy administrative department.

  第四章防洪區(qū)和防洪工程設(shè)施的管理

  Chapter IV Administration of Flood Control Areas and Flood Control Works

  第二十九條防洪區(qū)是指洪水泛濫可能淹及的地區(qū),分為洪泛區(qū)、蓄滯洪區(qū)和防洪保護(hù)區(qū)。

  Article 29 A flood control area means an area where floodwater is likely to inundate, which is classified as a flooded area, a flood storage and detention area or a flood control protected area.

  洪泛區(qū)是指尚無工程設(shè)施保護(hù)的洪水泛濫所及的地區(qū)。

  A flooded area means an area to which floodwater reaches without the protect ion of works.

  蓄滯洪區(qū)是指包括分洪口在內(nèi)的河堤背水面以外臨時(shí)貯存洪水的低洼地區(qū)及湖泊等。

  A flood storage and detention area means a depression or a lake from outside embankments including flood--diversion mouths for temporarily storing floodwater

  防洪保護(hù)區(qū)是指在防洪標(biāo)準(zhǔn)內(nèi)受防洪工程設(shè)施保護(hù)的地區(qū)。

  A flood control protected area means an area protected by flood control works according to flood control standards.

  洪泛區(qū)、蓄滯洪區(qū)和防洪保護(hù)區(qū)的范圍,在防洪規(guī)劃或者防御洪水方案中劃定,并報(bào)請(qǐng)省級(jí)以上人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限批準(zhǔn)后予以公告。

  The scope of a flooded area, a flood storage and detention area or a flood control protected area shall be delimited in the flood control planning or the flood prevent ion scheme, reported to the people's government at or above the provincial level according to the scope of powers provided for by the State Council and if approved, announced to the public.

  第三十條各級(jí)人民政府應(yīng)當(dāng)按照防洪規(guī)劃對(duì)防洪區(qū)內(nèi)的土地利用實(shí)行分區(qū)管理。

  Article 30 People's governments at all levels should, according to flood control planning, exercise administration of the use of land within different flood control areas.

  第三十一條地方各級(jí)人民政府應(yīng)當(dāng)加強(qiáng)對(duì)防洪區(qū)安全建設(shè)工作的領(lǐng)導(dǎo),組織有關(guān)部門、單位對(duì)防洪區(qū)內(nèi)的單位和居民進(jìn)行防洪教育,普及防洪知識(shí),提高水患意見;

  Article 31 Local people's governments at all levels should strengthen leadership over the safety and construct ion work within flood control areas and organize relevant departments and units to conduct flood control education among units and residents within flood control areas, to popularize flood control know-how and to enhance their awareness of flood control.

  按照防洪規(guī)劃和防御洪水方案建立并完善防洪體系和水文、氣象、通信、預(yù)警以及洪澇災(zāi)害監(jiān)測(cè)系統(tǒng),提高防御洪水能力;

  They should, according to flood control planning and flood prevent ion schemes, establish and perfect the flood control system as well as systems for hydrology, meteorology, communications, early warning and monitoring of flood and waterlogging in order to improve the capability for flood control.

  組織防洪區(qū)內(nèi)的單位和居民積極參加防洪工作,因地制宜地采取防洪避洪措施。

  They should organize units and residents within flood control areas to actively take part in flood control work and take measures for flood control and flood evasion in the light of local conditions.

  第三十二條洪泛區(qū)、蓄滯洪區(qū)所在地的省、自治區(qū)、直轄市人民政府應(yīng)當(dāng)組織有關(guān)地區(qū)和部門,按照防洪規(guī)劃的要求,制定洪泛區(qū)、蓄滯洪區(qū)安全建設(shè),控制蓄滯洪區(qū)人口增長(zhǎng),對(duì)居住在經(jīng)常使用的蓄滯洪區(qū)的居民,有計(jì)劃地組織外遷,并采取其他必要的安全保護(hù)措施。

  Article 32 People's government s of provinces, autonomous regions and municipalities directly under the Central Government in places where flooded areas or flood storage and detention areas are located should, as required by flood control planning, organize relevant departments and units to formulate safety and construction work plans for flooded areas and flood storage and detention areas, to bring under control population growth within flood storage and detention areas, to move residents in a planned way out of flood storage and detent ion areas which are frequently in use, and to take other necessary safety and protective measures.

  因蓄滯洪區(qū)而直接受益的地區(qū)和單位,應(yīng)當(dāng)對(duì)蓄滯洪區(qū)承擔(dān)國(guó)家規(guī)定的補(bǔ)償、救助義務(wù)。

  Regions and units directly benefiting from flood storage and detention areas should bear obligations of compensation and aid to flood storage and detent ion areas as required by the state.

  國(guó)務(wù)院和有關(guān)的省、自治區(qū)、直轄市人民政府應(yīng)當(dāng)建立對(duì)蓄滯洪區(qū)的扶持和補(bǔ)償、救助制度。

  The State Council and relevant people's government s of provinces, autonomous regions and municipalities directly under the Central Government should establish a system to support and give compensations and aids to flood storage and detent ion areas.

  國(guó)務(wù)院和有關(guān)的省、自治區(qū)、直轄市人民政府可以制定洪泛區(qū)、蓄滯洪區(qū)安全建設(shè)管理辦法以及對(duì)蓄滯洪區(qū)的扶持和補(bǔ)償、救助辦法。

  The State Council and relevant people's government s of provinces, autonomous regions and municipalities directly under the Central Government may formulate measures for control of safety and construction within flooded areas and flood storage and detention areas and measures for giving support, compensations and aids to flood storage and detention areas.

  第三十三條在洪泛區(qū)、蓄滯洪區(qū)內(nèi)建設(shè)非防洪建設(shè)項(xiàng)目,應(yīng)當(dāng)就洪水對(duì)建設(shè)項(xiàng)目可能產(chǎn)生的影響和建設(shè)項(xiàng)目對(duì)防洪可能產(chǎn)生的影響作出評(píng)價(jià),編制洪水影響評(píng)價(jià)報(bào)告,提出防御措施。

  Article 33 Where a construct ion project not intended for flood control is to be carried out within a flooded area or a flood storage and detention area, the possible impact of floodwater on the construct ion project and the possible impact of the construction project on flood control should be assessed, a flood impact assessment report be provided and precautions be put forward.

  建設(shè)項(xiàng)目可行性研究報(bào)告按照國(guó)家規(guī)定的基本建設(shè)程序報(bào)請(qǐng)批準(zhǔn)時(shí),應(yīng)當(dāng)附具有關(guān)水行政主管部門審查批準(zhǔn)的洪水影響評(píng)價(jià)報(bào)告。

  When submitted for approval according to the procedures set by the state for capital construction, the feasibility study report of the construction project should include the flood impact assessment report having been examined and approved by the relevant water conservancy administrative department.

  在蓄滯洪區(qū)內(nèi)建設(shè)的油田、鐵路、公路、礦山、電廠、電信設(shè)施和管道,其洪水影響評(píng)價(jià)報(bào)告應(yīng)當(dāng)包括建設(shè)單位自行安排的防洪避洪方案。

  Flood impact assessment reports for oilfields, railways, highways, mines, power plants, telecommunications installations and pipelines to be built within flood storage and detent ion areas should include flood control and flood evasion plans arranged by construction units themselves.

  建設(shè)項(xiàng)目投入生產(chǎn)或者使用時(shí),其防洪工程設(shè)施應(yīng)當(dāng)經(jīng)水行政主管部門驗(yàn)收。

  When the construction project is to be put into operation or use, their flood control works should pass the acceptance by the water conservancy administrative department.

  在蓄滯洪區(qū)內(nèi)建造房屋應(yīng)當(dāng)采用平頂式結(jié)構(gòu)。

  Houses built within flood storage and detention areas shall have flat roofs.

  第三十四條大中城市,重要的鐵路、公路干線,大型骨干企業(yè),應(yīng)當(dāng)列為防洪重點(diǎn),確保安全。

  Article 34 Flood control work should focus on large and medium--sized cities, trunk lines of major railways and highways as well as large--sized key enterprises and their safety be guaranteed.

  受洪水威脅的城市、經(jīng)濟(jì)開發(fā)區(qū)、工礦區(qū)和國(guó)家重要的農(nóng)業(yè)生產(chǎn)基地等,應(yīng)當(dāng)重點(diǎn)保護(hù),建設(shè)必要的防洪工程設(shè)施。

  Cities, economic development zones, industrial and mining areas and important state agricultural production bases under the threat of floodwater should be protected as key areas and necessary flood control works constructed.

  城市建設(shè)不得擅自填堵原有河道溝汊、貯水湖塘洼淀和廢除原有防洪圍堤;

  1n urban construction, no one may, without authorization, stuff or block up originally existing river courses, ditches, branching streams and waterlogging lakes, pools or depressions, or demolish originally existing embankments used for flood control.

  確需填堵或者廢除的,應(yīng)當(dāng)經(jīng)水行政主管部門審查同意,并報(bào)城市人民政府批準(zhǔn)。

  If it is really necessary to stuff or block up or demolish them, consent should be obtained from the water conservancy administrative department and the cases be reported to the people's government of the city for approval.

  第三十五條屬于國(guó)家所有的防洪工程設(shè)施,應(yīng)當(dāng)按照經(jīng)批準(zhǔn)的設(shè)計(jì),在竣工驗(yàn)收前由縣級(jí)以上人民政府按照國(guó)家規(guī)定,劃定管理和保護(hù)范圍。

  Article 35 The scope of administration and protection of state--owned flood control works should be determined by people's governments at or above the county level according to the state provisions before the completion and acceptance of the projects according to the approved design.

  屬于集體所有的防洪工程設(shè)施,應(yīng)當(dāng)按照省、自治區(qū)、直轄市人民政府的規(guī)定,劃定保護(hù)范圍。

  The scope of protection of collective--owned flood control works should be determined according to the provisions of people's governments of provinces, autonomous regions and municipalities directly under the Central Government

  在防洪工程設(shè)施保護(hù)范圍內(nèi),禁止進(jìn)行爆破、打井、采石、取土等危害防洪工程設(shè)施安全的活動(dòng)。

  Within the scope of protection of flood control works, exploding, drilling wells, quarrying stones, collecting earth or other operations endangering the safety of flood control works are prohibited.

  第三十六條各級(jí)人民政府應(yīng)當(dāng)組織有關(guān)部門加強(qiáng)對(duì)水庫大壩的定期檢查和監(jiān)督管理。

  Article 36 People's governments at all levels should organize the relevant departments to intensify the regular inspection, supervision and administration over dams of reservoirs.

  對(duì)未達(dá)到設(shè)計(jì)洪水標(biāo)準(zhǔn)、抗震設(shè)防要求或者有嚴(yán)重質(zhì)量缺陷的險(xiǎn)壩,大壩主管部門應(yīng)當(dāng)組織有關(guān)單位采取除險(xiǎn)加固措施,限期消除危險(xiǎn)或者重建,有關(guān)人民政府應(yīng)當(dāng)優(yōu)先安排所需資金。

  For those dams in danger which fail to conform to the designed flood standards and anti--earthquake defence requirements, or have serious quality defects, the department in charge of the dams should organize the relevant units to take measures to eliminate dangers and reinforce dams, set a time limit to get rid of dangers or rebuild dams, and the relevant people's governments should give priority to funds needed.

  對(duì)可能出現(xiàn)垮壩的水庫,應(yīng)當(dāng)事先制定應(yīng)急搶險(xiǎn)和居民臨時(shí)撤離方案。

  For reservoirs whose dams are likely to collapse, emergency measures for rush repair and schemes for temporarily evacuating residents should be worked out in advance.

  各級(jí)人民政府和有關(guān)主管部門應(yīng)當(dāng)加強(qiáng)對(duì)屬礦壩的監(jiān)督管理,采取措施,避免因洪水導(dǎo)致垮壩。

  People's governments at all levels and the relevant administrative departments should strengthen the supervision and management of tailings dams and take measures to avoid the collapse of dams in floodwater.

  第三十七條任何單位和個(gè)人不得破壞、侵占、毀損水庫大壩、堤防、水閘、護(hù)岸、抽水站、排水渠系等防洪工程和水文、通信設(shè)施以及防汛備用的器材、物料等。

  Article 37 No unit and individual may damage, occupy or destroy flood control works such as dams, embankments, sluices, bank revetments, pumping stations and drainage systems, hydrological and communications facilities and standby apparatuses and materials for flood control.

  第五章防汛抗洪

  Chapter V Flood Control and Flood Fighting

  第三十八條防汛抗洪工作實(shí)行各級(jí)人民政府行政首長(zhǎng)負(fù)責(zé)制,統(tǒng)一指揮、分級(jí)分部門負(fù)責(zé)。

  Article 38 The administrative heads of people's governments at all levels shall assume overall responsibility for the work of flood control, with different levels and different departments responsible for part of work under a centralized command.

  第三十九條國(guó)務(wù)院設(shè)立國(guó)家防汛指揮機(jī)構(gòu),負(fù)責(zé)領(lǐng)導(dǎo)、組織全國(guó)的防汛抗洪工作,其辦事機(jī)構(gòu)設(shè)在國(guó)務(wù)院水行政主管部門。

  Article 39 The State Council establishes the state flood control headquarters responsible for leading and organizing the flood control and flood fighting work nationwide, with its agency in the water conservancy administrative department under the State Council.

  在國(guó)家確定的重要江河、湖泊可以設(shè)立由有關(guān)省、自治區(qū)、直轄市人民政府和該江河、湖泊的流域管理機(jī)構(gòu)負(fù)責(zé)人等組成的防汛指揮機(jī)構(gòu),指揮所管轄范圍內(nèi)的防汛抗洪工作,其辦事機(jī)構(gòu)設(shè)在流域管理機(jī)構(gòu)。

  The flood control headquarters for major rivers and lakes designated by the state may be established and formed by persons in charge of the relevant people's governments of provinces, autonomous regions and municipalities directly under the Central Government and persons in charge of the administrative agencies for these rivers and lakes, which shall take control of the flood control and flood fighting work within their jurisdiction and have their agencies in the administrative agencies for rivers and lakes.

  有防汛抗洪任務(wù)的縣級(jí)以上地方人民政府設(shè)立由有關(guān)部門、當(dāng)?shù)伛v軍、人民武裝部負(fù)責(zé)人等組成的防汛指揮機(jī)構(gòu),

  Local people's governments at or above the county level responsible for flood control and flood fighting shall establish flood control headquarters formed by persons in charge of the relevant departments, local garrisons and the people's armed forces departments.

  在上級(jí)防汛指揮機(jī)構(gòu)和本級(jí)人民政府的領(lǐng)導(dǎo)下,指揮本地區(qū)的防汛抗洪工作,其辦事機(jī)構(gòu)設(shè)在同級(jí)水行政主管部門;

  Under the leadership of the flood control headquarters at the next higher level and the people's governments at the same level, the flood control headquarters shall take control of the work of flood control and flood fighting and have their agencies in the water conservancy administrative departments at the same level.

  必要時(shí),經(jīng)城市人民政府決定,防汛指揮機(jī)構(gòu)也可以在建設(shè)行政主管部門設(shè)城市市區(qū)辦事機(jī)構(gòu),在防汛指揮機(jī)構(gòu)的統(tǒng)一領(lǐng)導(dǎo)下,負(fù)責(zé)城市市區(qū)的防汛抗洪日常工作。

  When necessary, the flood control headquarters may, subject to the decision of people's governments of cities , establish city district agencies under the construction departments with responsibility for handling routine duties of flood control and flood fighting in urban districts under the unified leadership of the flood control headquarters.

  第四十條有防汛抗洪任務(wù)的縣級(jí)以上地方人民政府根據(jù)流域綜合規(guī)劃、防洪工程實(shí)際狀況和國(guó)家規(guī)定的防洪標(biāo)準(zhǔn),制定防御洪水方案(包括對(duì)特大洪水的處置措施)。

  Article 40 Local people's governments at or above the county level responsible for flood control and flood fighting shall, in accordance with the comprehensive plans for river basins, in the light of the actual conditions of flood control works and based on the flood control standards set by the state, formulate the flood prevention schemes (including the measures for dealing with catastrophic floods).

  長(zhǎng)江、黃河、淮河、海河的防御洪水方案,由國(guó)家防汛指揮機(jī)構(gòu)制定,報(bào)國(guó)務(wù)院批準(zhǔn);

  Flood prevention schemes for the Yangtze River, Yellow River, Huai River and Hai River shall be formulated by the state flood control headquarters and submitted to the State Council for approval.

  跨省、自治區(qū)、直轄市的其他江河的防御洪水方案,由有關(guān)流域管理機(jī)構(gòu)會(huì)同有關(guān)省、自治區(qū)、直轄市人民政府制定,報(bào)國(guó)務(wù)院或者國(guó)務(wù)院授權(quán)的有關(guān)部門批準(zhǔn)。

  Flood prevention schemes for other rivers involving two or more provinces, autonomous regions and municipalities directly under the Central Government shall be formulated by the relevant river basins administrative agencies in conjunct ion with the relevant people's government s of provinces, autonomous regions and municipalities directly under the Central Government and submitted to the State Council or its authorized agency for approval.

  防御洪水方案經(jīng)批準(zhǔn)后,有關(guān)地方人民政府必須執(zhí)行。

  0n approval, the flood prevention schemes shall be carried out by the local people's governments concerned.

  各級(jí)防汛指揮機(jī)構(gòu)和承擔(dān)防汛抗洪任務(wù)的部門和單位,必須根據(jù)防御洪水方案做好防汛抗洪準(zhǔn)備工作。

  Flood control headquarters at all levels and departments or units responsible for flood control and flood fighting must make preparations for flood control and flood fighting according to the flood prevent ion schemes.

  第四十一條省、自治區(qū)、直轄市人民政府防汛指揮機(jī)構(gòu)根據(jù)當(dāng)?shù)氐暮樗?guī)律,規(guī)定汛期起止日期。

  Article 41 Flood control headquarters under people's government s of provinces, autonomous regions and municipalities directly under the Central Government shall, according to the law of floods in their localities, fix the starting and ending date for flood seasons.

  當(dāng)江河、湖泊的水情接近保證水位或者安全流量,水庫水位接近設(shè)計(jì)洪水位,或者防洪工程設(shè)施發(fā)生重大險(xiǎn)情時(shí),有關(guān)縣級(jí)以上人民政府防汛指揮機(jī)構(gòu)可以宣布進(jìn)入緊急防汛期。

  When the water situation of any river or lake approaches the guaranteed water level or the safety flow capacity, or when the water level of any reservoir approaches the level of design flood, or when a great danger occurs to flood control works, the flood control headquarters under the relevant people's government at or above the county level may declare an emergency flood season.

  第四十二條對(duì)河道、湖泊范圍內(nèi)阻礙行洪的障礙物,按照誰設(shè)障、誰清除的原則,由防汛指揮機(jī)構(gòu)責(zé)令限期清除;

  Article 42 Obstacles in river courses or lakes which impede flood passage shall, according to the principle of whoever places the obstacles will remove them, be removed within a time limit by order of the flood control headquarters.

  逾期不清除的,由防汛指揮機(jī)構(gòu)組織強(qiáng)行清除,所需費(fèi)用由設(shè)障者承擔(dān)。

  If obstacles have not yet been removed within the time limit, the flood control headquarters shall organize a forcible removal at the expense of the person who placed the obstacles.

  在緊急防汛期,國(guó)家防汛指揮機(jī)構(gòu)或者其授權(quán)的流域、省、自治區(qū)、直轄市防汛指揮機(jī)構(gòu)有權(quán)對(duì)壅水、阻水嚴(yán)重的橋梁、引道、碼頭和其他跨河工程設(shè)施作出緊急處置。

  During the emergency flood reason, the state flood control headquarters or its authorized flood control headquarters in provinces, autonomous regions and municipalities directly under the Central Government shall have the right to take emergency measures against bridges, approaches, wharves and other engineering structures across a river which seriously intercept or block water .

  第四十三條在汛期,氣象、水文、海洋等有關(guān)部門應(yīng)當(dāng)按照各自的職責(zé),及時(shí)向有關(guān)防汛指揮機(jī)構(gòu)提供天氣、水文等實(shí)時(shí)信息和風(fēng)暴潮預(yù)報(bào);

  Article 43 During the flood reason, departments concerned of meteorology, hydrology and oceanology should provide real--time information on weather and hydrology as well as forecasts of storm tides for the relevant flood control headquarters within their respective functions and duties,

  電信部門應(yīng)當(dāng)優(yōu)先提供防汛抗洪通信的服務(wù);運(yùn)輸、電力、物資材料供應(yīng)等有關(guān)部門應(yīng)當(dāng)優(yōu)先為防汛抗洪服務(wù)。

  the telecommunications departments should give priority to providing services for communications for flood control and flood fighting, and departments concerned of transportation, electricity and supply of materials should give priority to providing services for flood control and flood fighting.

  中國(guó)人民解放軍、中國(guó)人民武裝警察部隊(duì)和民兵應(yīng)當(dāng)執(zhí)行國(guó)家賦予的抗洪搶險(xiǎn)任務(wù)。

  The People's Liberation Army, the People's Armed Police Forces and the militia should perform duties of flood fighting and emergency operations entrusted by the state.

  第四十四條在汛期,水庫、閘壩和其他水工程設(shè)施的運(yùn)用,必須服從有關(guān)的防汛指揮機(jī)構(gòu)的調(diào)度指揮和監(jiān)督。

  Article 44 During the flood reason, the use of reservoirs, sluices, dams and other water engineering structures must be subjected to the command, control and supervision of the relevant flood control headquarters.

  在汛期,水庫不得擅自在汛期限制水位以上蓄水,其汛期限制水位以上的防洪庫容的運(yùn)用,必須服從防汛指揮機(jī)構(gòu)的調(diào)度指揮和監(jiān)督。

  During the flood season, no reservoir may store water above the flood season restricted level without authorization and the use of flood control capacity beyond the flood season restricted level of any reservoir must be subjected to the command, control and supervision of the relevant flood control headquarters

  在凌汛期,有防凌汛任務(wù)的江河的上游水庫的下泄水量必須征得有關(guān)的防汛指揮機(jī)構(gòu)的同意,并接受其監(jiān)督。

  During the melting ice flood season, any reservoir upstream a river or lake responsible for the control of melting ice flood must obtain the consent of the relevant flood control headquarters and be subject to its supervision when discharging its flow down stream.

  第四十五條在緊急防汛期,防汛指揮機(jī)構(gòu)根據(jù)防汛抗洪的需要,有權(quán)在其管轄范圍內(nèi)調(diào)用物資、設(shè)備、交通運(yùn)輸工具和人力,決定采取取土占地、砍伐林木、清除阻水障礙物和其他必要的緊急措施;

  Article 45 During the emergency flood season, the flood control headquarters shall, according to the requirements for flood control and flood fighting, have the right to al locate material s, equipment, means of transport and manpower within their jurisdiction and to make decisions for collecting earth, occupying land, felling trees, removing obstacles blocking water and taking other necessary emergency measures.

  必要時(shí),公安、交通等有關(guān)部門按照防汛指揮機(jī)構(gòu)的決定,依法實(shí)施陸地和水面交通管制。

  When necessary, departments for public security and traffic control shall, according to the decision of the flood control headquarters, execute traffic control on land and in water areas.

  依照前款規(guī)定調(diào)用的物資、設(shè)備、交通運(yùn)輸工具等,在汛期結(jié)束后應(yīng)當(dāng)及時(shí)歸還;

  Materials, equipment and means of transport allocated according to the provisions of the preceding paragraph should be returned promptly after the flood season.

  造成損壞或者無法歸還的,按照國(guó)務(wù)院有關(guān)規(guī)定給予適當(dāng)補(bǔ)償或者作其他處理。

  If they have been damaged or are unable to be returned, proper compensations should be given or other measures be taken according to the relevant state provisions.

  取土占地、砍伐林木的,在汛期結(jié)束后依法向有關(guān)部門補(bǔ)辦手續(xù);

  Those who collected earth, occupied land or felled trees shall apply to the competent department for completing required formalities according to law after the flood season.

  有關(guān)地方人民政府對(duì)取土后的土地組織復(fù)墾,對(duì)砍伐的林木組織補(bǔ)種。

  The local People's government concerned shall organize the reclamation of land on which earth was collected and organize the planting of trees In the place where trees were felled.

  第四十六條江河、湖泊水位或者流量達(dá)到國(guó)家規(guī)定的分洪標(biāo)準(zhǔn),需要啟用蓄滯洪區(qū)時(shí),國(guó)務(wù)院,國(guó)家防汛指揮機(jī)構(gòu),流域防汛指揮機(jī)構(gòu),省、自治區(qū)、直轄市人民政府,省、自治區(qū)、直轄市防汛指揮機(jī)構(gòu),按照依法經(jīng)批準(zhǔn)的防御洪水方案中規(guī)定的啟用條件和批準(zhǔn)程序,決定啟用蓄滯洪區(qū)。

  Article 46 Where the water level or the flow of any river or lake attains the flood divers on standards of the state which needs to put a flood storage and detention area in use,the State Council,the state flood control headquarters the flood control headquarters of the river basin, the people's government and the flood control headquarters of the province,autonomous region or municipality directly under the Central Government shall,according to the conditions for starting the use of a flood storage and detention area and approval procedures stipulated in the approved flood prevention scheme,make a decision on starting the use of the flood storage and detention area.

  依法啟用蓄滯洪區(qū),任何單位和個(gè)人不得阻攔、拖延;

  No unit or individual may obstruct or delay the use of a flood storage and detention area.

  遇到阻攔、拖延時(shí),由有關(guān)縣級(jí)以上地方人民政府強(qiáng)制實(shí)施。

  In the event of someone's obstruction or delay,the relevant local people's government at or above the county level shall execute the use forcibly.

  第四十七條發(fā)生洪澇災(zāi)害后,有關(guān)人民政府應(yīng)當(dāng)組織有關(guān)部門、單位做好災(zāi)區(qū)的生活供給、衛(wèi)生防疫、救災(zāi)物資供應(yīng)、治安管理、學(xué)校復(fù)課、恢復(fù)生產(chǎn)和重建家園等救災(zāi)工作以及所管轄地區(qū)的各項(xiàng)水毀工程設(shè)施修復(fù)工作。

  Article 47 After the occurrence of flood and waterlogging,the relevant people's government should organize the relevant departments and units to ensure the relief work in the disaster area in respect of supply of necessities health care and immunity,supply of relief materials,public security,resumption of classes,resumption of production and rebuilding of homes as well as repairing of various engineering structures destroyed in floodwater within its jurisdiction.

  水毀防洪工程設(shè)施的修復(fù),應(yīng)當(dāng)優(yōu)先列入有關(guān)部門的年度建設(shè)計(jì)劃。

  The renovation of flood control works should take precedence in the annual construction plans of the relevant departments.

  國(guó)家鼓勵(lì)、扶持開展洪水保險(xiǎn)。

  The state encourages and supports the flood insurance.

  第六章保障措施

  Chapter VI Guarantee Measures

  第四十八條各級(jí)人民政府應(yīng)當(dāng)采取措施,提高防洪投入的總體水平。

  Article 48 People's governments at all levels should take measures to improve the overall level of flood control allocations.

  第四十九條江河、湖泊的治理和防洪工程設(shè)施的建設(shè)和維護(hù)所需投資,按照事權(quán)和則權(quán)相統(tǒng)一的原則,分級(jí)負(fù)責(zé),由中央和地方財(cái)政承擔(dān)。

  Article 49 Realignment of rivers and lakes and construction and maintenance of flood control works shall,according to the principle of consistency of business power and financial power,and with responsibility divided at different levels,be financed by the Central authorities and local authorities respectively.

  城市防洪工程設(shè)施的建設(shè)和維護(hù)所需投資,由城市人民政府承擔(dān)。

  The construction and maintenance of flood control works in cities shall be financed by the people's governments of cities.

  受洪水威脅地區(qū)的油田、管道、鐵路、公路、礦山、電力、電信等企業(yè)、事業(yè)單位應(yīng)當(dāng)自籌資金,興建必要的防洪自保工程。

  Enterprises and institutions in charge of oilfields,pipelines,railways mines,electric power and telecommunications in flood-threatened areas shall raise funds by themselves to build up necessary self-securing flood control works.

  第五十條中央財(cái)政應(yīng)當(dāng)安排資金,用于國(guó)家確定的重要江河、湖泊的堤壩遭受特大洪澇災(zāi)害時(shí)的抗洪搶險(xiǎn)和水毀防洪工程修復(fù)。

  Article 50 The Central finance should allocate funds for flood fighting and emergency operations when embankments and dams of major rivers and lakes designated by the state suffer catastrophic floods and waterlogging and for renovation of flood control works destroyed by floodwater.

  省、自治區(qū)、直轄市人民政府應(yīng)當(dāng)在本級(jí)財(cái)政預(yù)算中安排資金,用于本行政區(qū)域內(nèi)遭受特大洪澇災(zāi)害地區(qū)的抗洪搶險(xiǎn)和水毀防洪工程修復(fù)。

  People's governments of provinces,autonomous regions and municipalities directly under the Central Government should allocate funds from financial budgets at their level for flood fighting and emergency operations In areas afflicted by catastrophic floods and waterlogging within their administrative regions and for renovation of flood control works destroyed by floodwater.

  第五十一條國(guó)家設(shè)立水利建設(shè)基金,用于防洪工程和水利工程的維護(hù)和建設(shè)。具體辦法由國(guó)務(wù)院規(guī)定。

  Article 5l The state establishes a fund for water conservancy projects for the purpose of the maintenance and construction of flood control works and water conservancy works. The State Council shall stipulate the specific measures for this fund.

  受洪水威脅的省、自治區(qū)、直轄市為加強(qiáng)本行政區(qū)域內(nèi)防洪工程設(shè)施建設(shè),提高防御洪水能力,按照國(guó)務(wù)院的有關(guān)規(guī)定,可以規(guī)定在防洪保護(hù)區(qū)范圍內(nèi)征收河道工程修建維護(hù)管理費(fèi)。

  The provinces, autonomous regions and municipalities directly under the Central Government threatened by floodwater may, for the purpose of strengthening the construction of flood control works and improving the capacity for flood control within their administrative regions and according to the relevant provisions of the State Council, stipulate the levying of a fee for construction, maintenance and administration of river course projects within flood control protected areas.

  第五十二條有防洪任務(wù)的地方各級(jí)人民政府應(yīng)當(dāng)根據(jù)國(guó)務(wù)院的有關(guān)規(guī)定,安排一定比例的農(nóng)村義務(wù)工和勞動(dòng)積累工,用于防洪工程設(shè)施的建設(shè)、維護(hù)。

  Article 52 Local people's governments at all levels responsible for flood control should, according to the relevant provisions of the State Council, assign village compulsory labor and accumulative labor at a proper ratio for the construction and maintenance of flood control works.

  第五十三條任何單位和個(gè)人不得截留、挪用防洪、救災(zāi)資金和物資。

  Article 53 No unit or individual may intercept or appropriate funds and materials for flood control and disaster relief.

  各級(jí)人民政府審計(jì)機(jī)關(guān)應(yīng)當(dāng)加強(qiáng)對(duì)防洪、救災(zāi)資金使用情況的審計(jì)監(jiān)督。

  Auditing organs of people's governments at all levels should strengthen the supervision through auditing of the use of funds for flood control and disaster relief.

  第七章法律責(zé)任

  Chapter VII Legal Liability

  第五十四條違反本法第十七條規(guī)定,未經(jīng)水行政主管部門簽署規(guī)劃同意書,擅自在江河、湖泊上建設(shè)防洪工程和其他水工程、水電站的,責(zé)令停止違法行為,補(bǔ)辦規(guī)劃同意書手續(xù);

  Article 54 Any violator of the provisions of Article l7 of this Law who, without his consent document for planning approved by the water conservancy administrative department, builds flood control works or other hydraulic works and hydropower stat ions on rivers and lakes shall be ordered to stop the illegal act and complete the formalities for the consent document for planning.

  違反規(guī)劃同意書的要求,嚴(yán)重影響防洪的,責(zé)令限期拆除;

  In case where violation of requirements in the consent document for planning seriously affects flood control, the violator shall be ordered to dismantle his works within a time limit.

  違反規(guī)劃同意書的要求,影響防洪但尚可采取補(bǔ)救措施的,責(zé)令限期采取補(bǔ)救措施,可以處一萬元以上十萬元以下的罰款。

  In case where violation of requirements in the consent document for planning affects flood control but remedies can be taken, the violator shall be ordered to take remedies within a time limit and may be concurrently fined not less than RMB 10, 000 yuan and not more than RMB 100, 000 yuan.

  第五十五條違反本法第十九條規(guī)定,未按照規(guī)劃治導(dǎo)線整治河道和修建控制引導(dǎo)河水流向、保護(hù)堤岸等工程,影響防洪的,責(zé)令停止違法行為,恢復(fù)原狀或者采取其他補(bǔ)救措施,可以處一萬元以上十萬元以下的罰款。

  Article 55 Any violator of the provisions of Article 19 of this Law who fails to follow the planned realigning and leading line to realign river courses and build up construct ion projects for leading the river direction or protecting embankments shall, if the flood control work is affected, be ordered to stop the illegal act, restore to the original state or take other remedies and may be concurrently fined not less than RMB 10, 000 yuan and not more than RMB 100, 000 yuan.

  第五十六條違反本法第二十二條第二款、第三款規(guī)定,有下列行為之一的,責(zé)令停止違法行為,排除阻礙或者采取其他補(bǔ)救措施,可以處五萬元以下的罰款:

  Article 56 Any violator of the provisions of the second and third paragraphs of Article 22 of this Law who commits one of the following acts shall be ordered to stop the illegal act, remove the obstacles or take other remedies and may be concurrently fined not more than RMB 50, 000 yuan:

  (一)在河道、湖泊管理范圍內(nèi)建設(shè)妨礙行洪的建筑物、構(gòu)筑物的;

  (1) Constructing buildings or structures impeding flood discharge within the scope of control for river courses and lakes;

  (二)在河道、湖泊管理范圍內(nèi)傾倒垃圾、渣土,從事影響河勢(shì)穩(wěn)定、危害河岸堤防安全和其他妨礙河道行洪的活動(dòng)的;

  (2) Dumping garbage and waste residues or engaging in activities affecting the stability of river flows, harming the safety of banks and embankments or other activities impeding flood discharge in river courses within the scope of control for river courses and lakes; or

  (三)在行洪河道內(nèi)種植阻礙行洪的林木和高稈作物的。

  (3) Planting trees or long--stalk crops impeding flood discharge in river courses used for flood discharge.

  第五十七條違反本法第十五條第二款、第二十三條規(guī)定,圍海造地、圍湖造地、圍墾河道的,責(zé)令停止違法行為,恢復(fù)原狀或者采取其他補(bǔ)救措施,可以處五萬元以下的罰款;

  Article 57 Any violator of the provisions of the second paragraph of Article 15 and Article 23 of this Law who reclaims land from seawaters or encloses a lake or river course for cultivation shall be ordered to stop the illegal act, restore land to the original state or take other remedies and may be concurrently fined not more than RMB 50, 000 yuan.

  既不恢復(fù)原狀也不采取其他補(bǔ)救措施的,代為恢復(fù)原狀或者采取其他補(bǔ)救措施,所需費(fèi)用由違法者承擔(dān)。

  If the violator neither restores land to the original state nor takes other remedies, the competent department shall do so at his expense.

  第五十八條違反本法第二十七條規(guī)定,未經(jīng)水行政主管部門對(duì)其工程建設(shè)方案審查同意或者未按照有關(guān)水行政主管部門審查批準(zhǔn)的位置、界限,在河道、湖泊管理范圍內(nèi)從事工程設(shè)施建設(shè)活動(dòng)的,責(zé)令停止違法行為,補(bǔ)辦審查同意或者審查批準(zhǔn)手續(xù);

  Article 58 Any violator of the provisions of Article 27 of this Law who fails to obtain approval for its engineering construction scheme from the relevant water conservancy administrative department, or fails to follow the posit ion and border as approved by the water conservancy administrative department in engaging in the construct ion of engineering structures within the scope of control for river courses and lakes shall be ordered to stop the illegal act and to complete the formalities for examination and approval.

  工程設(shè)施建設(shè)嚴(yán)重影響防洪的,責(zé)令限期拆除,逾期不拆除的,強(qiáng)行拆除,所需費(fèi)用由建設(shè)單位承擔(dān);

  If the construction of engineering structures seriously affects the flood control work, the violator shall be ordered to dismantle them within a time limit. If he fails to do so within the time limit, the competent department shall dismantle them forcibly at the construct ion unit's expense.

  影響行洪但尚可采取補(bǔ)救措施的,責(zé)令限期采取補(bǔ)救措施,可以處一萬元以上十萬元以下的罰款。

  If remedies can be taken for impact on the discharge of flood, the violator shall be ordered to take remedies within a time limit and may be concurrently fined not less than RMB 10, 000 yuan and not more than RMB 100, 000 yuan.

  第五十九條違反本法第三十三條第一款規(guī)定,在洪泛區(qū)、蓄滯洪區(qū)內(nèi)建設(shè)非防洪建設(shè)項(xiàng)目,未編制洪水影響評(píng)價(jià)報(bào)告的,責(zé)令限期改正;逾期不改正的,處五萬元以下的罰款。

  Article 59 Any violator of the provisions of the first paragraph of Article 33 of this Law who fails to provide a flood impact assessment report for a construction project not intended for flood control within a flooded area or a flood storage and detention area shall be ordered to make corrections within a time limit. If he fails to do so within the time limit, the violator shall be fined not more than RMB 50, 000 yuan.

  違反本法第三十三條第二款規(guī)定,防洪工程設(shè)施未經(jīng)驗(yàn)收,即將建設(shè)項(xiàng)目投入生產(chǎn)或者使用的,責(zé)令停止生產(chǎn)或者使用,限期驗(yàn)收防洪工程設(shè)施,可以處五萬元以下的罰款。

  Any violator of the provisions of the second paragraph of Article 33 of this Law who puts the construction project in operation or use while the flood control works have not yet passed the acceptance by the water conservancy administrative department shall be ordered to stop the product ion or use, pass the acceptance of the flood control works within a time limit and may be concurrently fined not more than RMB 50, 000 yuan.

  第六十條違反本法第三十四條規(guī)定,因城市建設(shè)擅自填堵原有河道溝汊、貯水湖塘洼淀和廢除原有防洪圍堤的,城市人民政府應(yīng)當(dāng)責(zé)令停止違法行為,限期恢復(fù)原狀或者采取其他補(bǔ)救措施。

  Article 60 Any violator of the provisions of Article 34 of this Law who, without authorization, stuffs or blocks up originally existing river courses, ditches, branching streams and waterlogging lakes, pools or depressions, or demolishes originally exiting embankments used for flood control in urban construction shall be ordered by the people's government of the city to stop the illegal act, restore to the original state or take other remedies.

  第六十一條違反本法規(guī)定,破壞、侵占、毀損堤防、水閘、護(hù)岸、抽水站、排水渠系等防洪工程和水文、通信設(shè)施以及防汛備用的器材、物料的,責(zé)令停止違法行為,采取補(bǔ)救措施,可以處五萬元以下的罰款;

  Article 61 Any violator of this Law who damages, occupies or destroys embankments, sluices, bank revetments, pumping stations, drainage systems or other flood control works, or hydrological or communications facilities, or stand--by apparatuses or materials for flood control shall be ordered to stop the illegal act, take remedies and may be concurrently fined not more than RMB 50, 000 yuan.

  造成損壞的,依法承擔(dān)民事責(zé)任;應(yīng)當(dāng)給予治安管理處罰的,依照治安管理處罰條例的規(guī)定處罰;構(gòu)成犯罪的,依法追究刑事責(zé)任。

  If damage has been caused, the violator shall bear civil liability according to law. Should an administrative penalty be given, the Regulations on Administrative Penalties for Public Security shall apply. If a crime has been constituted, criminal liability shall be investigated according to law.

  第六十二條阻礙、威脅防汛指揮機(jī)構(gòu)、水行政主管部門或者流域管理機(jī)構(gòu)的工作人員依法執(zhí)行職務(wù),構(gòu)成犯罪的,依法追究刑事責(zé)任;尚不構(gòu)成犯罪,應(yīng)當(dāng)給予治安管理處罰的,依照治安管理處罰條例的規(guī)定處罰。

  Article 62 Whoever obstructs or threatens any functionary of the flood control headquarters,water conservancy administrative departments or river basin administrative agencies who performs duties according to law shall, If a crime has been constituted,be investigated for criminal liability according to law. If a crime has not been constituted and administrative penalty for public security should be given,the Regulations on Administrative Penalties for Public Security shall apply.

  第六十三條截留、挪用防洪、救災(zāi)資金和物資,構(gòu)成犯罪的,依法追究刑事責(zé)任;尚不構(gòu)成犯罪的,給予行政處分。

  Article 63 Whoever intercepts or appropriates funds and materials for flood control and disaster relief shall,If a crime has been constituted,be investigated for criminal liability according to law. If a crime has not been constituted,administrative sanctions shall be given.

  第六十四條除本法第六十條的規(guī)定外,本章規(guī)定的行政處罰和行政措施,由縣級(jí)以上人民政府水行政主管部門決定,或者由流域管理機(jī)構(gòu)按照國(guó)務(wù)院水行政主管部門規(guī)定的權(quán)限決定。

  Article 64 Administrative penalties and administrative measures stipulated in this Chapter with exception of the provisions in Article 60 of this Law shall be decided by water conservancy administrative departments of people's governments at or above the county level,or by river basin administrative agencies within the scope of powers provided for by the water conservancy administrative department under the State Council.

  但是,本法第六十一條、第六十二條規(guī)定的治安管理處罰的決定機(jī)關(guān),按照治安管理處罰條例的規(guī)定執(zhí)行。

  However,administrative penalties for public security stipulated in Articles 61 and 62 of this Law shall be decided by organs as provided for in the Regulations on the Administrative Penalty for Public Security.

  第六十五條國(guó)家工作人員,有下列行為之一,構(gòu)成犯罪的,依法追究刑事責(zé)任;尚不構(gòu)成犯罪的,給予行政處分:

  Article 65 Any state functionary who commits one of the following acts shall,if the act has constituted a crime,be investigated for criminal liability according to law. If a crime has not been constituted,administrative sanctions shall be given.

 ?。ㄒ唬┻`反本法第十七條、第十九條、第二十二條第二款、第二十二條第三款、第二十七條或者第三十四條規(guī)定,嚴(yán)重影響防洪的;

 ?。?)In violation of the provisions of Article 17,Article 19,the second or third paragraph of Article 22,Article 27 or Article 34,affecting flood control seriously;

 ?。ǘE用職權(quán),玩忽職守,徇私舞弊,致使防汛抗洪工作遭受重大損失的;

 ?。?)Abusing power,neglecting duties or engaging in malpractices for personal gains resulting in heavy losses to the flood control and flood fighting work

 ?。ㄈ┚懿粓?zhí)行防御洪水方案、防汛搶險(xiǎn)指令或者蓄滯洪方案、措施、汛期調(diào)度運(yùn)用計(jì)劃等防汛調(diào)度方案的;

  (3)Refusing to implement the flood prevention schemes,flood control and emergency operational instructions or flood control operational plans such as flood storage and detention plans or measures,or dispatching and operation plans in flood seasons; or

 ?。ㄋ模┻`反本法規(guī)定,導(dǎo)致或者加重毗鄰地區(qū)或者其他單位洪災(zāi)損失的。

 ?。?)In violation of the provisions of this Law,causing or aggravating flood losses to contiguous regions or other units.

  第八章附則

  Chapter VIII Supplementary Provision

  第六十六條本法自1998年1月1日起施行。

  Article 66 This Law shall come into force as of January, 1998.
